Michael Avenatti's week is off to a bad start, at least in court.On Monday, a California judge hit Avenatti with a .85 million judgment for failure to pay the debt owed to his former Newport Beach law partner, a court representative told CNN.The order stems from an agreement that allowed Avenatti's law firm, Eagan Avenatti, out of bankruptcy in 2017. As part of the agreement, Eagan Avenatti LLP agreed to a settlement with his former non-equity partner Jason Frank's law firm and the IRS.The firm agreed it would pay .85 million in two installments. If a payment was missed, that amount would balloon to million.Eagan Avenatti LLP failed to make the first payment and found itself in default, which put Avenatti himself in a financial pickle.Avenatti, who has become a household name as porn star Stormy Daniels' hard-hitting attorney in her case against President Donald Trump, had personally guaranteed the payment of .85 million -- meaning he was on the hook if his firm didn't pay. When Jason Frank Law PLC was not paid, he sued in federal and state court, and Los Angeles Superior Court Judge Dennis Landin ruled in favor of him on Monday.Frank's attorney Eric George told CNN that Avenatti had attempted to delay the case by trying to get it moved to federal court, but failed in his effort."He thought he could gum up the works and file something last minute and the state court would throw up his hands. The trial judge saw through it and ruled on the merits of our motion," George said.Earlier this year, Frank had won a judgment against the Eagan Avenatti firm for the million that had been agreed to in the same settlement. That is, until a Black Lives Matter mural was vandalized.“We’re really just fighting for our black community members here in Martinez and across the country, to be able to exist in America and globally, without fear,” said Justin Gomez, a community organizer in the California town. “We weren’t surprised that it got vandalized, we were more so just shocked at how brazen it was.”Gomez just wanted to let black community members in Martinez know they mattered when he got a permit to paint a Black Lives Matter mural“I hadn’t even taken off my paint clothes,” said Tati Rae, who helped paint the mural.It was only up for a couple of hours before two people were accused of trying to vandalize it.“This is just kind of a microcosm of everything that’s happening in this country around racism and white supremacy and we got to see that play out right here in our own community,” said Gomez.Nichole Anderson and David Nelson were arrested, accused of painting over the mural. They were charged with multiple misdemeanor counts, including a hate crime charge.“When people are outraged by Black Lives Matter. It’s a representation of what this country is founded on,” said Nuru Dennis.But for Gomez, it’s an opportunity.“I think right now this is an opportunity for our town to be a model for predominantly white, smaller communities across the country, to show we don’t get a pass just because we have a less than 4% black population. Andy Beshear and state public health officials.The Derby is set to take place on Saturday, Sept. 5 after being postponed from its original date, Saturday, May 2.Churchill Downs says its plan was developed in conjunction with advice and counsel from the Louisville Metro Health Department and Kentucky’s Healthy at Work guidance.Some of the steps that will be taken to ensure guest and employee safety include:Venue capacity reductions to limit overall crowd density, including general admission, outdoor reserved seating, premium dining and suites. More information on ticketing and seating areas will be released in the coming days and also will be sent directly to ticket holders.Access throughout the facility will be severely limited.Credentials for employees, media and guests will be reduced.Barn area access will be restricted to essential personnel. Guests and parties in the barn area for morning workouts and during race days will be eliminated.Changes in venue operations to limit person-to-person touchpoints.Team member protocols established to protect employees and guests.A revised "Fan Code of Conduct" will also be in place that establishes expectations for guests coming to the Derby:Guests will be consistently and frequently encouraged to wear a mask at all times unless seated in their reserved seat or venue, including when riding on a shuttle, traveling through the venue, going to the restroom, placing an in-person wager, and purchasing food or beverages from a concession stand.
