SAN DIEGO (KGTV) -- Allegations of battery made against a California Assembly candidate have proven to be false, according to the San Diego County Sheriff’s Department.Detectives say after interviewing several witnesses and reviewing surveillance video, allegations against Phil Graham have proven to be unfounded and the case is being closed.RELATED: State assemblyman candidate accused of batteryNiki Burgan filed the report on Sunday, May 20. Burgan alleged that the incident happened on May 14 at the First Street Bar in Encinitas. Burgan said she met Graham and that they engaged in conversation.Burgan alleged that Graham kissed her against her will and followed her outside before attempting to have her touch him in a sexual manner against her wishes.The department says it conducted a thorough investigation and disproved the allegations after being assigned to the case on May 21.10News reached out the Phil Graham and received the following statement:  1006

SAN DIEGO (KGTV) - A woman who mailed out her state tax payment at a post office in Mira Mesa got a big shock a few days later. A week ago, Barbara Reynolds wrote out a 9 check for her state taxes. She drove to her post office on Mira Mesa Boulevard and dropped it off around noon."I thought it was safer to come here," said Reynolds.Days later, she got a call. A bank teller in San Juan Capistrano was looking at her check, but it looked a lot of different. The amount had been hiked a bit to 9. Instead of the state, the new payee was the name 'Marco Antonio Lopez Ramirez."The teller shredded the check, suspicious because a man hoping to deposit the check had presented a dubious driver's license and an odd-looking check. As in other stolen check cases, the thief likely used a chemical solution to dissolve away the ink and 'wash' the check, before filling in the blanks."Very disappointed. It wasn't a good feeling at all," said Reynolds.The feeling was made worse because of how that check was stolen. One possible cause is 'fishing,' where thieves use a simple string - connected to something like a rodent glue trap - to fish mail out of a collection boxIn this case, Reynolds says the stolen check included her social security number."I'm very worried about identity theft. I won't be using the mail for future important documents or payments," said Reynolds.Reynolds filed a report with police and the Postal Inspection Office. SAN DIEGO (KGTV) - An Encinitas family on vacation woke up to a disturbing alert last week, video of someone stealing multiple packages from their porch.Homeowner Mark Sandorf says the most peculiar thing was who the thief was."It’s different in that she looks like she’s probably someone’s grandma," said Sandorf.The family immediately filed a police report from New Mexico.10News blurred the woman's face because the San Diego Sheriff's Department has not yet said she's a wanted suspect.One of the packages had sentimental value, three custom holsters for Sandorf's son who is in law enforcement."My son is, like I said, risking his life out there every day and we try to keep him in good equipment and what not. These were custom made by a friend of mine in South Carolina," said Sandorf.Sandorf says the most frustrating thing is knowing the holsters will likely get thrown away.He hopes others in his Encinitas Ranch neighborhood will be on alert after the incident. 980

SAN DIEGO (KGTV) -- A San Diego man was arrested Saturday after allegedly assaulting an elderly woman at a Central Coast beach parking lot in San Luis Obispo, law officials said.Morro Bay Police Officers responded to a disturbance call at around 1 p.m. at the Morro Rock parking lot on Coleman Drive, authorities said.Witnesses told officers that the suspect assaulted an elderly woman and knocked her to the ground. Numerous people witnessed the attack and went to help the victim, according to police.Officials said the woman was treated by first responders for moderate injuries.In a press release, officials said Brian Robert Sprinkle, 39, of La Jolla, "was participating in a surf competition when he exited the water and assaulted the woman without provocation."Sprinkle was booked in the San Luis Obispo County Jail on felony charges of elder abuse and battery, according to Morro Bay police.Officers also found a firearm with Sprinkle's property and seized it.It is believed the suspect was under the influence of marijuana and hallucinogenic drugs, police said in a statement.Anyone with information regarding this incident is asked to contact the Morro Bay Police Department (805) 772-6225.While police say Sprinkle was taking part in the Big, Bad and Ugly surf competition, surf contest organizers tell KSBY News he was not registered with the contest and is not affiliated with any of the surf clubs that participated.ABC 10News affiliate KSBY News contributed to this report. 1497
