LONG BEACH (CNS) - For thousands of years, millions of tiny white abalone snails lived along the California coast.Now facing extinction, the white abalone will be getting a major boost toward survival this month, thanks to a breeding program spearheaded by marine organizations across the state, including the Aquarium of the Pacific in Long Beach.In mid-November, researchers from the aquarium, the National Oceanic and Atmospheric Administration, the UC Davis Bodega Marine Laboratory, the Bay Foundation, Paua Marine Research Group and state Department of Fish and Wildlife will be releasing white abalone into the wild at a series of undisclosed locations across Southern California.RELATED: Dog swept out to sea rescued, owner asks for more signage"This is a historic moment, as a species once on the brink of extinction may finally have a chance to rebound," said Sandy Trautwein, vice president of animal husbandry at Aquarium of the Pacific. "This is important not just for white abalone, but for the entire marine ecosystem off Southern California."Researchers are withholding the locations of the planned releases, hoping to give the white abalone the best chance at successfully settling into their new homes. The white abalone were actually placed underwater at their release locations last month, but they remain inside holding boxes."Natural recovery is not occurring fast enough or at all for this species to rebound on its own," said Melissa Neuman of the NOAA National Marine Fisheries Services' Abalone Recovery Program. "Fishing and other human activities brought white abalone to the brink of extinction, and now it is our responsibility to recover the first federally protected marine invertebrate."RELATED: Video: Rare blue whale with calf spotted off San Diego coastThousands of the white abalone have been bred through the program. Aquarium of the Pacific officials noted that when they joined the program in 2008, only 75 white abalones existed in managed care.The once-teeming population of white abalone was decimated over the decades by overfishing and low reproduction rate, according to the NOAA. Recent surveys indicated that the population dropped by about 99% in Southern California since 1970s.The white abalone was officially listed as a federally endangered species in 2001 -- the first marine invertebrate ever to make the list.NOAA officials said that without intervention, the remaining population would likely continue to decrease by 10% a year. 2493

The plane was flying northwest of the junction of the 710 and the Century (105) freeways, according to a map released by the FBI. More specifically, it appears the plane was in the area west of the 710, east of San Juan Avenue, north of Firestone Boulevard and south of Cudahy Park."Tower, American 1997. We just passed a guy in a jet pack," the pilot said on the August radio transmission. An air-traffic controller -- noticeably taken aback by the report -- responded, "American 1997, OK, thank you for the update. Left side or right side?""Off the left side," the pilot replied, "at maybe, uh, 300 yards or so, at our altitude."At least one other pilot, aboard a Southwest Airlines flight that August, also spotted the unusual aviator: "Tower, we just saw the guy pass by us," the pilot reported.The LAX tower alerted an inbound JetBlue pilot to beware of "a person with a jet pack reported 300 yards south of the L.A. final at about 3,000 feet." Looking around the room where Hector Barajas spends the majority of his time, you could easily forget you’re in Mexico. American flags, G.I. Joes, and military dog tags line the walls.“I wanted to serve my country,” Barajas recalls, of his decision to join the United States military, where he served 82nd Airborne Division of the U.S. Army from 1995 to 2001.But he sits in Tijuana not by choice.“I was picked up by immigration and deported in 2004,” he said.The phrase “deported veteran” may not be a common part of most people’s vocabulary, but they exist—and there are many.The military does not keep and make public an official count of deported veterans, but the ACLU, which assists deported veterans, including Barajas, estimates the number is easily in the thousands.“One of the most difficult things is being separated from your kids,” Barajas says, referring to his 11-year old daughter who still lives back in California with her mother.  “I try to call her everyday in the mornings when she’s going to school, and we Skype.”Barajas was born in southern Mexico. His parents had crossed the border illegally some time earlier, and when Barajas turned 7, Barajas—along with his sister and a cousin—crossed over to meet them.  They succeeded and spent the majority of their upbringing in southern California.He considers the U.S. his only real home.“It’s where I grew up, it’s where I studied. I did everything in the United States.”It’s also where he took an oath to defend that very same country.But shortly after his enlistment ended in 2001, Barajas says he made a mistake. He was convicted of “shooting at an occupied motor vehicle” and sentenced to prison.  Not long after his release two years later, he was picked up and deported to Mexico.He made it back to the U.S.—“snuck” back home, as he says—and was able to remain until authorities stopped him following a fender bender in 2010. That lead to his re-deportation.He’s been fighting to become a permanent citizen ever since. California Governor Jerry Brown pardoned him last year, erasing that conviction off his record. That, he says, gives him hope that citizenship may not be far off.But in the meantime—and for the last 5 years—Barajas has devoted his time to helping other deported vets. He created the Deported Veterans Support House in Tijuana.“I basically started doing this full time and turning my apartment into a support house [in 2013] and then it just took off from there,” he says smiling.It’s a place where recently deported veterans can get help with benefits, compensations and benefits they may be owed, even medical assistance.He says they’ve had about 40 people in total utilizing the shelter as a temporary place to live. Barajas says one of the hardest parts about being deported is losing your support network and going through it all in what for many of them is a strange land.“When you get deported some of us really don’t know the country that we’re deported to. We may not have been to this country since we were children.”He wants anyone enlisted in the U.S. military to know one thing: just because you have legal permanent resident status and you join the military, it does not guarantee that you will automatically become a citizen. You have to actively pursue citizenship.“When I got my green card, it’s a legal permanent resident card,” Barajas says. “I thought it was permanent. But its not permanent.”As for the crimes he and other veterans may have committed that lead to their deportation, he says every makes mistakes—but they should be allowed to pay their debt to society and remain in the U.S.“Regardless of what these individuals have done they should still be allowed to stay in the U.S. with their families,” he said. Now, the only way he may be guaranteed to get back into the country he calls home is when he dies since he would be eligible for burial at Arlington National Cemetery. 3927

  

LOS ANGELES (CNS) - The captain of the Conception, a Santa Barbara- based dive boat that caught fire last year near Santa Cruz Island, resulting in the deaths of 33 passengers and one crew member, was indicted today by a federal grand jury in Los Angeles on 34 counts of seaman's manslaughter.Jerry Nehl Boylan, 67, of Santa Barbara, was named in the indictment that alleges Boylan, as the captain and master of the vessel, ``was responsible for the safety and security of the vessel, its crew, and its passengers.''Each of the 34 little-used seaman's manslaughter counts carries a penalty of up to 10 years in federal prison, according to the U.S. Attorney's Office.Federal prosecutors informed Boylan's attorneys of the indictment after it was filed, and the defendant is expected to self-surrender to federal authorities in the coming weeks.The indictment alleges that Boylan caused the deaths of 33 passengers and one crew member -- including two Santa Monica residents -- ``by his misconduct, negligence, and inattention to his duties.''Marybeth Guiney and Charles McIlvain, diving enthusiasts who lived in the same Santa Monica condominium complex, were among the nearly three dozen people trapped aboard the Conception when it sank amid a three-day Labor Day weekend diving trip to the Channel Islands.The indictment cites three specific safety violations: failing to have a night watch or roving patrol, which was required by the Code of FederalRegulations and for over 20 years was a requirement in the Conception's Certificate of Inspection issued by the U.S. Coast Guard; failing to conduct sufficient fire drills, which are mandated in the CFR; and failing to conduct sufficient crew training, which was also required by the CFR.The 75-foot, wood-and-fiberglass passenger vessel docked in Santa Barbara Harbor. On what would be its final voyage, the boat carried 33 passengers and six crew members.During the predawn hours of Sept. 2, 2019, a fire broke out while the boat was anchored in Platt's Harbor near Santa Cruz Island. The fire, which engulfed the boat and led to its sinking, resulted in the deaths of 34 people who had been sleeping below deck. Boylan was among five crew members who were able to escape.``As a result of the alleged failures of Captain Boylan to follow well- established safety rules, a pleasant holiday dive trip turned into a hellish nightmare as passengers and one crew member found themselves trapped in a fiery bunk room with no means of escape,'' said U.S. Attorney Nick Hanna.``The loss of life that day will forever impact the families of the 34 victims. With this indictment and our commitment to vigorously prosecute the case, we seek a small measure of justice for the victims and their loved ones.''The fire aboard the Conception is one of California's deadliest maritime disasters, prompting criminal and safety investigations. The families of victims have filed claims against the boat owners, Glen and Dana Fritzler and Truth Aquatics, and the Fritzlers and the company, in turn, filed a legal claim to shield them from damages under a maritime law that limits liability for vessel owners.The families' suits allege that the 41-year-old Conception was in blatant violation of numerous Coast Guard regulations, including failing to maintain an overnight ``roving'' safety watch and failure to provide a safemeans for storing and charging lithium-ion batteries, and that the below-decks passenger accommodations lacked emergency exits.``Nothing will ever replace the 34 lives that were lost in the Conception tragedy,'' said Special Agent in Charge Kelly S. Hoyle of the Coast Guard Investigative Service-Pacific Region. ``Our hearts remain with the families as the Coast Guard continues to work with our partners in the Department of Justice on this investigation.'' 3828
