SAN DIEGO (KGTV) -- On January 1, it will be legal for businesses to sell pot in California. With that, the questions and concerns about what that means for drivers out on the roads.“I think we will see an increase in DUI marijuana’s,” said Officer John Perdue, a San Diego Police officer in the traffic division.Perdue is an expert at DUI and drug recognition. Since November 8, 2016, when California voters approved Prop. 64, or the adult use of marijuana act, he’s been hearing the same thing when he comes across drivers he suspects are driving high.“Their first reaction is one of two, either A. ‘I have a medical marijuana card’, or B. ‘marijuana is legal.’ And I have to remind them, so is alcohol, but you still can’t drive under the influence of it,” Perdue said.How exactly will police be able to tell if someone is driving high?One tool that officers will use to help is the Drager Drugtest 5000, a presumptive drug screening test that can detect seven types of drugs in a person’s system.Like an alcohol breathalyzer, Perdue said, “the person has every right to refuse this.” But unlike alcohol, it doesn’t have a percent limit.If the Drager reads positive, Perdue said, “it doesn’t necessarily mean they’re impaired or under the influence, it just says that chemical or drug is in their body.”  So to be arrested for DUI, it’s still up to the officer to decide if the driver shows impairment.But that can be tough. Look at the Drager as an extra tool that’s used along with field sobriety tests, what an officer smells, sees or finds in the car, to formulate that officer’s opinion of whether a driver is high.“The hardest thing will be, because there is no per se limit right now, the officers are really going to have to be aware of the signs and symptoms,” Perdue said. 1808

SAN DIEGO (KGTV) — One person was found shot inside their vehicle in the Encanto area on Wednesday, according to police.The shooting occurred in the 6200 block of Varney Drive, near Leaf Terrace and Vado Way, just after 7:30 p.m., according to San Diego Police. Officers arrived to find a man in a vehicle who had been shot at least once.The man was taken to a nearby hospital, where he was pronounced dead. The man has been identified, though police only described him as a 44-year-old Black male.SDPD says it appeared the victim was in the area with an acquaintance when another vehicle pulled up near the victim and fired several rounds. The suspect then fled the area.Police described the suspect as an unknown race male, wearing all dark clothing. SAN DIEGO (KGTV) - National Guard troops have not been at the border for too long, but are already making their presence felt.Border Patrol officers last week arrested a 31-year-old woman on Interstate 15 they say was transporting 51 bundles of methamphetamine in her vehicle.The woman's vehicle was transported to a Border Patrol facility where agents continued searching the vehicle with the help of National Guardsman who have recently been deployed to the border.RELATED: Border Patrol officials discuss National Guard deployment to US-Mexico borderDuring the secondary search, agents initially did not locate any additional narcotics, officials said. Eventually, a National Guardsman found another 11 bundles of meth hidden deep within a door panel.In all, border agents discovered more than 68 pounds of meth valued at 6,000."Although the California National Guardsman have been on duty for only a couple of weeks, they have quickly fit in and are a great asset in assisting the Border Patrol to protect our communities," San Diego Sector Chief Patrol Agent Rodney Scott said.The woman has been turned over to Riverside County law enforcement and faces narcotics smuggling charges.RELATED: Thousands of kids a year migrate to the US alone. SAN DIEGO (KGTV) - Police body-worn cameras captured the parents of Trevor Heitmann pleading with officers to hospitalize their son just hours before he killed himself and two others in a high-speed car crash.In August 2018, Trevor Heitmann, known on his popular YouTube channel as McSkillet, ultimately drove the wrong way down the 805 at speeds over 100 miles per hour before the fatal accident.A lawsuit filed against the City of San Diego claims, police officers failed “to act in accordance with the statute and carry out their mandatory duty,” and as a result, Heitmann, “subsequently and predictably endangered the lives of others and himself and drove his vehicle at speeds in excess of 100 mph, striking Aileen and Aryana Pizarro's vehicle and endangering other members of the public.”The lawsuit goes on to say, “Because he was not evaluated by defendants to determine if he was a danger to himself or others, he was able to carry on with his erratic and mentally unstable behavior, and ultimately colliding head-on with Aileen Lydia Pizarro's vehicle, and thereby, causing fatal injuries to Aileen and Aryana Pizarro." 1137
