SAN DIEGO (KGTV) - The Rancho Bernardo area could be getting its first legal marijuana dispensary.Will Senn, the President and Founder of URBN Leaf, has plans to open a dispensary in a strip mall at 16375 Bernardo Center Drive, just east of the 15 Freeway.A Conditional Use Permit filed with the city says it will be a 6,647 square foot business, the first of its kind in City Council District 5."There's a big demand, for sure," says Senn. His company owns two other URBN Leaf stores in San Diego County. He says people from the Rancho Bernardo area drive to his other locations frequently. He also says they receive delivery requests to the neighborhood. "We're excited about the opportunity, we think the community does need it," says Senn.Community members disagree. They say it's the wrong place for a dispensary.City law allows just four dispensaries per City Council District. Right now there are none in District 5, which includes Rancho Bernardo, Scripps Ranch, Carmel Mountain, Rancho Penasquitos, Torrey Highlands and San Pasqual.There are already 23 other marijuana dispensaries operating throughout San Diego.Senn's permit application is the only one on file with the city for District 5.The city's rules governing the placement of dispensaries say they must be at least, "1,000 feet from resource and population-based city parks, churches, child care centers, playgrounds, libraries owned and operated by the City of San Diego, minor-oriented facilities, residential care facilities, and schools."Opponents say the new dispensary would be within 1,000 feet of the Hope United Lutheran Church on Bernardo Center Drive. They also say two other storefronts within the strip mall qualify as "minor-oriented facilities," the Kumon Math and Reading Center, and the Little Artists studio.Senn says that's not the case."We're 1,000 feet away from the church," he says. "And there is some language in other projects that have been approved by the planning commission that is consistent with our project."Opponents will have their chance to voice their concerns Tuesday night at the Rancho Bernardo Development Review Committee Meeting. It will be held at 6 pm at the Rancho Bernardo Library on 17110 Bernardo Center Drive.Senn says he plans to listen to all of the comments and take the community's concerns to heart. But, he adds that his company's track record of running other dispensaries makes them good partners who know how to operate legally."We like to tread lightly and be delicate when we enter a new market," says Senn. "But we do have experience. We've been doing this for a long time. And there's no better company prepared to enter a market like Rancho Bernardo than Urbn Leaf." 2706

SAN DIEGO (KGTV) -- The San Diego County Office of Education says schools may hold on-campus classes beginning Tuesday under new guidance. The updated county health orders that take effect June 16 allows all schools -- with the exception of colleges and universities -- to hold on-campus classes as long as the schools comply with measures outlined by the California Department of Public Health.Those measures include face coverings required at all times, daily temperature checks recommended, increased emphasis on hand washing and sanitizing, enhanced cleaning and disinfecting in the classrooms and setting classrooms up to allow for increased physical distance between students.Each school must complete and post a document detailing the actions the school is taking to comply with the industry guidance issued by the state.The order from the San Diego County Health and Human Services Agency says: "All public, charter and private schools may hold classes or school business operations on the school campus, provided the school complies with the measures contained in the State COVID-19 Industry Guidance: Schools and School-Based Programs issued by the CDPH (including the face covering requirements contained therein), also incorporating where feasible the guidelines provided in Stronger Together: A Guidebook for the Safe Reopening of California’s Public Schools issued by the California Department of Education. Each school shall complete and post a document detailing the actions the school is taking to comply with the CDPH Industry Guidance measures after considering the CDE Guidelines noted above. Colleges and Universities shall not hold classes or other school activities where students gather on the school campus, except for research-related activities in colleges and universities and where necessary to train students who will serve as essential workers." 1884

  

SAN DIEGO (KGTV) - There's a stretch of Linda Rosa Avenue in Bird Rock that winds up a hillside and leads to homes with sweeping views of San Diego's coastline.The homes that enjoy that view, however, vary quite a bit. Some are older, smaller, and were built in the 1960s.Others are modern, and tower above the rest. Some refer to those larger homes as "McMansions," and wonder how they keep getting approved without any pushback from neighbors to protect community character."They basically skirt the reviews," said Dave Ish, who lives in an older home on Linda Rosa.READ?JON HORN'S ORIGINAL LOOK AT 'MCMANSIONS'Developers are able to skip the lengthy and public Coastal Development Permit process as long as they retain at least 50 percent of a structure's exterior walls. It's spelled out in city code. That's why McMansions are popping up in San Diego's coastal neighborhoods. But it turns out the city's 50-percent exemption creates even more flexibility for developers because they can get permit after permit with no waiting period in between.RELATED: Coronado neighbors worried about historic mansion turned transitional homeDeveloper Ben Ryan, of Tourmaline Properties, did that for an ocean-view home on Linda Rosa.In October, the city issued him a permit to add a closet and convert a garage to a carport, under the 50-percent exemption.  "Obviously it was just a temporary deal," Ish said. "Nothing was finished, it was this bowed out paneling, these windows weren't finished. It may have been a quick job, but it changed the layout of the home enough to allow Ryan to alter the design for a larger project.Ryan got a new permit later in February - again under the 50-percent exemption - calling for a second story, master suite, decks, kitchen, living room, dining room, and more. Today, the home is just half a wood frame - the closet and carport nowhere in site. SAN DIEGO (KGTV) -- Threats from President Donald Trump to move forward with ICE raids aren't stopping a Barrio Logan organization from patrolling the streets and alerting the community when agents are in their neighborhoods. Union Del Barrio is a 38-year-old organization. In the last year, they started the community patrols to warn neighbors of their rights, if ICE shows up at their door. Benjamin Prado is a member of Union Del Barrio. He says volunteers patrol in Logan Heights, Barrio Logan, Shelltown, City Heights and Linda Vista. Prado says they never interfere with the ICE agents doing their job, only document what they see. The organization is also training volunteers in other cities, including Los Angeles. Prado says they feel ICE shouldn't exist at all and that these patrols are to challenge the administration, trying to stop them from terrorizing and separating their families with deportations. On Saturday, Trump said the administration would move forward with ICE raids "fairly soon". Late Sunday afternoon, the president also tweeted in response to a New York Times article saying in part "people should not be entering the country illegally" while also praising the work of Border Patrol and others in law enforcement. Trump also insisted the wall is being built. So far, no word from the administration as to when the deportations will start. 1378
