SAN DIEGO (KGTV) — The Ninth Circuit Court of Appeals rejected an emergency injunction for a Chula Vista church to hold Christmas Day services indoors.South Bay United Pentecostal Church, which has had legal challenges denied over California's COVID-19 restrictions against places of worship holding indoor services, requested the injunction while its appeals case works its way through the courts.Thursday, the Ninth Circuit denied the request but the case will see a full hearing on the merits on January 15, 2021.RELATED: Los Angeles County change on indoor religious services could impact South Bay lawsuit"We are extremely disappointed that the Ninth Circuit has yanked the joy of Christmas away from South Bay United Pentecostal Church and its congregants," Charles LiMandri, one of the attorneys representing the church, said in a statement.LiMandri said they will request that the U.S. Supreme Court intervene in the case. The country's highest court has already ruled in favor of religious institutions in a New York case, prompting Los Angeles County to amend their public health order to allow for indoor religious services under certain modifications.“By refusing to allow South Bay to participate in the worldwide celebration of the birth of Jesus Christ, the court is continuing to perpetuate the violations of religious liberty that Governor Newsom has been executing for nine months under the guise of COVID-19 prevention,” said LiMandri.California's regional stay-at-home order prohibits indoor operations across several industries, including churches and places of religion.South Bay United Pentecostal Church has argued against the state's restrictions since May. SAN DIEGO (KGTV) - The man who attacked a teenage Syrian refugee on a San Diego trolley pleaded guilty Monday. Adrian Vergara, 26, was arrested Oct. 22 on an unrelated misdemeanor drug charge. While he was in custody, he was recognized in connection to the ongoing hate crime investigation. The 17-year-old boy was beaten on a Metropolitan Transit System car Oct. 15. Representatives for the Partnership for the Advancement of New Americans (PANA), who spoke on the teen's behalf, told 10News the teen was speaking Arabic while on FaceTime with a friend when a man on the trolley asked him, "Where are you from? Are you Mexican?" RELATED: Teen attacked on trolley in possible hate crime The teen reportedly responded, "No, I am Arab." According to the teen, the man then started punching him and cursing while using racial slurs. The victim left the trolley at the 62nd Street station in Encanto. Vergara pleaded guilty to assault and hate crime charges. As part of the plea deal, Vergara will be sentenced December 5 to five years in prison. 1051

SAN DIEGO (KGTV) — The City of San Diego could go to court to invalidate a landmark pension reform measure that voters overwhelmingly supported in 2012.The City Council is expected to meet in closed session the week June 10 to decide whether to ask a judge to throw out Measure B. The measure switched most new hires from pensions to 401(k) style retirement plans. More than 65 percent of San Diego voters supported Measure B in 2012. The problem, however, is that the measure got to the ballot via a citizens initiative, but then-Mayor Jerry Sanders campaigned on its behalf. Labor unions challenged the initiative in court, contending the mayor's involvement meant the city needed to meet and confer with them. The state Supreme Court agreed, and an appellate court ordered the city to make its employees whole, plus pay them 7 percent interest. The courts, however, did not invalidate Measure B, instead directing the city to work out a compromise with the unions. On Thursday, City Councilman Scott Sherman and former Councilman Carl DeMaio held a news conference pushing the city to protect Measure B."Right now we are being asked to go against what our bosses told us, and I don't think we should do that," Sherman said, adding that the city spends 0 million a year now meeting its minimum pension obligations. DeMaio said he would work with a coalition to go to court to protect Measure B. "I'm talking about putting the City of San Diego back on the brink of bankruptcy, let alone telling voters that they don't have a say on where their tax dollars go," he said. Early estimates indicate the amount needed to make employees whole ranges from negligible to million.Michael Zucchet, who heads the Municipal Employees Association, said the only rational way to move forward is to invalidate Measure B."It is time for the City and its citizens to move forward by ending the Prop B debacle with the least amount of additional litigation and expense, and at the same time help address the City’s severe recruitment and retention challenges brought about because San Diego is the only City in California with no defined benefit pension nor Social Security benefits for newly hired employees," Zucchet said in a statement.Mayor Kevin Faulconer said in a statement he would oppose any effort to get rid of Measure B. SAN DIEGO (KGTV) - Tempers flared at a meeting of the Community Review Board On Police Practices Tuesday night. Dozens spoke out against the San Diego Police Department’s chokehold policy. Members of the Racial Justice Coalition wants to ban the practice, saying it’s excessive force and potentially deadly.  San Diego’s new police Chief David Nisleit called the comments at the meeting “passionate.” He said he heard them loud and clear but had questions about the doing away with the chokehold as some law enforcement agencies around the country have done.“Anytime you take a use of force tactic away from an officer, they generally have to go a higher level,” Nisleit said. “So my concern on that, and why I’m hitting pause to take a hard look at this, is I want to make sure that if we continue or discontinue, it's for the very right reasons. I want to look at the LAPD and the Chicago Police Department and their information on what has happened prior to and more importantly, what has happened afterward to see if more higher level of force had to be used.”The chokehold is expected to come to the review board again at their May meeting. 1163
