SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. San Diego (KGTV)- Homes and businesses aren't the only things being affected by power shut-offs Thursday. Traffic lights are also out, and it's causing a lot of confusion for drivers. Just before 10 a.m., a crash happened at the intersection of Poway Road and Highway 67, where the traffic lights had no power. A car slammed into the side of an SUV. Good Samaritans ran through traffic to assist and call 911. Both drivers are expected to be okay. Hours earlier, traffic backed up for about half a mile during the morning rush hour. Drivers were confused about their turn to go. "A lot of these people have been coming to this intersection for 30-plus years," says Deputy Nicholas McGregor. "They have an expectation that when they get here, it's going to be smooth, flow traffic. So when the lights go out, I think it's a hazard."Wednesday night, a car rammed into the back of a truck after power was shut off at the intersection of Scripps Poway Parkway and Highway 67. The car burst into flames moments after the crash.The Sheriff's Department says there are only about two hours of battery life on the traffic lights after the power is shut off. SAN DIEGO (KGTV): Wall Street set a record last week for the longest "Bull" run in US Stock Market history, topping 3,400 days of growth. Now, financial experts are saying it won't last forever and advising clients to prepare for a downturn."You have to expect at some point, we're due," says Dennis Brewster of SagePoint Financial. "I think everybody's almost forgotten, look at earlier in the year, how sharp the markets broke back in February. So it wouldn't be unusual to see any of those declines coming up later this year or early next year."Brewster says he doesn't expect anything as drastic as 2008, but he still says investors should take a few steps to safeguard their earnings and even make the downturn work in your favor.A lot of it, he says, depends on how close you are to retirement."When you look at the year to year returns, they're all over the board. When you look at the 20-30 year returns they're very close," says Brewster. "If you're younger and have 20-30 year horizons, the day to day gyrations are almost noise to you. But if you're getting closer to retirement or in retirement, then you have to be more careful."'Brewster looked up numbers from the S&P 500 for the last 20 years. He says someone who invested ,000 in 1998 would have lost about ,300 after the crash in 2008. But if they kept their money in until 2018, that same ,000 investment would now be worth more than ,000.He says older investors should be more conservative with their portfolios. SAN FRANCISCO (AP) — Archaeologists have confirmed a long-time suspicion of historians and say that famed Alcatraz prison was built over a Civil War-era military fortification.SFGate reports researchers have found a series of buildings and tunnels under the prison yard of Alcatraz Federal Penitentiary, which once held Al Capone.A study published in "Near Surface Geophysics" says archaeologists used ground-penetrating radar and terrestrial laser scans and historical maps and photographs.They found fully buried structures, ammunition magazines and tunnels.Historians believe workers built over existing structures when the prison was built in the 20th century.Alcatraz first came to the attention of the U.S. government after it wrestled control of California from Mexico in the 1840s.Its location in San Francisco Bay made it attractive for military fortification purposes. 886
