OCEANSIDE, Calif. (KGTV) -- A woman was killed Monday after police said she was run over by heavy machinery at an Oceanside beach.The incident was reported shortly after 10 a.m. in the 1200 block of North Pacific, Street, near Oceanside’s South Harbor, according to an Oceanside Police Department spokesperson.The spokesperson said the woman, who was not identified, was asleep on the beach when the equipment hit her. No other people were struck.Police told ABC 10News the heavy machinery was at the beach as part of a dredging project at the harbor. 559

Marguerite Cruz, who is a co-owner of Te Mana Cafe, said someone broke into her restaurant early morning on Valentine’s Day. “I just felt really attacked,” she said with tears in her eyes.She said the burglary was caught on multiple surveillance cameras. The video shows the person crawling in through a window, then using some sort of took to dislodge the cash drawer from the register. A couple weeks ago, less than two blocks away, a criminal was caught on camera breaking into Pat’s Liquor and stealing the entire cash register. Police have not said if they think it is the same criminal, but Cruz seemed certain. “I think this person’s on a roll,” she said.  777

One of the people inside the Waffle House in Antioch, Tennessee where a gunman opened fire said she played dead in order to stay alive.Kayla Shaw, age 21, shared her story with Scripps station WTVF in Nashville three days after three customers and a restaurant employee were killed. "That was a very traumatic experience, and it changed my life," Shaw said. "I went to a store for the first time yesterday, and I was constantly looking over my shoulder and checking my surroundings. Every little noise scared me."Shaw is from Brownsville, Tennessee and was in Nashville to visit her cousins over the weekend.They were at a different Waffle House that morning, but it was so busy that they placed a to-go order at the Murfreesboro location instead.She was paying for her food near the counter when gunshots erupted."I heard a loud pop on my left side, and after that I felt the glass from the window hit my face and I fell on my right side," she remembered. "I laid there, and my first thought was, 'God please don't let me die inside of a Waffle House.'"The young mother showed the scratches to her face from the glass and the bruise on her arm after hitting it against a stool. She said all she could do at that point was close her eyes and pray."The one time during the altercation I opened my eyes, the only thing I saw was the shooter's genitals because he was naked in the direction I was laying. I question why I got to live, but I feel like my actions by playing dead actually helped me live after I heard the gunshot," she emphasized. "My whole body was motionless."Unbeknownst to her, another restaurant patron wrestled the AR-15 from the gunman and likely saved countless people from dying.She hid behind the counter as soon as she no longer heard gunshots."I actually tripped over someone's dead body and I fell right in front of a young lady who had a majority of her leg blown off. I was in such a state of shock, all I could do was pray over her," added Shaw. "She asked me to give her her phone which was under the guy's body I tripped over."When it was clear to go, Shaw frantically ran to the car and drove off with her cousins.It did not take too long before she spotted the naked gunman on the run."I'm speeding though like we're so shocked, and I see the naked shooter on the side of the road. I was almost paralyzed in that moment. It was so terrifying to leave that place and to actually see him on the side of the road walking, while my cousin was on the phone with dispatchers," she said. That same day she got to meet James Shaw (who she is unrelated to), the man credited and honored by Tennessee lawmakers for stopping the shooter from killing others. She described the moment as emotional as both hugged and cried in each other's arms."I continued to express my gratitude to him," she said. "James, on behalf of me and everybody that walked out of the Waffle House, we thank you so much."Travis Reinking, age 29, was arrested for the shooting following a nearly 35-hour long manhunt. The victims he's accused of killing were Taurean Sanderlin, Joe R. One of the first things Richard Phillips did when a judge finally declared him a free man is go on a grocery run. He was amazed to discover how many varieties of orange juice are on sale.It's just one of many revelations Phillips is dealing with these days after 45 years in prison for a crime he didn't commit.Phillips was exonerated earlier this week after a judge threw out his murder conviction. When he went in, the Detroit man was 27. He turns 72 next month.The time he served behind bars makes Phillips the nation's longest serving exoneree in history, says the Innocence Clinic at University of Michigan law school."The world has changed, a lot of people have changed," Phillips told CNN on Thursday. "I have a lot of adjustments to make."The crime for which he was chargedPhillips was an auto worker in Detroit when a man named Gregory Harris was dragged from his car and shot to death in June 1971.Based on the testimony of the victim's brother-in-law, police arrested Phillips. The brother-in-law told investigators he'd met up with Phillips and another man, Richard Polombo, at a bar to discuss Harris' murder.Phillips and Polombo were convicted. And in October 1972, Phillips was sentenced to life in prison without the possibility of parole.The break in the caseYears went by. Phillips' contention that he was innocent fell on deaf ears.Then, in 2010. Polombo said he lied. He told a parole board that he killed Harris along with the brother-in-law; Phillips had nothing to do with it. In fact, Polombo said, he didn't even know Phillips.But Phillips wasn't made aware of this exculpatory evidence until four more years.In 2014, someone tipped off the Innocence Clinic, an organization that investigates prisoner claims of innocence.After speaking with both Polombo and Phillips, the clinic took up his cause -- and began working quickly to get him a new trial.The long legal roadAfter years in and out of court and court of appeals, Phillips was finally granted a new trial late last year."When he first got his new trial, prosecutors dangled a carrot," Phillip's attorney Gabi Silver told CNN. "They said if he agreed to a plea deal, he could get out faster."Phillips refused."He told me, 'I will die in prison before I agree to a plea deal.'"On December 14, a judge overturned his murder conviction, making him the first person to be exonerated by the Wayne County Prosecuting Attorney's new Conviction Integrity Unit.But he had to wait until Wednesday to become a free man permanently.That day, Phillips -- wearing a blue suit and a big smile -- listened as prosecutors dismissed all charges against him."The system failed him. There's no question about it," Wayne County Prosecutor Kym Worthy told reporters. "Justice is indeed being done today."What lies aheadMichigan adopted the Wrongful Imprisonment Compensation Act in 2016, which grants ,000 for every year that a person has been wrongfully imprisoned. This makes Phillips eligible to receive up to ,250,000.Silver, Phillip's attorney, told CNN that she was "hopeful and very confident" that he would receive full compensation."The most difficult part of my journey since being freed has been that I do not have financial assistance from the state," Phillips said. "Exonerees do not get very much compensation from the State of Michigan."Phillips says he has been living off worth of food stamps each month since December."He's a very smart man," Silver said. "He's made some friends. He's living in an apartment with a friend. He wants to get his driver's license. He's very artistic."Despite his struggles, however, Phillips remains optimistic."I am not bitter," he told CNN. "I was upset at first, but mistakes happen in this world. No life is perfect. Everybody has problems. It would be unimaginable for me to be upset because I had problems, because everybody has them."Phillips spoke at length about his amazement at new technology."When I left the streets, if there were any phones at all, they were these big boot-like portable phones," Phillips laughed. "It would look like you had a big shoe up to the side of your face. We didn't have all these gadgets. iPhones didn't exist."When Phillips was convicted, he left behind a wife and two children, ages 4 and 2. He hasn't had contact with them since and hopes to reconnect soon."I have not seen my children in 45 years," Phillips said. "I hope that they will see my story in the news and come find me."In the meantime, Phillips is enjoying life outside of the prison walls."I'm so happy to be free, I'll make any adjustment I have to make," Phillips said.
