SAN DIEGO (KGTV)-- A San Diego mother says working from home during the coronavirus pandemic cost her her job. She claims she was fired because her kids were making noises in the background of her teleconference calls."We're letting you go," Drisana Rios said. That was what her Human Resources representative told her in a call earlier this month. She said she thought the call was supposed to help resolve her workplace problems. Instead, by the end of the call, she says she was fired.Rios says it all began in mid-March when her bosses at an out-of-state insurance firm told her to work from home and telecommute via conference calls. This was in response to the state's COVID-19 lockdown orders.Rios says all parents working from home received an email from the company's regional boss that read, "thank you for the incredible effort you are putting forth through these difficult times." She says it also said that they would avoid layoffs during the pandemic.Like many parents, Rios was unable to find childcare for her four-year-old daughter and one-year-old son. Despite juggling parenting and working from home, Rios claims she was able to complete all her tasks. She adds that her clients never complained about her kids being in the background of her conference calls. The only complaints, she says, came from her male, direct superior."I said, 'Do you want me to lock my kids in the room? My one-year-old in the room? Do you want me to do that?' And… he responded and said, 'Figure it out.'" Rios said.She says she tried to arrange calls to be during her children's afternoon naptimes but claims her boss continued to ignore and demean her."He would purposely overlap schedules," Rios said.Rios then reached out to her HR department and asked how she should deal with the harassment she says she was experiencing-- a move she says that backfired a week later."She was shamed for having children, so she first elevated it to Human Resources," Daphne Delvaux, Sr. trial attorney at Gruenberg Law, said. "Human Resources took the side of the abusive manager, and terminated her for complaining."Rios has since filed a lawsuit against both her direct boss and the company for Gender discrimination, Retaliation, Gender harassment, Failure to prevent gender discrimination, Negligent supervision, Intentional infliction of emotional distress, and Wrongful termination in violation of public policy.In her complaint, Rios claims her HR representative told her that the company was "...experiencing a reduced revenue due to COVID-19 and they were laying [the] plaintiff off as a result of the pandemic." But Rios believes this was retaliation."The fact that they tried to cover it up because I went to HR, it's obvious what they did," Rios said.ABC 10News reached out to the company headquarters for comment on this lawsuit. SAN DIEGO (KGTV) — USO San Diego's annual "Santa Store" event kicks off with a special event Tuesday night at their downtown office.The event allows children of military service members to pick a free present they can give their parents as a holiday gift."It just helps give a little more holiday cheer for our service members who do so much to keep us safe and secure at home," USO San Diego CEO Lorin Stewart told 10News.Volunteers collected and wrapped thousands of presents, including watches, tool kits, headphones, makeup kits, and handbags. The parents stay outside the Santa while USO San Diego volunteers help the children select the right gift. "They love being able to talk about what mom and dad are into and what they like, and then have that surprise under the tree," said military spouse Ashley Camak, who organizes the annual event. "Just makes it a magical moment for them."The evening also includes a meal, play area, and chance to take a picture with Santa. The "Santa Store" will be open December 4-6 from 5-8pm. 1040
SAN DIEGO (KGTV)- A judge ruled Friday that Alvin Quarles, known as the “Bolder Than Most Rapist," will continue to stay in a state hospital until at least December. A status hearing was held Friday morning to get an update on the location of where he will live. The search is still ongoing to find a location, and the judge has given the court a 90-day extension to do that. In the meantime, the San Diego County District Attorney’s Office has issued an appeal to pump the brakes on Quarles’ release. The Deputy District Attorney, Jessica Coto, says they are attempting to make sure Quarles is not released into the public before he is ready. “The evidence showed that the release of Mr. Quarles was premature and that he still poses a danger to the community,” says Coto. There have been many evidentiary hearings during this process that have not been open to the public. Quarles' victims feel they should have a right to know what was said behind closed doors. The DA's office is hoping that will be reversed during the appeal process. “It makes me shaky for myself personally, and it makes me shaky for the young people of our community, who is his demographic, and who I think really will be at risk,” said survivor Mary Taylor. In the 1980s, Quarles sexually assaulted more than 10 women, often holding them at knifepoint, forcing their boyfriends or husbands to watch as be brutally attacked them. He was sentenced to 50 years behind bars but was moved to Colinga State Hospital years ago to get treatment for sexually violent predators. Quarles was initially set to be housed in Jacumba Hot Springs, but that idea was shut down. Another status hearing has been set for Dec. 6. 1694
SAN DIEGO (KGTV) — Two prized pieces of San Diego sports history will be placed up for auction this week.Two awards belonging to San Diego Padres legend Tony Gwynn are going on the auction block Tuesday, according to listings from SCP Auctions.Gwynn's 14-karat gold 1998 National League Championship ring and Rawlings Career Gold Glove award are available for bidders starting at 10 a.m. Bids for each item begin at ,000.RELATED: San Diego Padres are bringing back the brown uniforms in 2020The reasoning behind the memorabilia auction was immediately clear. In 2018, the Gwynn family's Poway home was put up for auction, with bids starting at .2 million, but failed to sell.While Gwynn's skills earned him a spot in the MLB Hall of Fame and millions over his career, bad investments forced him to file bankruptcy in 1987.Last year, the Gwynn family settled a wrongful death lawsuit against the U.S. Smokeless Tobacco Company. The amount of the settlement was not disclosed, but Gwynn's family said the “matter has been resolved to all parties’ satisfaction."Gwynn died from salivary gland cancer in 2014. SAN DIEGO (KGTV) -- With just weeks to go before the first day of school, parents across California are trying to figure out the best way to ensure their kids get a quality education.For some families, that means pulling their kids from a traditional district school."We're going to be homeschooling them," said parent Sarah Farsian.The Farsians have two kids, a first- and second-grader."In the pandemic, we are really afraid of sending them back to a campus," Farsian said. "Even though they're disinfected, what if they get sick."Her family is not the only one across the state making the same decision. Along with setting up their home school, some families are looking into micro-schooling or a small school. It could have regular classroom space or operate out of someone's home, using remote curriculums."First, it's going to be just us, but we are a member of a Facebook co-op group that also has accredited tutors, accredited teachers all different grades," Farsian said.Parents' decisions on where and how to educate their children could have impacts on the schools they leave."The overwhelming majority of the money to the overwhelming majority of districts from the LCFF, Local Control Funding Formula, which comes from the state, the dollars come from the state and go to the school districts based on the number of students they've got and also the distribution, the demographics of those students," said Bob Blattner with Blattner and Associates, an education lobbying and consulting firm.In a May revision to the governor's budget, the Local Control Funding Formula took a significant hit. The proposal states, "Absent additional federal funds, the COVID-19 Recession requires a 10 percent (.5 billion) reduction to LCFF."Lawmakers pushed back and passed a budget that kept school funding at current levels. Schools will get the same amount of state funding as they did this past school year. However, billions of dollars will be deferred, and schools won't be able to get it until the next school year."If we don't get federal dollars, the final budget deal starts borrowing from the next year," Blattner said."Districts are either going to have to go into their savings, and many have enough, or they're going to have to borrow. If they can't do either, the budget does have a provision giving support for districts that can't access the borrowing tools they need."Deferrals will impact districts and public charter schools a bit differently."Everybody is going to be subject to deferrals, and what that means basically is you will be reimbursed at a later date," said Myrna Castrejón, president and CEO of the California Charter Schools Association.Castrejón said in the last recession when they saw a lot of deferrals impacting the charter school sector, many of their school networks had to file for bankruptcy or borrow at commercial interest rates."Charter schools can't levy taxes, they can't pass bonds," Castrejón said."It's creating a particularly precarious perfect storm of fiscal challenge for charter schools when you can't get reimbursed for the students that are coming. You have limited access to borrowing capital to withstand the impact of deferrals," she said.Castrejón said there is a concern for some school entities when it comes to average daily attendance.The budget made it so growing schools and schools that have seen enrollment drop still get funded at the same level."Which means that for our charter schools that are growing and for district schools also that are experiencing enrollment growth, which is about 30 percent of districts across California, we're not going to be reimbursed for those students that we're serving," she explained.Castrejón said the governor did ask lawmakers to pursue solutions to fix the issue.As for Sarah Farsian, she said her kids will go back to a physical school location when they think it's safe."This is only for right now," she said. "If they can get this under control, yes (they will go back). They need to be with their friends." 4029
