DENVER, Colo. — On Wednesday, a Boulder man released videos of his July 29 arrest, and said he's ready to take action against the Denver Police Department for "savagely" beating him. He also claims an officer sexually assaulted him with a baton.Michael Jacobs, a self-described student activist, was arrested on July 29 during a "Stop the Sweep" homeless protest at Lincoln Park, across from the Colorado State Capitol.He says he was rattling a fence at Lincoln Park to get an officer's attention and says he was taken down by officers."I was grabbed from behind, it felt like it was from my neck, no warning, no 'you're under arrest,'" Jacobs said.It's important to stress that little is known about what led up to the takedown. Video shows people shaking a fence at the park and then the takedown.In the video, you see an officer run towards Jacobs and then several officers holding him down. You can briefly see an officer use his baton against Jacobs in the recording."One of the officers took his baton, lifted it in the air and forcefully shoved it into my a**," Jacobs said.A probable cause statement released by the Denver Police Department claims Jacobs was part of a group trying to push down a gate at Lincoln Park and adds that they managed to bring it down and get inside.But in the video, Jacobs is outside of the fence.The police report states Jacobs violently resisted arrest and even grabbed an officer's pepper ball gun. It's a claim Jacobs and his attorney, Dr. Matt Greife, dispute."That could not be further from the truth," Jacobs said."To say that he attempted to disarm a police officer of their pepper gun or pepper ball gun, that's nonsense, he was on the ground way too fast," Dr. Greife said.According to Dr. Greife, it's been challenging to obtain vital evidence they should be granted to prepare for a lawsuit and a civil claim they plan to file."We should know what the police reports say. We should know what the body cams tell us," Dr. Greife said.Denver police say they launched an internal investigation and added that it would be inappropriate to comment further.Medical records provided by Jacobs' attorney to KMGH show a doctor couldn't conclusively identify sexual abuse from the incident.Jacobs is facing a felony charge of attempting to disarm a police officer. DENVER, Colo. — Voters in Denver, Colorado, overwhelmingly voted to pass Ballot Measure 2J to lift the cities more than 30 years old ban on pit bulls.Ballot Measure 2J passed with 64.5% voting to lift the ban and 35.5% voting to keep the ban in place.Passing the measure will allow the city to grant a provisional permit to pit bull owners as long as the owner microchips the animal and complies with additional requirements set by Denver Animal Protection.Denver Council member Christopher Herndon led the charge, proposing the idea to lift the pit bull ban in January.Denver City Council voted 7-4 to repeal the ban in February, which would have replaced the law with what could be best described as a “probation” for pit bulls. However, Mayor Hancock vetoed the ordinance just days later, saying in a letter he could not support the legislation because it did not, "fully addresses the very real risk to a severe injury that can result from attacks from these particular dog breeds, especially should they happen to a child."The law banning pit bulls was put in place in 1989 after 20 people had been attacked by pit bulls in the previous five years.One was a 3-year old who died from the attack in 1986. Hancock argued in his letter to the council that less than 20% of all pets in Denver are currently licensed, which "raises significant questions about the effectiveness of this proposed new system."Proponents said breed-specific bans do not work and enforcing the ban has cost the City of Denver more than .8 million.Aurora, Lone Tree, Louisville, and Commerce City still have bans on pit bulls, though Castle Rock repealed their ban in 2018. Death Wish Nitro Cold Brew cans because the current process could lead to the growth and production of botulin.Botulism is a potentially fatal form of food poisoning and can cause symptoms like weakness, dizziness, double vision, difficult breathing and more.They have halted the production of the Nitro Cold Brew until an additional step in the manufacturing process is implemented.They have also removed cans from the comapny's online stores.The company said they will make sure everyone who bought the product on their website receives a full refund within 60 days.So far, no illnesses have been reported. 811

DETROIT — The Trump campaign announced Thursday it was dropping its lawsuit over the election results in Michigan. The news comes as two Republicans try to rescind their vote that certified Wayne County's election results, however there is no "legal mechanism" for them to do so.According to a statement from Trump lawyer Rudy Giuliani, the campaign wanted to stop the Wayne County results from being prematurely certified.“This morning we are withdrawing our lawsuit in Michigan as a direct result of achieving the relief we sought: to stop the election in Wayne County from being prematurely certified before residents can be assured that every legal vote has been counted and every illegal vote has not been counted," Giuliani said in a statement.It is also being reported that President Donald Trump reached out to the two Republican members of the Board of Canvassers in Wayne County before they sought to rescind their votes.The two Republican members initially voted against certification Tuesday night, then reversed course and voted for certification just ahead of the deadline. Now they are trying to rescind those votes."There is no legal mechanism for them to rescind their vote. Their job is done and the next step in the process is for the Board of State Canvassers to meet and certify," said a statement from Michigan's Secretary of State Jocelyn Benson.Monica Palmer, chair of the Wayne County Board of Canvassers, and William Hartmann, one of two Republicans on the Board, filed signed affidavits Wednesday night demanding to rescind their "yes" certification votes."I fully believe the Wayne County vote should not be verified," Palmer said in an affidavit. "The Wayne County election had serious process flaws which deserve investigation. I continue to ask for information to assure Wayne County voters that these elections were conducted fairly and accurately."After the two Republican members of the Wayne County Board of Canvassers initially caused a deadlock Tuesday, they eventually agreed to certify the county's vote on the condition of an audit.The motion to hold another vote came following hours of public comments condemning Republican canvassers' decisions to vote against the certification."Late in the evening, I was enticed to agree to certify based on the promise that a full and independent audit would take place," Palmer wrote. "I would not have agreed to the certification but for the promise of an audit."Both Palmer and Hartmann claim they were pressured into agreeing to certify the results after being subjected to harsh comments during a lengthy public hearing."This vote was followed by public derision from our two democrat colleagues. But just before 9:30 p.m. Tuesday, the Board filed a motion and voted to certify the results under the stipulation that Secretary of State Jocelyn Benson does a comprehensive audit of the election in the county.The canvassers' initial vote came after many Detroit precincts were found to be out of balance — meaning the number of votes is not in line with the number of voters.
