SAN DIEGO (KGTV) - There are disturbing allegations that the foster system in San Diego County failed children it was supposed to protect.Critics question whether the rules of confidentiality designed to protect children are doing more to shield social services from scrutiny."My children are going to have to live a lifetime trying to get over and deal with this trauma,” said Melanie. 10News is not sharing Melanie’s last name to protect her adopted children. She is an adoptive mother and foster parent."I became a foster parent because I did want to make a difference in children's lives that didn't have families,” she said.Melanie said she became a foster parent about a decade ago. She wanted to give children in need a safe, loving home.However, Melanie says a potential adoptive child placed with her in 2015 ripped the joy right out of her home.The foster child “ended up sexually assaulting all three of Melanie's adopted sons,” said Melanie’s attorney Jomo Stewart.Stewart said they filed a lawsuit against the County of San Diego, several county employees, and a national foundation that focuses on foster care alleging they all were negligent in placing the child with Melanie’s family.The lawsuit said the county assured Melanie the potential foster child had no history of sexual misconduct, mental illness or any history of wrongdoing.The suit claims that social services concealed the child's past issues and put her sons in unreasonable harm.According to Melanie’s lawyer, Melanie "asked social services whether or not these children had any type of mental health issues, had any previous history of being sexually abused or any previous history of sexually acting out and all answers to those questions were no.”Court documents claim about a month after taking the child into her home the child began to act out, including incidents such as smearing feces on the wall and downloading and watching pornography. Court documents stated that the child “took one of the boys’ cell phones and again downloaded homosexual child pornography.”Then things escalated.The suit claims there were several incidents of sexual violence against the other children in the home over the next year.Melanie says her son was traumatized and is still in counseling trying to deal with it.After each incident, Melanie said she reached out to county social services employees seeking help."Sometimes there was no response at all,” Melanie said. “Sometimes they said that they were going to place a report, I'd follow up on the report, I wouldn’t get any information.”According to a representative with the County of San Diego’s Child Welfare Services division, as of July 2017, there were more than 3,692 open child welfare cases and more than 2,365 kids placed in foster care, which is less than the year before There are 712 caseworkers but not everyone directly handles a foster child's case.Although there is no mandate for how many cases a social worker can carry the county says caseloads are monitored and assigned on a monthly basis. Case count per caseworker often fluctuates based on changing circumstances of every case.A spokesperson for the county denied all interview requests for this story. However, attorneys for the county did respond to the lawsuit in a court filing asking that it be dismissed.The response noted the records in the county's possession at the time the foster child was placed in the home didn't include any information that would have alerted them that the child may pose a risk of harm.They also claim there are no factual allegations to support that they failed to take appropriate action. After each incident, they did take action by filing a report and commencing an investigation, according to the county's court filing.Team 10 investigator Adam Racusin asked San Diego attorney Shawn McMillan if it’s surprising to see allegations like the ones in Melanie’s complaint against San Diego County and the foster system. “No, no the foster system not just in San Diego County, but statewide is completely and totally broken,” McMillan said. McMillan is one of only a handful of attorneys in California who specializes in child welfare cases. He said one of the most significant problems in the system is that everything is done in secret."I've dealt with San Diego County for a long time,” he said. “These specific attorneys defending this case, I have cases with them right now, and it's typical to see what they're doing here, it's blame assignment, denial -- a refusal to be held accountable.”According to Melanie's lawsuit, the district attorney's office filed felony delinquency charges against the foster child for sexual abuse, after the placement with Melanie.Melanie said had she known the child's history there's no way the placement would have taken place. 4928
SAN DIEGO (KGTV) -- With the drop of a banner, the Rock Church replaced the old sign of the Body Shop Strip Club purchased by the church.The church says they’re unsure what they’ll do with the building, but Thursday, they made it clear it’s no longer a strip club.It was quite the presentation, dozens of people, a stage and a sound system. The church and several investors brought the club and its license for .2 million.Councilmember Lorie Zapf said the move is the beginning of a new future for the Midway with a vision of parks, families and a new welcoming look. “Midway is no longer going to be the red light district of yesteryear.”The problem with the plan, however, is the building sits just feet away from another strip club. “They started harassing me in April, I was called about 15 times by their broker,” said Kathleen Morgan, who owns Les Girls Theater.“It’s easy to stigmatize this type of business. But we don’t even have male bouncers, we don’t even serve alcohol, we’re old school burlesque,” Morgan said.On stage Thursday, was a pledge to take over Morgan’s place. “I’m hoping that they can acquire the property next door. Once the Midway plan is approved, they’ll be able to plan for the future of what’s allowed here by the zoning,” Zapf said.Morgan says investors are trying to driver her out. SAN DIEGO (KGTV) - Wednesday, a San Diego City Council Infrastructure Committee was briefed on the progress of a downtown building that’s presently costing taxpayers millions and may end up costing tens of millions more.The 19-story building at 101 Ash Street was supposed to be about saving taxpayers money and improving communication among city employees. But some council members say it’s becoming a symbol for just the opposite."What people need to remember is this is tax-payer money," says Councilman David Alvarez. SAN DIEGO (KGTV) - As the San Diego Airport plans a Billion expansion to Terminal 1, concerns over how to get people to and from Lindbergh Field are creating problems for the project."We are the first and last impression people have of San Diego," says Dennis Probst, the Airport VP of Development. "We want to make it a good one."The airport served a record 22 million passengers in 2017. They expect that number to grow to 28 million by 2035. Getting all of those people to and from Lindbergh is a big part of the expansion.Plans put forward by the airport call for a new three lane roadway connecting Harbor Drive to Lindbergh. It would start near Laurel Street and take people directly to the new terminal and proposed parking garage."No stop lights, no stop signs, free-flowing," says Probst. "It's gonna take about 45,000 cars a day off Harbor Drive."But other San Diego agencies say the airport needs to think bigger and focus on different modes of transportation, instead of just cars."Connecting the airport to transit is something we've been talking about for a long, long time," says Rafael Castellanos, the Chair of the Port of San Diego. "If San Diego wants to be a world class city, we need to have world-class infrastructure."The Port owns the land that the airport sits on. They've proposed a light rail-style people mover that would connect trolley stations nearby to the terminal.Meanwhile, SANDAG and the County of San Diego released a study proposing a skyway with gondola rides that could run from the Convention Center to the Airport."I think the only obstacle is getting everyone to the table quickly," says Castellanos. "That's something that can be easily overcome."The airport says they're willing to look at all options, but they can't take a stand or incorporate any into their current plans because they can only control what happens on airport property."The view from the airport's side is that we're not the region's transit planning agency," says Probst.Funding is also an issue. The expansion project will only use FAA and airport-generated money. Because of that, FAA rules say they can only spend money to improve things at the airport or directly related to the airport. A tram or skyway that spans all of Harbor Drive would require an exception to that rule and would need money from other agencies as well.Probst says the airport has already started talking to the FAA about that option. They got a similar exception to help with infrastructure improvements when the airport built the rental car center a few years back.Right now, the airport is reviewing comments from their Environmental Impact Report. The next step is to put together environmental quality reports for the state and the federal government. Probst says the debate over transit is slowing down the process, to the point where he doesn't think they'll be able to start construction until after 2020. 2932
SAN DIEGO (KGTV) -- With just weeks to go before the first day of school, parents across California are trying to figure out the best way to ensure their kids get a quality education.For some families, that means pulling their kids from a traditional district school."We're going to be homeschooling them," said parent Sarah Farsian.The Farsians have two kids, a first- and second-grader."In the pandemic, we are really afraid of sending them back to a campus," Farsian said. "Even though they're disinfected, what if they get sick."Her family is not the only one across the state making the same decision. Along with setting up their home school, some families are looking into micro-schooling or a small school. It could have regular classroom space or operate out of someone's home, using remote curriculums."First, it's going to be just us, but we are a member of a Facebook co-op group that also has accredited tutors, accredited teachers all different grades," Farsian said.Parents' decisions on where and how to educate their children could have impacts on the schools they leave."The overwhelming majority of the money to the overwhelming majority of districts from the LCFF, Local Control Funding Formula, which comes from the state, the dollars come from the state and go to the school districts based on the number of students they've got and also the distribution, the demographics of those students," said Bob Blattner with Blattner and Associates, an education lobbying and consulting firm.In a May revision to the governor's budget, the Local Control Funding Formula took a significant hit. The proposal states, "Absent additional federal funds, the COVID-19 Recession requires a 10 percent (.5 billion) reduction to LCFF."Lawmakers pushed back and passed a budget that kept school funding at current levels. Schools will get the same amount of state funding as they did this past school year. However, billions of dollars will be deferred, and schools won't be able to get it until the next school year."If we don't get federal dollars, the final budget deal starts borrowing from the next year," Blattner said."Districts are either going to have to go into their savings, and many have enough, or they're going to have to borrow. If they can't do either, the budget does have a provision giving support for districts that can't access the borrowing tools they need."Deferrals will impact districts and public charter schools a bit differently."Everybody is going to be subject to deferrals, and what that means basically is you will be reimbursed at a later date," said Myrna Castrejón, president and CEO of the California Charter Schools Association.Castrejón said in the last recession when they saw a lot of deferrals impacting the charter school sector, many of their school networks had to file for bankruptcy or borrow at commercial interest rates."Charter schools can't levy taxes, they can't pass bonds," Castrejón said."It's creating a particularly precarious perfect storm of fiscal challenge for charter schools when you can't get reimbursed for the students that are coming. You have limited access to borrowing capital to withstand the impact of deferrals," she said.Castrejón said there is a concern for some school entities when it comes to average daily attendance.The budget made it so growing schools and schools that have seen enrollment drop still get funded at the same level."Which means that for our charter schools that are growing and for district schools also that are experiencing enrollment growth, which is about 30 percent of districts across California, we're not going to be reimbursed for those students that we're serving," she explained.Castrejón said the governor did ask lawmakers to pursue solutions to fix the issue.As for Sarah Farsian, she said her kids will go back to a physical school location when they think it's safe."This is only for right now," she said. "If they can get this under control, yes (they will go back). They need to be with their friends." 4029
