SAN DIEGO (KGTV) — The new community plan for Kearny Mesa, given final approval by the City Council earlier this week, takes effect Friday. Several properties are being rezoned with 27,000 new housing units planned for those parcels.“My vision is that within five years, you’ll be able to live on Convoy, enjoy the restaurants and the shops that are on Convoy, and work in a job in Kearny Mesa, all in one community," City Councilmember Chris Cate, who represents the area, told ABC 10News ahead of the final vote.Cate says the city is trying to encourage a"live-work" village concept for many San Diego neighborhoods, especially those that are major job centers, such as Kearny Mesa. The idea is that by creating housing and recreational possibilities in the same communities where people work, they will have to commute less. That has numerous benefits across the city, including less traffic and car pollution.It is anticipated that many of the new projects will replace aging strip malls whose parking lots remain vacant much of the time. Cate hopes the areas around Convoy St., Clairemont Mesa Blvd., and Aero Dr. will become similar to the feel of Little Italy.Because parameters have already been set for how many homes will go onto each affected parcel, as well as other necessities such as pathways, street improvements, and parks, there will not be the same drawn-out approval process that has been seen with other recent attempts at development. Cate says that means developers who acquire the land will be able to move quickly, as long as their design stays within the parameters of the community plan. “They already have an understanding of what these projects will look like, what’s required of them, where different pathways or parks will go. SAN DIEGO (KGTV) - The Coronavirus Pandemic has had an unexpectedly positive effect on the Helen Woodward Animal Center, as pet adoptions have doubled over the past week."This is a fabulous time to bring animals into your home," says Jessica Gercke, the spokesperson for the HWAC.Gercke says the Center has seen a surge in people applying for adoption and fostering because they're working from home, and have more time to integrate a new pet into the family."We're seeing a lot of teachers and graduate students," says Gercke, noting that many had planned to wait until summer break, but moved up their adoptions because of the extra time at home.That's what led Anna Fairman, a Carlsbad Kindergarten teacher, to adopt last Thursday. She took home a new dog, Archie."I had had this plan that I was gonna adopt a dog at the beginning of this summer so that I could obviously have time to spend with the dog and train it," she says. "Now, just seemed like the perfect time."The HWAC is doing its part to keep the adoptions as safe as possible. They're only letting one person in at a time, with appointments set up in advance. Each person is allowed to interact with up to three animals to decide which one to take home.For fostering, the HWAC is doing video chat calls to inspect the homes of people wishing to foster and make sure they're safe and appropriate for the pets. They're also doing online training for potential foster families."We're seeing this beautiful, beautiful love that animals give to us," says Gercke. "It lowers blood pressure. SAN DIEGO (KGTV) -- The family of Kimberly Fattorini is suing former San Diego Chargers linebacker Shawne Merriman in connection with her fatal overdose, according to a TMZ Sports report.Fattorini's parents claim Merriman drugged and assaulted their daughter before she died at a house party in 2017, the report says.In a statement, Merriman's representatives said they are unaware of the lawsuit and that the original police investigation found no wrongdoing by the former NFL star.Her parents say Fattorini and her friends were invited to a club promoter's house party, and that Merriman "was allegedly witnessed carrying a bottle with some sort of liquid inside."At some point during the party, she texted the promoter saying, "you friend just poor'd half G in my drink," the lawsuit says. Her "parents believe G refers to GHB," the TMZ report says.Per the report, Fattorini's parents claim that first responders found her unresponsive and "half naked with jeans unzipped and buttoned" at a party in Los Angeles. A preliminary autopsy listed her death caused by a lethal cocktail of alcohol, cocaine, and gamma-hydroxybutyrate -- the last more commonly known as the "date rape" drug GHB.The suit alleges that while her autopsy did not reveal foul play, "a test for sexual assault wasn't done because officials said it wasn't conducted at the time of the initial autopsy, and couldn't be done properly afterward," the report says.The "complaint claims negligence, battery and a violation of the drug dealer liability act," and the Fattorinis are seeking damages, TMZ Sports reports.Merriman's representative told TMZ, "As of right now Shawne, nor his attorney, have any knowledge of him being named in any lawsuit. SAN DIEGO (KGTV) - The man who attacked a teenage Syrian refugee on a San Diego trolley pleaded guilty Monday. Adrian Vergara, 26, was arrested Oct. 22 on an unrelated misdemeanor drug charge. While he was in custody, he was recognized in connection to the ongoing hate crime investigation. The 17-year-old boy was beaten on a Metropolitan Transit System car Oct. 15. Representatives for the Partnership for the Advancement of New Americans (PANA), who spoke on the teen's behalf, told 10News the teen was speaking Arabic while on FaceTime with a friend when a man on the trolley asked him, "Where are you from? Are you Mexican?" RELATED: Teen attacked on trolley in possible hate crime The teen reportedly responded, "No, I am Arab." According to the teen, the man then started punching him and cursing while using racial slurs. The victim left the trolley at the 62nd Street station in Encanto. Vergara pleaded guilty to assault and hate crime charges. As part of the plea deal, Vergara will be sentenced December 5 to five years in prison. 1051

SAN DIEGO (KGTV) - The local ACLU is now firing back at ICE officials after news broke Tuesday of a new measure in place of blocking certain calls from detainees’ being housed at the Otay Mesa Detention Center.“For the government to interfere with the people's ability to make those calls and advocates abilities to receive those calls is deeply troubling,” said ACLU senior staff attorney Mitra Ebadolahi. She’s now sent a letter to both ICE and ICE’s contractor, CoreCivic, demanding answers and writing in part, "…legally, these blockages may violate the constitution."On Tuesday, Alex Mensing with Pueblo Sin Fronteras said his number was blocked along with numbers to another immigrants rights' activist group, Otay Mesa Detention Resistance. Mensing told ABC 10 News, “Last time I checked, in the United States we're not supposed to censor people's ability to denounce abuses, to denounce medical negligence, to denounce physical assault by guards…by private prison guards or ICE officers against the people.”The Otay Mesa Detention Center has come under fire for allegations of poor health conditions and abuses inside as hundreds of people being housed there were testing positive for COVID-19.“Without more information, it does appear that his kind of blockage is either retaliatory or at least viewpoint discriminatory,” added Ebadolahi.The ACLU is demanding that ICE remove the blockage and offer a response by next Tuesday.CoreCivic referred ABC10 News to ICE which sent a statement Wednesday reiterating part of a statement from Tuesday which reported that it temporarily blocked detainee calls to a specific San Diego area phone number after calls resulted in disruptive behavior from detainees.
