WASHINGTON — The Justice Department has unsealed charges against a Libyan bombmaker in the December 21, 1988 explosion of Pan Am Flight 103 over Lockerbie, Scotland. The attack killed 259 people in the air and an additional 11 on the ground in the town of Lockerbie. The flight was leaving London's Heathrow International Airport heading to New York's John F. WASHINGTON — The Supreme Court sounded skeptical Monday that President Donald Trump could categorically exclude people living in the country illegally from the population count used to allot seats among the states in the House of Representatives.But it also appeared possible that the justices could avoid a final ruling on the issue until they know how broadly the Trump administration acts in its final days in office and whether the division of House seats is affected.No president has tried to do what Trump outlined in a memo in July — remove millions of noncitizens from the once-a-decade head count of the U.S. population that determines how many seats each state gets in the House of Representatives, as well as the allocation of some federal funding.Justice Amy Coney Barrett was among several members of the court who said the administration’s argument for broad discretion in deciding whom to exclude is troublesome because “a lot of the historical evidence and long-standing practice really cuts against your position.”The court decided to hear the case on a fast track, based on the administration’s plea for a decision by early January, when Trump is required by law to transmit census numbers to Congress. The Census Bureau is supposed to send the data to Trump by Dec. 31. However, the bureau said last month they are checking anomalies and the data will be delayed. They did not give a new date, only saying they hope some data will be available in January. VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

VISTA, Calif. (KGTV) - A backyard workshop in Vista caught fire Sunday afternoon, according to Vista Fire officials. Neighbors said they saw thick black smoke towering into the sky and heard almost a dozen explosions.Neighbor John Ploetz said it sounded, "like a bomb, people up the street heard it.""It takes a minute you know, your brain goes oh it's probably fine, or he's welding you know and then I see there's flames, and no firemen here, and the fence is on fire, I better call 9-1-1," Ploetz said he grabbed his garden hose and worked to contain the fire. He wet down nearby foliage and put out small spot fires on the outside of the fence.Fire officials said the fire started around 12:32 p.m. and arrived at the home in the 1000 block of Ora Avo Drive in minutes. Ploetz said what he did was something anyone would do and he was concerned the fire would spread to other homes nearby. He was shocked when a pine tree burned up in seconds, "it just whoosh! Went up like a torch, it was loud, that was before the firemen got here."The workshop contained propane tanks, and tools for metal art that the homeowner creates as a hobby. The family was at church when the fire started and were thankful no one was hurt. Among the valuables they lost were three boats and a motor home.Firefighters are still investigating the cause. 1340
