Sears has won some more time to save itself. But not a lot more time.At a bankruptcy court hearing Thursday, Judge Robert Drain approved Sears' plan to auction off about 500 stores. The auction is central to the company's mission to remain in business. "We're not blind to that fact."Schrock said the upcoming holiday shopping season is a crucial period for Sears, and the company believes it will at least be able to break even in the fourth quarter.The creditors' attorney expressed doubts that the company will be able to stay in business. But he said they could live with waiting until December for a decision on Sears' future.Sears also disclosed in a filing late Wednesday that it has arranged for an additional 0 million loan to fund operations during the bankruptcy process. That loan is a crucial component of the company's ability to stay in business, according to a filing the company made on the first day of the bankruptcy process, but it has taken a month to lock-up the funding.The loan is from Great American Capital Partners, rather than ESL, the hedge fund controlled by Sears Chairman Eddie Lampert. When Sears first filed for bankruptcy, it said that it anticipated the loan would come from ESL, but creditors have objected to a the series of insider deals between Sears and Lampert. 2303

Sayfullo Saipov has been charged with federal terrorism offenses in connection with Tuesday's attack in Manhattan in which eight people were killed, according to a charging document from the US Attorney for the Southern District of New York.Saipov, a 29-year-old Uzbek national who was living in New Jersey, is being charged with providing material support to ISIS and violence and destruction of motor vehicles.[Previous story, published at 5:13 p.m. ET]The suspect in New York's deadliest terror attack since 9/11 had planned the attack for weeks and carried out the killings "in the name of ISIS," John Miller, NYPD deputy commissioner for intelligence and counterterrorism, said on Wednesday.Authorities identified the suspect as Sayfullo Habibullaevic Saipov, a 29-year-old Uzbekistan native who came to the US legally in 2010. Saipov allegedly drove a rented truck onto a well-trafficked bike path just blocks from the World Trade Center on Tuesday afternoon.Eight people were killed and more than a dozen injured as the driver carved a path of destruction through several blocks of Lower Manhattan. Saipov crashed the rented truck into a school bus, left the vehicle brandishing imitation firearms and was shot by police, officials said. He survived and was taken into custody, police said.In carrying out the attack, Saipov relied on the playbook laid out by ISIS in recent years, officials said. SANTEE, Calif. (KGTV) - A rare and beloved family tortoise disappeared from a Santee backyard, possibly grabbed by a thief.Along Jeremy Street, one fenced yard feels especially empty."Heartbroken. My whole family is heartbroken," said a tearful Melanie Clark.Shelly, a 20-year-old leopard tortoise, disappeared about three weeks ago. Clark and her husband returned home from a trip and opened the sliding door but Shelly never came in. Days before returning, Clark says her daughter put down some lettuce on the backyard patio. The couple discovered it half-eaten, which was odd. Usually, Shelly comes back and finishes it.Still, Clark wondered if Shelly wandered off. "We checked all along the fence and saw no gaps," said Clark, who believes it all adds up to a thief."I'm just afraid that somebody saw her and said, 'What a beautiful animal, and I want that beautiful animal,'" said Clark.The foot-long, ten-pound tortoise is unique in its yellow-and-black coloring and origins. "She was one of the last South Africa tortoises to be imported into the United States," said Clark.Clark purchased Shelly at a local pet store before a 2001 ban on the importing of leopard tortoises to the U.S. They were banned because of a certain tick the tortoises may carry.The tortoise, native to Africa, is sensitive to cold temperatures."I'm just worried about not being kept warm. We bring her inside when it's cold. We use special lights and heat to keep her warm," said Clark.She made a plea to the person who took Shelly."Please bring her home to us. She's not just a tortoise. SANTEE, Calif. (KGTV) - A local woman says her heart stopped when she saw what someone nearly sat on at a popular trail in Santee.Angie Haake was just beginning her usual dog walk last Thursday morning near the entrance of Walker Preserve Trail, when she noticed two upset women on the phone talking to deputies.  Haake asked them what was going on and they showed her a razor blade on the bench."I was shocked when it saw it. Obviously whoever put it there wanted someone to sit down and slice the back of their thighs. It's cruel and hateful," said Haake.The discovery was not the first.  Another trail goer tells 10news about three weeks ago, she found a similar blade near another bench.  In November 2016, 10news spoke with a mother at Mast Park in Santee, who found dozens of tacks placed sharp-side up underneath leaves.10news reached out to deputies to find out how many reports of similar cases there have been on the trail, but have yet to hear back. 983
