LORAIN, Ohio - A family has filed a lawsuit against the Lorain County School District in Lorain, Ohio after their daughter was wrongly accused of bringing drug-laced candy to lunch in September and suspended.Shannon Ciotti and her daughter have filed a suit naming the district, the Lorain City Board of Education, every board member, the district CEO and the Lorain Police Department.Ciotti said her daughter was suspended immediately from Southview Middle School after being accused of bringing tainted candy, before any test was ever conducted on the candy. The director of out of school suspension cited Ciotti’s daughter with a level three violation – possession of marijuana edibles.The lawsuit states a 10-day suspension turned into 21 because the police department took so long to test the candy. The box of Milk Duds was not properly tagged as evidence and sat on a shelf in the police department, “untested and abandoned,” the court filing states. It was only after the crime lab found out from Ciotti that the evidence was improperly tagged that they tested the candy.The family also contacted the Hershey Company, who tested the batch of Milk Duds for illegal substances, the suit states.Hershey came to the same conclusion that Lorain police eventually did: the candy contained no illegal substances.According to the lawsuit, the teen has been harassed and ridiculed since returning to Southview Middle School. Fellow students have called her names like “pothead,” and a teacher allegedly mocked the girl, saying, “I hope you’re not planning on exchanging candy. LOS ANGELES (AP) — Authorities say a Los Angeles County sheriff's deputy who said he was shot in a station parking lot was lying.Assistant Sheriff Robin Limon said at a news conference late Saturday that Wednesday's "reported sniper assault was fabricated" by Angel Reinosa, a 21-year-old deputy.A department statement on Thursday had said a round hit the top of Reinosa's shoulder, damaging his uniform shirt but failing to penetrate his flesh.But Sheriff's Capt. Kent Wegener says no bullets were recovered from the scene and detectives saw "no visible injuries." He says Reinosa eventually admitted making up the story and using a knife to cut the two holes in his shirt.Reinosa has been relieved of his duties and will face a criminal investigation. LOS ANGELES (AP) — Lawyers for the family of a black man killed by police in a busy Southern California parking lot said Monday that an autopsy found he was shot 10 times and died from choking on his own blood.The autopsy concluded that 26-year-old Diante Yarber died of asphyxiation and that had he been given medical treatment, he would have had a chance at surviving his wounds, attorney S. Lee Merritt said at a news conference.The autopsy was conducted by a private medical examiner at Merritt's request. An autopsy by San Bernardino County authorities has not been released and it's unclear whether it's been finished.Merritt, who is planning on filing a civil rights lawsuit in the case this week, said the private autopsy found that Yarber had wounds to his chest, back and arms and that he wasn't given medical treatment for "a great deal of time.""The injuries are consistent with defensive wounds ... as he was shielding himself and trying to escape the onslaught of bullets," Merritt said.Merritt did not respond to a message seeking a copy of the autopsy report.
