SAN DIEGO (KGTV) - A judge decided Wednesday not to order a second trial for the man accused in the disappearance and murder of his stepson.Tieray Jones cried after the decision was made in the downtown courthouse.Jones was charged with killing 2-year-old Jahi Turner. Jahi was last seen at a park near Balboa Park in April 2002. Jones reported the boy missing, telling police Jahi wandered off.A mistrial was declared in for Jones on March 16.Jones was facing several charges including second-degree murder and involuntary manslaughter. Two jurors found Jones guilty of murder while 10 did not. 10 jurors found Jones guilty of involuntary manslaughter and two did not.During the trial, the judge asked if jurors would be able to reach a verdict if given more time to deliberate. They responded by saying no. RELATED: Mistrial declared for Tieray?Jones, stepfather of Jahi TurnerJahi was in Jones’ care while the boy's mother was on deployment. After Jahi disappeared, a countywide search followed. Thousands of people looked for the boy in the park and Golden Hill neighborhood. Duncan Hunter’s attorney to the United States Deputy Attorney General discussed possible evidence of extramarital infidelity and excessive drinking.On August 6, Hunter attorney Gregory A. Vega wrote to Rod Rosenstein at the Department of Justice requesting the postponement of this week's campaign fund misuse indictment, and addressed “an overly aggressive prosecution intent on criminalizing content that is civil in nature”.“While there may be evidence of infidelity, irresponsibility, or alcohol dependence, once properly understood, the underlying facts do not equate to criminal activity; these allegations are, however, intended to embarrass and humiliate the Congressman shortly before a crucial election, and also to alienate him from his wife, the only other person under investigation and his intended co-defendant,” wrote Vega.Prosecutors allege the Hunters used more than 0,000 in campaign funds to support a lavish lifestyle and reported the purchases as campaign expenses.The affidavit detailed money spent on hotel rooms for different individuals and various social outings, including one involving 30 shots of tequila. SAN DIEGO (KGTV) - A local World War II veteran who survived a battle with COVID-19 has died.In May, ABC 10News was there when loved ones, including daughter Lisa Hoover, welcomed home Ben Pack after a month in the ICU fighting COVID-19. He was among the oldest known survivors of the virus."It was one of the most emotional moments of my life," said Hoover.RELATED: 94-year-old El Cajon veteran who beat cancer, heart failure overcomes COVID-19At the age of 94, Pack had lived through a lifetime of survival stories. The World War II veteran survived tuberculosis, cancer, and congestive heart failure, but when he contracted COVID-19, his family prepared for the worst."There were days we thought it was over. We literally had our goodbye calls, and it was heartbreaking. What got him through this was his will to live and a fighting spirit, I guess," said Hoover.Even with that spirit, his battle with coronavirus took a toll. He lost 35 pounds and remained weak. In mid-October, while in his independent living apartment in Rancho San Diego, he fell and broke his hip. Surgery followed. He was 95, and he passed away on November 11, which was Veterans Day," said Hoover.Hoover says the timing of her father's death gave her family some solace."All felt it was a monumental day for him to pass. SAN DIEGO (KGTV) - A local family is desperately pleading to individual ICE officials to let them see their patriarch for the first time in 19 months. The Bakala family is seeking asylum after they say they barely escaped death in the Republic of Congo. Once they reached San Diego, the family of nine was separated.17-year-old Marie Louise Bakala should be focusing on college. But right now, that is on hold. "I am getting stronger, but it is not enough because I need my father back," Mari Louise said to the St. Luke's Episcopal Church congregation in North Park. The Bakala's left a comfortable life in the Republic of Congo. Father Constantin was a computer engineer for the Ministry of Health. His wife Annie Kapongo was a shop owner and mother of seven. The Bakalas say it all changed when the new government stepped in. Kapongo says because of Constantin's occupation, the family was targeted, brutalized, and even sexually abused by Congolese authorities. Fearing for their lives, they came to San Diego in 2017 to seek political asylum."This family came across a world come to a country that will protect them, but instead, it has only been a continuing nightmare," Pastor Colin Mathewson said. Annie Kapongo was released with an ankle monitor with the seven kids in San Diego. Immigration and Customs Enforcement [ICE] authorities detained Constantin in the East Coast alone. In February, a judge rejected Constantin's asylum case and appeal. But in March, he as given an emergency stay. Just last week, he earned the right to appear in front of a judge again, this time with a lawyer. Friends and staff of St. Luke's are now pleading with ICE to grant Constantin parole, to be with his family. They say it would be a show of good faith, just as the Good Samaritan did in the Bible."There is an assistant field director, and there is a deportation officer out there in Atlanta," Pastor Mathewson said. "We are asking Christine and Michael today to help somebody that needs so much help. After 19 months of detention, to bring him back home with his family as he awaits his next court date.""I hope that he will be here with us and we will be a family again," Marie Louise said."Please, please help me," Kapongo said through a French translator. "Send me back my husband."Last year, the couple missed their 20th wedding anniversary because Constantin was detained. If he is not paroled soon, he will also miss his eldest daughter, Marie Louise's 18th birthday. The family's next court date is September 25, 2019. 10News reached out to ICE for comment on this case.
