A limousine company and its owner are under scrutiny after a stretch limousine crashed in upstate New York killing 20 people.For unknown reasons, the 2001 Ford Excursion, operated by Prestige Limousine Chauffer Service, plowed through a stop sign and crashed into a parked SUV in Schoharie, New York, last Saturday. Francisco Gilberto Hernandezvargas was recovered after a boating incident on Stillhouse Hollow Lake. The lake is a U.S. Army Corps of Engineers reservoir on the Lampasas River, southwest of Belton. The 24-year-old, whose home of record is listed as Woodside, New York, entered the army in May 2017 as an automatic rifleman and has been assigned to 1st Battalion, 5th Cavalry Regiment, 2nd Armored Brigade Combat Team, 1st Cavalry Division since December 2017.The Bell County Sheriff's Office was alerted that a male, while riding an inner tube behind a boat, went under water and did not surface on Saturday. This took place in the area of Dana Peak Park on Stillhouse Hollow Lake, according to officials.His body was recovered on Sunday.Hernandezvargas’ awards and decorations include the National Defense Service Medal, Korean Defense Service Medal, Army Good Conduct Medal, Overseas Service Ribbon and the Army Service Ribbon.“The Black Knight family is heartbroken by the loss of Spc. Francisco Hernandezvargas. Our hearts go out to his family and friends during this difficult time,” said Lt. Col. Neil Armstrong, commander of 1st Bn. 5th Cav. Regt. “Spc. Hernandezvargas served his country honorably both stateside while at Fort Hood and abroad in Korea and Romania and this tragic loss is felt by every member within our formation.”The unit is cooperating with local authorities as this incident is currently under investigation.The drowning marks the fourth death of a Fort Hood soldier in the past few months. Specialist Vanessa Guillen, Private Gregory Wedel-Morales, and Private Mejhor Morta passed away in separate incidents before Hernandezvargas. A major crackdown could be coming to stop those annoying robocalls. New research from YouMail--a company that developed robocall blocking software--shows each person on the country receives about 150 robocalls a year.Alex Quilici, CEO of YouMail, says these terribly annoying calls keep increasing for two reasons. "One is there are more and more scam calls. The second thing that's driving the increase is people aren't answering the phone anymore," Quilici says.Because people don’t answer their phones, it makes the robocallers place more calls, he says.It’s a problem both Democrats and Republicans can agree on.  Senators John Thune, R-South Dakota, and Ed Markey, D-Massachusetts, have proposed bipartisan legislation to increase the penalties for robocalls to ,000. They are also proposing to extend the time after a crime in which prosecutors must bring their case from one years to three years.Commercial robocalls are illegal, but the Federal Trade Commission, which is tasked with investigating and charging those who have violated the anti-Robocall federal law, has a hard time prosecuting offenders within the current one-year time limit. “If you look at the current enforcement efforts, there's been a 0 million fine and million fine that's covered people who've made 100 million robocalls or a couple hundred million robocalls. A federal judge has dismissed adult film star Stormy Daniels' defamation lawsuit against President Donald Trump.Daniels sued Trump after he said Daniels' story of a man threatening her not to come forward with her story of her alleged affair with Trump was "a total con job."Daniels argued Trump's tweet "attacks the veracity of her account" of the incident and that Trump's statement was "false and defamatory, and that the tweet was defamation ... because it charged her with committing a serious crime," District Judge S. James Otero wrote in his opinion Monday.Trump had asked Otero to dismiss the lawsuit."The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement," Otero wrote.Daniels says she and Trump had an affair in 2006, shortly after he married first lady Melania Trump and she gave birth to their son, Barron. Trump has denied the affair.In addition, Trump is entitled to attorney's fees, Otero said.Trump's attorney Charles J. Harder said in a statement to CNN, "No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.""The amount of the award for President Trump's attorneys' fees will be determined at a later date," Harder added.Daniels' attorney, Michael Avenatti, responded to the ruling on Twitter and said: "Daniels' other claims against Trump and Cohen proceed unaffected.
