A Rikers Island inmate is back in police custody in New York after attempting to escape on Thursday, officials said.Around 12:30 p.m., the detainee climbed a recreation yard fence and ran to the shoreline, Deputy Commissioner of Public Information Peter Thorne said.The detainee was apprehended by K-9 Correction Officers Larry McCardle and Gregory Braska, Correction Officers' Benevolent Association President Elias Husamudeen said."These two brave officers immediately jumped into action to bring the inmate back into custody without any regards for their own safety," Husamudeen said. "We proudly salute them for their bravery and for reminding the public the critical role Correction Officers play every day in maintaining public safety.”Husamudeen is scheduled to speak Thursday afternoon.This is a developing story. A New York appeals court has denied a motion by President Donald Trump's attorney to stay the Summer Zervos defamation case pending appeal, meaning the gathering of evidence known as "discovery" can move forward as both parties await a ruling on the appeal.Zervos, a former "Apprentice" contestant, filed a lawsuit against Trump in January 2017 in which she alleged that Trump defamed her in 2016 after she said he sexually assaulted her in 2007.Trump's lawyer, Marc Kasowitz, is appealing the March 20 ruling by New York Supreme Court Justice Jennifer Schecter, who allowed the case to go forward. He wants the appellate court to revisit the matter of whether the Constitution's Supremacy Clause bars a state court from hearing an action against a sitting president -- what would be considered immunity, because it would make the President immune from suit. Schecter ruled it does not. Kasowitz also argues that Schecter erred in denying the President's motion to dismiss or delay the case on First Amendment grounds.Kasowitz said his motion should be granted on the grounds that New York and federal law both mandate a stay pending appeal, that proceeding with the case could irreparably harm Trump, and that the temporary suspension being sought was not designed to delay the case. But the Appellate Division of the New York Supreme Court denied his motion in a one-page ruling."We look forward to proving Ms. Zervos's claim that defendant lied when he maliciously attacked her for reporting his sexually abusive behavior," said Zervos' attorney, Mariann Meier Wang. Kasowitz did not immediately respond to a request for comment on the ruling.Earlier this month, Zervos' team issued subpoenas to Metro-Goldwyn-Mayer and the Beverly Hills Hotel as part of their effort to prove that Trump lied "when he falsely denigrated Ms. Zervos and denied sexually assaulting her," Wang said. She set a May 31 deadline for both companies to comply with the subpoena for the material requested.MGM owns the archives of "The Apprentice" and Wang wants the company to hand over all documents, video or audio that feature Zervos or Trump talking about Zervos and any recording in which Trump speaks of women in a sexual or inappropriate manner. Wang also wants to depose an MGM representative to inquire about how recordings of "The Apprentice" are stored and maintained, who has access to them, and when, if ever, they were transferred or destroyed.The subpoena asks for "(a)ll video and audio recordings that include Donald J. Trump talking or commenting on the female candidates or female potential candidates of any season of The Apprentice in any sexual or inappropriate manner, including without limitation any statements or comments by Donald J. Trump concerning any female candidate's or potential candidate's body or body parts and/or his sexual or romantic desire or intention concerning any female candidate or potential candidate."Wang also wants records from the Beverly Hills Hotel of any stay by Trump from 2005 through 2009 and documents related to his longtime bodyguard Keith Schiller, his longtime assistant Rhona Graff or Zervos and for "(a)ll video recordings that depict the entrances, common areas, or bungalow areas of the Beverly Hills Hotel during the month of December 2007."The-CNN-Wire 3308

A US Postal Service employee was found fatally shot inside a truck on Interstate 30, Dallas police said.The employee was found about 2:20 a.m. Monday in a USPS box truck on the Dallas-Fort Worth Turnpike Freeway, police said in a statement.Homicide detectives and US postal inspectors responded, but police did not indicate what might have happened. The victim has not been named yet.A photo from the scene shows the truck resting beside a guard rail.On February 8, a marked Dallas police squad car was shot at about one mile from Monday's incident. A recently published study looks at the potential of asymptomatic spread at grocery stores and the psychological distress of these essential workers.Researchers looked at a grocery store in the Boston area in May. They found 20 percent of the 104 employees tested positive for the coronavirus. This rate was significantly higher than the infection rate in the surrounding community, which was only reporting a positive rate of around 1 percent at the time.More than 75 percent of those who tested positive reported having no symptoms.Those employees who interacted with customers were five times as likely to test positive for COVID-19 compared to employees in other positions."We were definitely surprised to see that there were that many people that were asymptomatic," Dr. Justin Yang, an assistant professor at Boston University School of Medicine and a researcher at Harvard School of Public Health who worked on the study told CNN. "This is definitely very alarming as it means that retail grocery store employees are exposed to customers and sort of serve as a middleman for the virus - like a super spreader almost."The study also looked at feelings of anxiety and depression among the grocery store employees.About 24 percent of all employees reported feeling at least mild anxiety. The data suggests employees who were able to remain socially distant while at work had a lower rate of anxiety; 76 percent of those who reported having no anxiety were able to keep spacing while at work.Whereas 46 percent of those who did report having anxiety were unable to stay socially distant from coworkers or customers while on the job.About 8 percent of employees screened positive for at least mild depression symptoms on a self-reported questionnaire. Those who could not practice social distancing at work and commuted by public transportation were more likely to screen positive for depression.As a conclusion, the team of researchers hopes their findings are a call to action for providing comprehensive employee assistance services to help essential workers in all industries “cope with the psychological distress during the COVID-19 pandemic.”The study was published in the Journal of Occupational and Environmental Medicine. 2241

  

A pedestrian bridge suddenly collapsed onto the road below near Florida International University, crushing cars and killing at least six people Thursday.Hours after the bridge collapsed, officials said early Friday that the rescue mission is now a recovery operation.Emergency crews worked overnight in what Miami-Dade Police spokesman Alvaro Zavaleta called a "very slow process" in order to preserve evidence and the safety of possible victims and rescuers, because of unstable conditions at the bridge.At least nine people were transported to hospitals for treatment, authorities said.Witnesses described hearing a loud boom Thursday and moments later, finding victims, including construction workers across the wreckage and people trapped in cars.Senator Marco Rubio, who visited the site Thursday, posted on Twitter: "The cables that suspend the #Miami bridge had loosened & the engineering firm ordered that they be tightened. They were being tightened when it collapsed today." Rubio has been a visiting professor at the university for the past 10 years.The bridge's main span, which weighs 950 ton, had just been installed Saturday over eight lanes, near the university in Miami.  1205
