ESCONDIDO, Calif. (KGTV) -- It was a murder-mystery that gripped San Diego County. The family of 12-year-old Stephanie Crowe, waking up on the morning of January 21, 1998, to a horrifying discovery.Stephanie - lying dead on her Escondido bedroom floor in a pool of blood, after being stabbed multiple times.Her family told detectives they were asleep inside the house when the murder happened and heard nothing. Detectives say they found no signs that someone forced their way inside.The investigation and court battles that followed would change the way law enforcement collects evidence and performs interrogations."It was a case where there were clearly major problems with the investigation," said Brad Patton, Richard Tuite's criminal defense attorney. "The problems with the investigation related to the crime scene."Patton spoke with 10News on Thursday, nearly 20 years after Stephanie's death. He told 10News the problems surround the case were how police collected evidence and how detectives interrogated suspects. Problems that caused the case to turn cold - letting Stephanie's true killer continue to walk the streets in San Diego County.  "I don't think the Crowe family will ever get closure," Patton said. Who killed Stephanie Crowe?In the months after her death, Stephanie's 14-year-old brother, Michael and two of his friends would be charged with the murder. A knife was found under the bed of John Treadway. Both he and Stephanie's brother Michael later confessed to detectives during videotaped interrogations.The boys were subjected to intense, prolonged questioning and deprived of food and sleep. The confessions were later judged to be coerced and the charges were dropped. Then, a new suspect. Richard Tuite. He was a transient and diagnosed schizophrenic. Brad Patton was his defense attorney. Tuite was seen in the Escondido neighborhood that night - banging on doors, looking for an old girlfriend. Most damning of all, he was seen wearing a sweatshirt with Stephanie's blood on it. "Mr. Tuite could not, did not, go into that house. There was no forensic evidence of him being in that house," Patton said. There were no hairs, no fibers, no DNA. Tuite claimed he found the sweatshirt while dumpster-diving. Tuite was convicted and would spend more than a decade behind bars. Then, he got an appeal.  An appeal where he was found not guilty of voluntary manslaughter. Stephanie's parents never suspected her brother. Years ago, her mom had this to say to 10News, after Tuite was cleared:"I just hope that North County is aware that he's going to be out walking the streets and that people lock their doors."The murder of Stephanie Crowe is still unsolved.Patton says there's only one way he sees the mystery solved. "You're probably never going to find the actual killer unless that person comes forward at some time," he said. The Crowe family has since moved to the Pacific Northwest. Patton is now living in the South Bay. 3027

ENCINITAS, Calif. (KGTV) - People who live on Bonita Drive in Encinitas want the city to stop a 10-home development on their street. They say it will make the area more dangerous if a wildfire breaks out."It's a huge concern," says Sione Schad-Siebert. "When the fire starts, and Santa Ana winds blow, they move fast, and you need to get out fast."Plans for the project call for 10 single-family homes to be built on a mostly empty 2.4-acre lot. People who live around it say adding the homes will allow fires to spread faster and cause more congestion on the street if people need to evacuate.Schad-Siebert showed 10News parts of the street where the road narrows to just over the width of a couple of cars. She says fire engines can hardly get through as it is. She also worries that a nearby open-space nature trail could catch fire and decimate the neighborhood."If there's ever a fire in the canyon or if a house here catches on fire, the fire department will not get here in time to stop the fire from spreading through the neighborhood because of poor access," she says.The City Planning Commission approved the project in November, but the residents have filed an appeal.In the appeal, they list fire danger as one of six problems the new homes will bring to the area. Among the other claims are traffic issues, environmental concerns, and questions about ways they say the project skirted city rules during the approval process."I feel like the city's kind of losing its soul," says Schad-Siebert. "I feel it's selling out to developers from out of town that just want to make a lot of money."Housing has been a problem in Encinitas, where city leaders have traditionally shunned large developments. Until 2019, it had been more than two decades since the city successfully submitted a housing and growth plan to the state. The mayor says that has to change.As for the appeal, the Planning Department staff issued a 23-page memo refuting the claims point-by-point. It says the City Council should deny the appeal and move forward with the project.Schad-Siebert says if that happens, she and her neighbors plan to file a lawsuit to stop the construction.The Encinitas City Council will vote on the appeal at Wednesday night's meeting, which begins at 6 pm. ESCONDIDO, Calif. (KGTV) -- An Escondido-based avocado grower is voluntarily recalling avocados sold in bulk due to possible Listeria monocytogenes contamination. Henry Avocado Corporation issued the recall Saturday due to positive test results on environmental samples taken during routine inspection of its packaging facility. So far, there are no reports of illness. The recalled products were packaged at Henry Avocado’s packaging facility and distributed to Arizona, California, Florida, New Hampshire, North Carolina and Wisconsin. Customers can identify the recalled fruit by the “Bravocado” stickers. Henry Avocado organic products do not carry the “Bravocado” label on the sticker. Instead those products are labeled “organic” and include “California” on the sticker.All shipments from the facility are subject to the recall. According to the company, avocados imported from Mexico and distributed by Henry Avocado are not part of the recall. The company said in a news release that it’s contacting all affected customers to make sure the products are removed from shelves. Anyone who purchased the recalled product are urged to discard or return the items for a full refund. Listeria monocytogenes can cause high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea. 1303

  

ESCONDIDO, Calif. (KGTV) — One person is dead following a multi-car crash on Interstate 15 in North San Diego County.A 25-year-old man from Chula Vista was behind the wheel of a Mustang traveling southbound on I-15 collided with at least three vehicles just before 6:30 a.m. just north of the State Route 76 connector, according to California Highway Patrol.The driver of the Mustang was seriously injured and taken to Palomar Medical Center, where he later died. The man was not immediately identified.RELATED: Motorcyclist dies in solo Oceanside crash during stormInvestigators said the driver of the Mustang was not wearing a seatbelt. CHP doesn't not believe alcohol or drugs were a factor in the crash.Several lanes of southbound I-15 remained closed early Saturday for nearly three hours as crews cleared the scene.Saturday afternoon, the crash remained under investigation. 913
