(AP) — Authorities say somebody stole a tripod from a California Department of Transportation crew and then dropped it from an overpass onto a Sacramento freeway, impaling the lung of a passenger in a van.The driver of the van, Tim Page, tells KCRA-TV that he was on Interstate 5 Thursday morning when the yellow-and-red tripod smashed through the glass. He says it went through his passenger's lung and popped out.The man survived but with broken ribs and a partially punctured lung.Authorities say a 32-year-old man, who the Sacramento Bee identified as homeless, threw the tripod was arrested after a brief struggle and chase. Jerry Brown ordered new DNA tests that a condemned inmate says could clear him in a 35-year-old quadruple murder case, which has drawn national attention.On Monday, Brown ordered new testing on four pieces of evidence that Kevin Cooper and his attorneys say will show he was framed for the 1983 Chino Hills hatchet and knife killings of four people. The items that will be tested are a tan T-shirt and orange towel found near the scene and the hatchet handle and sheath.Brown also appointed a retired Los Angeles County Superior Court judge to serve as a special master overseeing the case.Cooper was convicted in 1985 of killing Doug and Peggy Ryen, their 10-year-old daughter Jessica and 11-year-old neighbor Christopher Hughes. Prosecutors say Cooper's claims of innocence have been disproven multiple times, including by prior DNA testing, but Cooper and his attorney argue evidence against him was planted."I take no position as to Mr. Cooper's guilt or innocence at this time, but colorable factual questions have been raised about whether advances in DNA technology warrant limited retesting of certain physical evidence in this case," Brown wrote in his executive order.New York Times' columnist Nicholas Kristof, U.S. Sen. Kamala Harris, state Treasurer John Chiang and reality television star Kim Kardashian are among people who called for Brown to order new DNA tests. Cooper had his execution stayed in 2004, which drew national attention at the time.The purpose of the new testing, he wrote, is to determine whether another suspect's DNA or the DNA of any other identifiable suspect is on the items. If the tests reveal no new DNA or DNA that cannot be traced to a person, "this matter should be closed," Brown wrote.Two previous tests showed Cooper, 60, was the killer, argued San Bernardino County District Attorney Mike Ramos. He previously said the tests proved Cooper had been in the home of the Ryens, smoked cigarettes in their stolen station wagon, and that Cooper's blood and the blood of at least one victim was on a T-shirt found by the side of a road leading away from the murders.Cooper's attorney, Norman Hile, said his client's blood was planted on the T-shirt, and that more sensitive DNA testing would show who wore it. He contends that investigators also planted other evidence to frame his client, a young black man who escaped from a nearby prison east of Los Angeles two days before the murders.Other evidence points to the killers being white or Hispanic, Cooper's supporters say.A San Diego judge in 2011 blocked Cooper's request for a third round of DNA testing.Cooper's scheduled execution in 2004 was stayed when a federal appellate court in San Francisco called for further review of the scientific evidence, but his appeals have been rejected by both the California and U.S. supreme courts. Former Gov. Arnold Schwarzenegger twice denied Cooper's clemency petitions.California hasn't executed anyone since 2006.Brown issued his Christmas Eve order alongside 143 pardons and 131 commutations. ROCKFORD, Ill. (AP) — Police say a gunman opened fire inside an Illinois bowling alley, killing three people and injuring three others during what authorities believe was a random attack. Rockford Police Chief Dan O'Shea says a 37-year-old white male suspect is in custody after the shooting Saturday night at Don Carter Lanes. Police were not seeking any other suspects. O'Shea did not immediately release additional information about the person of interest or the victims. A media briefing is expected to be held on Sunday morning.According to WREX, police received a call around 6:55 p.m. Saturday stating someone was shooting inside the bowling alley.WREX reported that police could not confirm the conditions of the three people injured in the shooting, but said at least two teenagers were shot. According to WREX, police could not confirm if the victims were patrons of the bowling alley or worked there.O'Shea says he did not think any officers fired their weapons. (AP) — California has overhauled its sex education guidance for public school teachers, encouraging them to talk about gender identity with kindergarteners and giving advice to help LGBT teenagers navigate relationships and practice safe sex.The guidance won't recommend students read books that describe anal sex, bondage and other sex acts after getting hundreds of complaints from concerned parents and conservative groups.A few hundred people gathered on the state Capitol grounds in Sacramento on Wednesday morning, carrying signs that read "stop sexualizing my kids" and "respect parental rights." The crowd soon filled the lobby of the California Department of Education, with parents busily handing out snacks to occupy their children for what could be a long day. Those who could not get inside circled the building holding signs.Patricia Reyes traveled more than 400 miles from her home in Anaheim Hills to bring her six children, who attend or have attended public schools, to Wednesday's board meeting. They included her 4-year-old daughter, Angelie, who carried a sign that read: "Protect my innocence and childhood.""It's just scary what they are going to be teaching. It's pornography," the 45-year-old mother said. "If this continues, I'm not sending them to school."Michele McNutt, 49, focused on the framework's attention to healthy relationships and consent, something she said is never too soon to teach her two daughters in public school, ages 11 and 9."Withholding medically accurate, scientific information from them actually causes more harm and does not actually protect innocence," she said while wearing a purple T-shirt that read "protect trans students." ''If you don't give kids accurate information about their own body ... how are they able to make good choices?"California's education standards tell school districts what students should know about a particular subject at the end of every grade level. The state's curriculum framework gives teachers ideas on how to do that. The state updated its health education standards in 2008. But because of a budget crisis, state officials never gave schools a framework for how to teach them.The more-than-700-page document compiled over three years does not require schools to teach anything, but it is designed to expose teachers to current research about health education and give guidance about how to teach it. It's also influenced by a 2015 state law that made California one of the first states to address LGBT issues as part of sex education.The framework tells teachers that students in kindergarten can identify as transgender and offers tips for how to talk about that, adding "the goal is not to cause confusion about the gender of the child but to develop an awareness that other expressions exist.""I think that people hear the word 'transgender' or 'gender identity' in guidance for kindergarten through grade three and they think the worst," said Stephanie Gregson, director of the Curriculum Frameworks and Instructional Resources Division at the California Department of Education. "It's really about civil rights issues."The framework gives tips for discussing masturbation with middle-schoolers, including telling them it is not physically harmful, and for discussing puberty with transgender teens that creates "an environment that is inclusive and challenges binary concepts about gender."Much of the pushback has focused not on the framework itself, but on the books it recommends students read. One suggested book for high schoolers is "S.E.X.: The All-You-Need-to-Know Sexuality Guide to Get You Through Your Teens and Twenties." It includes descriptions of anal sex, bondage and other sexual activity — depictions California Family Council President Jonathan Keller described as "obscene."On Wednesday, State Board of Education member Feliza I. Ortiz-Licon asked the board to remove that book, and a few others, from the guidance. She said the books had "created panic" and distracted from the framework's goals, including teaching students about consent and sex trafficking."It's important to know the board is not trying to ban books. We're not staying that the books are bad," she said. "But the removal will help avoid the misunderstanding that California is mandating the use of these books." 4326
