SAN DIEGO (KGTV)- A spokesperson for the County of San Diego said over two days, they have received approximately 580 complaints of businesses and entities not following the proper restrictions under the purple tier.The county has already sent out dozens of cease and desists orders since Monday. That includes at least two churches, Foothills Christian Church and Awaken Church, but the warnings are not stopping some churches from shutting down indoor operations.Since the pandemic began, Awaken Church has received two cease and desist letters. Once in July for its Balboa Campus, and the latest on Monday for the Carlsbad location, but it appears the church has no intentions of shutting down indoor services.A statement posted on the church’s website said in part, “In keeping our First Amendment right, we will continue to minister to those who are the most affected by all the COVID-19 lockdowns. Specifically tending to those who are struggling with depression, anxiety, hopelessness, suicidal thoughts, and addiction.”Bishop Arthur Hodges is a Senior Pastor at South Bay Pentecostal Church. As bishop, he oversees more than 100 churches in Southern California, including 25 in San Diego County.“About 50 percent are electing to remain indoors for worship,” he said. “About 30 percent are outdoors, and 20 percent are online only.”Hodges has taken the fight to stay open to the U.S. Supreme Court once, and it about to again, hoping a ruling could benefit all houses of worship nationwide.“We are filing either today or tomorrow back in the Supreme Court to reopen churches and for our constitutional guarantees to be recognized,” he said. “We are hopeful for an expeditious ruling, and we think it’ll be favorable to churches, and that’ll affect churches not only in California but across the nation.”A county spokesperson said if a cease and desist order is ignored, the next step would be a closure order. After that, law enforcement is asked to get involved by giving citations with a thousand dollar fine for each violation; then the case goes to either the San Diego District Attorney or City Attorney.In a video posted to the Awaken Church website in August, two church pastors explained why they believe religious services are essential, explaining the risks to their congregants’ mental health.It’s something we’ve heard from other religious leaders, like the lead pastor of Skyline Church, Dr. Jeremy McGarity.“We can’t stand by and not help people,” said McGarity. “We realized we can protect the most vulnerable and have services at the same time. We saw the huge rate of suicide ideation that went through the roof.”Hodges said he understands the pandemic is serious and can be deadly.“One of my daughters is a nurse at a local San Diego hospital and works with COVID patients, and I have two very near and dear personal friends who have died of COVID, so we know this is real, but we need to keep things in balance and perspective,” said Hodges.He urges every house of worship to take the necessary precautions but believes churches can stay open and stay safe at the same time.“We have zero cases, zero cases in our local church as a result of being on the church campus,” he said. “Churches are absolutely essential.”ABC 10News reached out to both Awaken Church and Foothills Christian Church for comment but have not yet heard back. 3366

SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. President Donald Trump, who intervened to move Gallagher to better confinement, has considered dismissing the charges.Gallagher pleaded not guilty to murder in the death of an injured teenage militant in Iraq in 2017 and to attempted murder for picking off two civilians from a sniper's perch.It is extremely unusual for a military judge to remove the prosecution or dismiss a case only days before the start of a trial. The military justice system has gotten few war crime convictions and been criticized for being ineffective.Gallagher's lawyers condemned the prosecution for embedding tracking code in emails sent to them and a journalist to find the source of news leaks.At hearings last week, Rugh indicated he was misled about the effort. He said investigators told him privately they planned to embed code in what he believed to be a court document to help them find the source of leaks but the judge said he didn't have the power to authorize such a tactic and wasn't told they planned to target emails sent to the defense lawyers or a journalist. 2161

SAN DIEGO - San Diego Democrats are now celebrating their party officially taking back the House of Representatives.Now, they want action on a bill they say will take corruption out of U.S. politics."Having the Democrats take back the house is the best birthday present anybody could have," said Ruth Kirk, who lives in Hillcrest. On Thursday, Kirk celebrated with about three dozen of her like minded friends - in front of Democratic Congresswoman Susan Davis's office in North Park. The demonstrators, part of a group called Indivisible, worked to flip house seats from red to blue in the 2018 election. With that goal accomplished, Indivisible is turning its attention to reforming how politics operate in this country. Indivisible held rallies outside Davis's office as well as Republican Congressman Duncan Hunter's Temecula headquarters. They are pushing for H.R. 1 - a bill that would reform campaign finance laws, ethics, and voting rights."We want to get the money and the gerrymandering out of politics and the ethics back into government," Kirk said. Davis says the bill is still being drafted and hopes to have it passed by Jan. 21. That's the eighth anniversary of the Supreme Court's Citizens United decision, which freed corporations and unions to spend all they want on political ads. It appears, however, to have a minuscule chance in the Republican-controlled senate. Majority leader Mitch McConnell last month called it a blatantly unconstitutional effort to micromanage our elections. Political analyst Ruben Barrales, who worked in the George W. Bush administration, says there are some aspects of the bill that could pass - such as more daylight for campaign contributions. SAN DIEGO — The race to replace former Congressman Duncan Hunter in California's 50th Congressional District is in a virtual deadheat, according to a new scientific poll.The ABC-10News Union-Tribune SurveyUSA poll shows Republican Darrell Issa, a former congressman, leading Democrat Ammar Campa-Najjar 46 percent to 45 percent, within the 5.4 percent margin of error. “This poll I think is a shocker for many political observers, including myself,” said Thad Kousser, political scientist at UC San Diego. “You have an establishment, well-known candidate in Darrell Issa with proven fundraising ability in a district that until a couple years ago was the reddest district in California, so many people thought that by this time the real start of the campaign season Darrell Issa would have a huge lead over Ammar Campa-Najjar.”Hunter resigned in January after pleading guilty to a single felony conspiracy count. Federal prosecutors accused him and his wife Margaret of misusing 0,000 in campaign funds. Hunter, under indictment during the 2018 election, still defeated Campa-Najjar by 3 percentage points, or 9,000 votes in the 50th District, which leans Republican.Campa-Najjar is running in 2020 to take the open seat. He secured the most votes in the Super Tuesday primary against a split Republican field, with Issa coming in second. Still, the Republican votes combined outnumbered Campa-Najjar in the March primary. By registration, Republicans outnumber Democrats in the district by about 33 percent.Issa, a longtime veteran of the House of Representatives, last represented the coastal 49th District. He did not seek re-election in 2018 amid changing voter registration. He is now running to go back to Washington, D.C., in the 50th District, which extends from parts of El Cajon into southern Riverside County. Gavin Newsom ordered that flags at the state Capitol be flown at half-staff Tuesday in honor of the eight Marines and one Navy sailor who died when an amphibious assault vehicle sank during a training mission last week near San Clemente Island."Jennifer and I were heartbroken to learn of the loss of nine service members in an accident off San Clemente Island," Newsom said in a statement. "It is a painful reminder of the sacrifice of members of our armed forces, who put their lives on the line for us. We stand united in mourning with their families and fellow Marines and sailors."The amphibious troop-transport vehicle was en route to a waiting ship about 80 miles off the coast of Encinitas about 5:45 p.m. last Thursday when it started taking on water for unknown reasons, according to Lt. Gen. Joseph Osterman, commanding general of 1st MEF.Seven members of the Camp Pendleton-based crew survived the accident. Medics took two of them to Scripps Memorial Hospital La Jolla, where both were admitted in critical status. One was upgraded to stable condition as of Sunday night, Marine officials said.The other five rescued Marines received clean bills of health and returned to their units.Lance Cpl. Guillermo S.
