The Ark may have been constructed to withstand 40 days and 40 nights of flooding, but Northern Kentucky’s Ark Encounter property did not fare as well as Noah’s original construction when rains hit the area.Court documents filed in District Court show that the owners of the Ark Encounter in Northern Kentucky have filed a suit against their insurance company after flood and storm damage.Crosswater Canyon Inc. alongside the Ark Encounter, have filed suit against multiple defendants who comprise the business’ insurance underwriters after their property was damaged by heavy rains.According to the suit, heavy rains caused a landslide and some structural support damage near the Ark exhibit.“Subsequent to heavy rains, a significant landslide occurred along portions of the slope, which eliminated the structural support for the roadway, caused significant damage to the road surface itself and the incorporated improvements, and rendered portions of the road unsafe and unfit for use,” reads the suit.Engineers fixed the roadway at a cost of about million. But when the Ark Encounter asked for their insurance to cover the repairs, they were disappointed.Initially, the suit alleges, the defendants cited faulty craftsmanship as the reason for the property damage and stated they were not liable. After an appeal, they conceded that only a small amount was covered by the policy.“By refusing to pay all but a very small proportion of Plaintiffs’ covered claim, the Defendants have failed to meet their Policy obligations and failed to handle Plaintiffs’ claim properly and in good faith, causing Plaintiffs to incur significant additional loss and expense,” reads the suit. The Ark Encounter is seeking damages. The vessel itself appears not to have been damaged. 1779

The National Foundation for Infectious Diseases released concerning information that only 52 percent of adults in the U.S. plan to get vaccinated during the upcoming flu season. The organization said on Thursday that it urges everyone 6 months of age or older to get vaccinated for the flu as soon as possible. "Many people underestimate the severity of flu, yet we know flu causes hundreds of thousands of hospitalizations and tens of thousands of deaths each year in the United States," said Secretary of Health and Human Services Alex M. Azar, II. "When it comes to protecting people from flu, our best preventive tool is an annual flu vaccine. It can safely prevent flu illnesses, hospitalizations, and deaths," added Secretary Azar. Getting vaccinated is especially important for people with chronic health conditions that puts them at higher risk for flu-related complications."Last flu season, approximately 93 percent of adults hospitalized for flu-related complications had at least one underlying medical condition, such as heart or lung disease. Vaccination against flu and pneumococcal disease must be part of disease management for people with chronic health conditions," said Dr. Borden, a preventive cardiology specialist. Those looking for a flu vaccine can click 1291
Tennessee Governor Bill Haslam has granted executive clemency to Cyntoia Brown by commuting her life sentence. The governor's office announced the decision Monday morning. She will be released to parole supervision on August 7, 2019, after serving 15 years in prison.“This decision comes after careful consideration of what is a tragic and complex case,” Haslam said. “Cyntoia Brown committed, by her own admission, a horrific crime at the age of 16. Yet, imposing a life sentence on a juvenile that would require her to serve at least 51 years before even being eligible for parole consideration is too harsh, especially in light of the extraordinary steps Ms. Brown has taken to rebuild her life. Transformation should be accompanied by hope. So, I am commuting Ms. Brown’s sentence, subject to certain conditions.”As part of her parole, she cannot violate any state or federal laws and will be subject to a release plan approved by the Tennessee Department of Correction and special supervision conditions, including employment, education, counseling and community engagement requirements.Brown's parole supervision will continue until August 7, 2029, at which point her sentence will expire. In 2006, she was convicted of first-degree murder, felony murder and aggravated robbery in the killing of Antioch realtor Johnny Allen. She was sentenced to life in prison. At the time of the crime, she was 16-years-old. Advocates have said that Brown, now 30, was a victim of sex trafficking and shot the 43-year-old in self-defense. The man she killed 1590
