SAN DIEGO (KGTV) — San Diego Police have identified the man killed in an officer-involved shooting this week in Mountain View.Police said 39-year-old Jose Alfredo Castro-Gutierrez was shot and killed after officers responded to the 300 block of South Pardee Street just before 5 a.m. on Monday over reports of a violent disturbance involving a weapon.According to SDPD, Castro-Gutierrez was staying at a home as a guest when the residents were woken up by him. Eventually, Castro-Gutierrez crawled out of a broken window and made his way to the front of the property where officers were.Police said Castro-Gutierrez began to run at full speed toward them with the metal pole, prompting three officers to fire their weapons at him: One officer fired a bean bag round, another officer fired a Taser, and a third officer fired several rounds from his service pistol, SDPD says.Castro-Gutierrez was hit by at least one round and fell to the ground. Officers started first aid at the scene, but Castro-Gutierrez was pronounced dead at the hospital.The officer who fired his service pistol was identified as Isai Castillo, a two-year veteran of SDPD assigned to Southeastern Division.SDPD's homicide unit is currently investigating the shooting, after which the San Diego County District Attorney's Office will review the case to determine if the officers bear any criminal liability. SAN DIEGO (KGTV) - San Diego County leaders have stressed education over enforcement regarding the rules and laws surrounding the coronavirus, but there are laws in place to help stop the spread."There is civil liability and criminal liability," says Professor Joanna Sax from the California Western School of Law.Sax says many of the laws rely on a standard called "reasonable care" to determine liability."As long as you are taking precautions reasonably, then it's unlikely that you'll be held negligent. That would be the legal term," Sax says.For businesses, that means following the rules like posting a safe reopening plan and sticking to it to keep customers safe. It can also mean providing PPE and hand sanitizer for employees.But for businesses that aren't using "reasonable care," San Diego officials have shown the ability and willingness to use the laws to force compliance.One of the most prominent cases over the last few months involves Boulevard Fitness in University Heights. According to the city, that gym stayed open for indoor workouts for 45 days, violating the county's rules. City Attorney Mara Elliott threatened Boulevard Fitness with a ,500 fine for each day, citing "unfair business practices."The gym closed after receiving Elliott's letter and has since reopened while obeying county guidelines for capacity and distancing.Sax says those kinds of laws work for extreme cases, but may not apply for smaller violations."If businesses are not behaving reasonably and they are behaving recklessly, and they have no plans, and they're letting people in, maybe they should face liability," Sax says. "Those aren't the businesses that should be open to the public. SAN DIEGO (KGTV) - San Diego cyber security expert Ted Harrington with Independent Security Evaluators invited us to his Downtown office to see how quickly and easily he and his colleagues demonstrate successful hacks of modern medical devices. Medical devices like pacemakers and patient monitors are some of the newest vulnerabilities to cyber attack in the healthcare industry.  The threat hits home. According to the California Life Sciences Association, the state has more medical device jobs that anywhere in the nation, with 74,000 employees. A total of 7,700 of them are based in San Diego.  San Diego is a city that's no stranger to malicious software or "malware" assaults on the medical sector. Last year, the 306-bed Alvarado Medical Center had its computer system affected by what it called a "malware disruption". The hospital briefly considered doing an on-camera interview with us about the security changes that have been implemented since the incident, but then it backed out.The hospital spokesperson cited in part, "A careless slip during an interview can reveal possible [vulnerabilities] in our 'armor' that a hacker can take advantage of." Also last year, nearby Hollywood Presbyterian Medical Center made headlines when it paid a ,000 ransom to the hacker who froze its computer system for several days."Healthcare is attacked more than any other industry because that's where the money is," writes prominent cybersecurity company Sophos in its SophosLabs 2018 Malware Forecast report. A records check on the U.S. Department of Health and Human Services' Office of Civil Rights website shows a total of thirteen California healthcare facilities that are currently under investigation for reported hacks.  Now, the threat to patient privacy could be challenged by a threat to patient safety. Harrington and his team connected my finger to a sensor that was attached to a patient monitor. It would most likely result in a fatality," says Harrington. In October, the FBI put out a warning about the growing concern over cyber criminals targeting unsecured "Internet of Things (IoT)" devices, including medical devices like wireless heart monitors and insulin dispensers. Years ago, it was reported that former Vice President Dick Cheney had his pacemaker altered to prevent an assassination attempt. "We can't bury our heads in the sand anymore. These types of medical cybersecurity vulnerabilities are going to become commonplace," says Dr. Christian Dameff with UC San Diego Emergency Medicine. Dameff is also a self-described hacker. Despite the FDA's claim that there aren't any known cases of patients' devices getting hacked, Dameff believes attacks have happened and they were likely accidental, but never got reported."These devices in our systems are not well equipped to even discover these types of attacks," he said. "It's essentially like asking a toaster to figure out if your house has been hacked. They're just not designed to find out."The experts we spoke to want to make it clear that while there's a threat of cyber attacks on medical devices, the likelihood of it happening to the average patient is low. SAN DIEGO (KGTV) — San Diego Police Officers are patrolling the College Area, cracking down on noise and health order violations as San Diego teeters on the edge of the red tier for coronavirus restrictions.Friday eight cease and desist orders were issued to College Area houses. The reason being the residence "intends to hold large gatherings on Oct. 30, 2020, - Nov. 1, 2020, in blatant violation of the Order of the State Health Officer, the County Order of the Health Officer and Emergency Regulations, and CDPH's October 9, 2020 gathering guidance."Saturday on Dorothy Drive near Dorothy Way it was easy to hear music, excited yelling, and chatter from multiple homes. A steady stream of young people came and left various houses.Normally, Jean Hoeger says it gets pretty wild, but when she went out Friday, "it was pretty quiet you didn't see the hoards of kids walking on the street which is kinda common in the College Area."Hoeger is a representative of the College Area Public Safety Committee."There were parties but they all seemed to be inside small groups, loud noise was not really present so nothing you could call into the police department for a noise disturbance," Hoeger said.
