CARLSBAD (KGTV) -- A slope in Carlsbad is moving, affecting a senior community on top of it. The question of who is responsible for paying to fix it has the City of Carlsbad battling with those who live in Camino Hills.“It’s been a tremendously stressful experience for everyone,” said Mike Perry, who has lived in Camino Hills since 2001. Joe Matthews has called the Camino Hills community his home for about 19 years. “We have lunch out here, sometimes dinner,” Matthews said, as he showed Team 10 the front patio area where he relaxes with his wife. “The grandkids come visit.”“It’s a really wonderful community,” Mathews added. What he did not know was something was going on beneath the surface. “It came as a real surprise,” Matthews said. According to court documents filed by the Camino Hills Homeowners Association in 2018, the City of Carlsbad noticed damage to the pavement and sidewalk right by Camino Hills Drive back in 2007. In January 2009, a geotechnical firm placed devices in the slope to track the movement. There was more slope movement detected during the El Ni?o rainstorms from 2016 and 2017.To fix the issue, it could cost anywhere from 0,000 to about million, according to Elizabeth French. French represents the Camino Hills Homeowners Association. She said the city did not fix the problem properly in the first place. “The city actually knew that there was an ancient landslide at this location and rather than make the developer make a more expensive repair, they allowed the developer to put in a subsurface buttress made of soil, but in recognition that that wasn’t the best repair,” French said. She said when this community was being built, the City of Carlsbad entered an agreement with the developer of Camino Hills. In the indemnity agreement, French said it required the developer to fix any problems for up to 10 years after the community was built. Camino Hills was built in the mid-1980s and the developer is now out of business. French said the city is now asking the residents of Camino Hills to foot the bill.“There’s nothing in this association’s government documents alerting any of the prospective purchasers that there’s this enormous liability out there, that they could be tasked with addressing down the road and that kind of notice is required in the law,” French said.Joanne Stout’s modular home is right by Camino Hills Drive. “This is it. This is where I’m going to be until they carry me out of here,” Stout said. CHICAGO, Ill. -- As coronavirus cases continue to spike, some states are reinstating restrictions on indoor dining. Restaurants already reeling with huge financial strains are trying to find innovative solutions to keep their doors open. Some are thinking outside the box and into a bubble.“What you're seeing in Washington D.C. and Chicago and elsewhere are local mayors trying to incentivize and help restaurants winterize their outdoor spaces and really doing whatever they can to encourage outdoor dining,” said Mike Whatley, vice president of state and local affairs for the National Restaurant Association.But with indoor dining shut down in many places across the country, geodesic domes or igloos, tents and mini greenhouses are popping up to help keep diners warm and safe.The National Restaurant Association says a recent survey indicates 49% of full-service restaurant operators say they are taking actions like installing tents or patio heaters to extend their outdoor dining season.Restaurant owner Sophie Huterstein and her staff built 14 4x6 greenhouses for use outside her restaurant, The Darling.“We’ve been utilizing this system of being able to dine together, apart from the moment we reopened after the initial shutdown, as a genuine intent to protect the guests and our staff,” she said.The idea was inspired by an installation in Amsterdam. Each one can accommodate two to four people and is helping sustain her business while indoor dining is restricted.“You are sitting closely in there, but it is our hope that no one would dine with people that they are not very familiar with,” said Huterstein.Safety experts say this type of seating can keep people safe if there’s frequent cleaning and ventilation.California resident Sarah Moffat dined inside a greenhouse for the first time.“I don't know if we're gonna have a sense of normalcy ever again,” said Moffat. “But to have moments that you can share with friends and your close loved ones in a safe environment is kind of amazing.”The City of Chicago challenged designers from across the country to propose winter dining solutions.Atlanta-based national design firm ASD/Sky created a modular cabin inspired by ice fishing huts that would fit inside the footprint of a parking space. (KGTV) - After a woman died in a jet ski crash in the Agua Hedionda Lagoon in Carlsbad on Sunday, Stephen and Aimee Cochrane were confronted with a painful memory.“I just cannot believe that this would have happened. It’s just wrong,” said Aimee.Her indignation was amplified by the fact that she and her husband were involved in a crash in the same lagoon in July of 2016.They had decided to rent a jet ski on their anniversary, something they had never done before.“We wanted to do something different,” recalled Stephen.But when they got to California Watersports at the Agua Hedionda Lagoon, they had second thoughts.“It was wild. It was mayhem out there,” said Stephen, describing the busy activity on the water.Despite their hesitations, they decided to go for it. But before they had even completed one lap around the buoys, they said they were t-boned by another rider.“We both flew off the jet ski,” remembers Aimee.Stephen said he momentarily blacked out. Aimee remembers swimming over to him and seeing him face down in the water.He was eventually pulled onto a boat and taken into an ambulance. He said he ended up with three broken ribs and a fractured sternum.Aimee suffered some cuts and bruises on her legs, but no broken bones.Stephen said he had to take three weeks off of work and pay ,000 in out of pocket medical expenses. He says he still has pain in his chest from the injury.After the crash, they said they had no contact with the owners of the rental company. They said they were unaware if the company had made any changes to prevent future crashes.10News spoke to an employee at California Waterspouts who said they would not be providing any statements. Canadian health officials’ approval of the NHL’s return-to-play proposal has led the league to consider designating one or more cities north of the border to serve as hubs for its 24-team playoff format. The approval comes as the NHL has entered the advanced stages of selecting its hub cities, which include three located in Canada.
