SAN DIEGO (KGTV) - The man who received 2,000 of his dead father’s Social Security benefits was sentenced Monday to federal prison time.Abel Perez, 55, pleaded guilty to accepting the benefits after his father died in 1997.Prosecutors said Perez would forge his father’s signature on a check payable to himself and divert the funds for his personal use.Perez admitted he knew he was not entitled to the funds which were put into the account.“The Social Security Administration’s Office of the Inspector General is pleased to see that this crime, which affects every individual relying on the Social Security Trust Fund for their retirement, was taken seriously and punished appropriately in this case,” said Robb Stickley, the Special Agent in Charge of the San Francisco Field Division, which is responsible for Southern California.  “We hope that this sentence sends a message that it is the responsibility of every individual in our society to protect their own retirement savings, and ensure that a loved one’s death does not go unreported.”A judge sentenced Perez to one year and one day in federal prison. SAN DIEGO (KGTV) -- The California Federation of Teachers (CFT) is urging school districts across the state to roll back in-person classes and return to distance learning.CFT President Jeff Freitas said with most of the state back in the purple tier of restrictions, it only makes sense to go back to virtual learning until there is a slow in the spread of COVID-19.“We need to get these numbers down," said Freitas. “We think the best thing right now is for schools to stop their plans of reopening and, or if they are reopened, to close their schools and go back to remote.”Three Vista Unified School District schools -- Rancho Buena Vista High, Vista Magnet Middle, and Madison Middle -- returned to virtual learning Tuesday after positive COVID-19 cases were reported. It’s a back-and-forth the district has been dealing with since reopening for in-person instruction last month.“There should be more of a statewide approach and definitely a national approach,” said Freitas. “We have been asking that they take the lead on this.”San Diego Unified School District thinks it has come up with an answer. During its State of the District address Tuesday evening, Superintendent Cindy Marten said the district created a federal relief plan to get all schools nationwide back on track for the next two years.The plan asks for federal investment in education that would be centered around equity and undoing learning loss.“What would the San Diego strategy look like at the national level? We have outlined that plan, shared it with the Biden administration,” said Marten.The plan includes a COVID-19 testing, tracking, and tracing strategy for students and staff, and 0 billion in direct relief to schools. SAN DIEGO (KGTV) -- The man accused in the death of three migrants found in the trunk of a car in August was arraigned on related charges in San Diego court Tuesday. According to court documents, Neil Edwin Valera, a U.S. citizen who lives in Mexico, was arraigned in federal court in connection with the deaths of three Chinese migrants, including a mother and her 15-year-old son. The third person in the trunk was a female. None of the victims have been identified. Authorities say Valera is a truck driver from El Paso, Texas. He was arrested at a downtown bus station Saturday. SAN DIEGO (KGTV) - The Florida school shooting is conjuring painful memories for an uncle who calls his nephew the "14th Columbine victim.""You get choked up and then you're mad," said Tim Barnes.It was a flood of different emotions, as Barnes watched coverage of the tragedy in Florida.April 19th, 1999, as news broke about the massacre at Columbine High through frantic 911 calls, the San Diegan had his nephew Greg on his mind: A Columbine High student and one of the top basketball players in Colorado.Greg did survive the shootings, but one of his best friends did not. Greg was among several students who tried to keep the girl's basketball coach alive."From my understanding, he was holding Coach Sanders when he bled to death," said Barnes.Two months later, Barnes sat down with his nephew.    "Everything's cool. I'm good. I'm fine. Don't really want to talk about it. And that scared me.
