An officer who hit and killed Susan Lotempio, 64, in a car crash last Friday was not driving with emergency lights or sirens on, Buffalo Police revealed Thursday morning.An attorney representing the officer confirmed to Scripps station WKBW in Buffalo that the man is Officer Daniel Ahearn.Lotempio was taking her morning walk near Hertel Ave and Tennyson Ave when an officer hit her with his police car. She died at the scene.The manual for Buffalo Police officers differentiates calls for service into three categories: routine, rapid and emergency response, according to Buffalo Police Captain Jeff Rinaldo."Based on the nature of the call that the officer was responding to, it would fall either within the routine or rapid response," Captain Rinaldo explained. "But, based on our very preliminary investigation, the officer was following our policy and it was not a call for service that necessarily dictated the use of the emergency lights and sirens."The Buffalo News first reported details about the emergency lights and sirens, citing anonymous police sources who said the officer "was traveling at between 30 and 40 mph, providing backup for another police officer going to a complaint about "an irrational person" on Starin Avenue"."At this point, we do not believe that speed was a factor," Captain Rinaldo said. "But, again, we're waiting on the final accident reconstruction from the State Police."Tom Burton, the attorney representing Officer Daniel Ahearn, said the officer is cooperating with investigators. Officer Ahearn immediately submitted a blood sample following the crash and a check of his phone showed it wasn't being used at the time of the accident, according to Burton."Where this appears to be leading is that it is a tragic accident, but nothing that involves any criminal wrongdoing," Burton said.New York State Police are handling accident reconstruction during the investigation. The New York State Attorney General's Office is investigating the death, as it does with any civilian death in an officer-involved situation.“The Attorney General’s Special Investigations and Prosecutions Unit has opened an investigation into this morning’s incident, pursuant to the Attorney General’s authority under Executive Order No. 147. We’re committed to conducting an independent, comprehensive, and fair investigation.” 2397

American Airlines is taking its long-grounded Boeing 737 Max jets out of storage, updating key flight-control software, and flying the planes in preparation for the first flights with paying passengers later this month.The airline invited press reporters and photographers on board one of the planes Wednesday to demonstrate its confidence in the plane’s safety.All Max jets worldwide were grounded in March 2019 after the second of two crashes that together killed 346 people. Last month, the Federal Aviation Administration approved changes — mainly in flight-control software — that will allow airlines to resume flying the plane.American flew journalists from Dallas to the airline’s maintenance center in Tulsa, Oklahoma, where crews explained how they are bringing the planes out of storage and making FAA-required changes.American is likely to be the first carrier to put passengers on Max jets, beginning Dec. 29 with once-a-day round trips between New York and Miami. In the meantime, the airline plans flights with employees on board.Some relatives of people who died in the crashes — and who still believe the plane is unsafe — expressed outrage at both Boeing and American over what they termed a publicity stunt.Zipporah Kuria, a British citizen whose father died in the second Max crash, said Boeing and the FAA should instead turn over documents on changes made to fix the plane and how they were tested. The company has withheld the documents, saying they cover trade secrets.“I feel like Boeing is using the press to leverage public trust instead of actually genuinely earning public trust,” she said. “I’m really disgusted by the whole thing and the fact that American Airlines would pay for that. Their focus is more about the profit and corporate interest than it is about consumer safety.”Some people who lost family members believe that the FAA erred by not accepting all the recommendations made by pilots and aviation professionals during a public comment period on its proposal to let the plane fly again.Scrutiny of the plane has focused on a flight-control system called MCAS, which repeatedly pushed down the nose of the plane before both crashes. Boeing, which describes changes to the plane on its website, and the FAA say the system has been made less powerful and easier for pilots to override.Some of the family members, however, wanted a deeper, nose-to-tail review of the plane. And they don’t trust Boeing or the FAA, which allowed the plane to keep flying after the first crash, in Indonesia in 2018.“It hasn’t been evaluated to the point where we can say that it’s safe,” said Nadia Milleron, whose daughter was killed in the second crash, which occurred in Ethiopia. “This plane hasn’t flown very much with this new software, the revamped MCAS, interfacing with the plane. It’s not responsible for them to put you on this flight.”Chicago-based Boeing said Wednesday it has flown more than 1,400 test flights on updated Max planes. The FAA said its people put in 60,000 hours reviewing and testing Boeing’s work.American is likely to be the only U.S. carrier using the Max for several weeks. United Airlines expects to put the plane back in its schedule during the first quarter of next year, with Southwest following in the second quarter. Regulators in Europe and Brazil have cleared a path for their airlines to resume Max flights in a few weeks.It’s unclear whether the flying public will accept the plane or avoid it. Some industry officials believe that fear of getting on the plane has lessened with time. An Ohio woman was arrested for reportedly pouring hot grease on another woman during a fight in Cincinnati, according to WXIX. Charlene Thompson, 61, was already wanted for criminal damaging or endangerment when she was arrested for felonious assault. The victim suffered severe burns to her back and arms, police say. An 11-year-old boy in Colorado is being called a hero after performing the Heimlich maneuver and possibly saving his younger brother from choking on his dinner.“So I got behind him went like this, pushed and pulled up about four times so the chicken could pop out and it did,” Elias Yatrakis told Denver7.Elias and his younger brother, Alex, were eating dinner on Monday night in their Greenwood Village home after a baseball game when the incident happened. The older boy says he knew what to do and jumped into action.“I was relieved. I was glad he was OK,” he said.“From my perspective, he saved his life,” mom Danielle Yatrakis said. “I’m just really glad he had the confidence and the knowledge to know what to do.”The 11-year-old had that knowledge because he had just recently learned what to do in a situation like this.“I am a Cub Scout so we had to take this CPR class in our basement and it taught CPR, the Heimlich,” he said. “I wasn’t really thinking. I knew what to do since I did that class.”Elias had earned his first aid badge as a part of the Cub Scouts just a few months earlier.“When he got the badge I’m like, 'that’s great to know,' but I mean I learned CPR before and I never used it. And so you’re kind of like they’re nice things to know and I now feel differently. That was really serious and important that he paid attention,” his mom said.The boys spent the evening after it happened with a lot of hugs and gratitude, according to their mom, but have since gone back to the same competitive young boys that they were before.KMGH's Jason Gruenauer first reported this story. 1609
