Nintendo has filed a lawsuit against an Arizona man after the video game giant claims he operated two websites "built almost entirely on the brazen and mass-scale infringement of Nintendo's intellectual property rights," according to court documents. The lawsuit, filed July 19 in Arizona U.S. District Court, claims Jacob Mathias and his company, Mathias Designs, L.L.C, operated 'LoveROMs.com' and 'LoveRetro.co' — websites lawyers for Nintendo say "are among the most open and notorious online hubs for pirated video games."The company claims Mathias posted thousands of Nintendo games on the sites that were downloadable as files — known as "ROMs" — and playable on phones or computers through software referred to as emulators. In court documents, the company's lawyers said Mathias uploaded an instructional video to YouTube explaining how to download and run the games.Nintendo estimates its titles were illegally downloaded from the sites by more than 60 million people. The company is seeking 0,000 for each infringement of its copyrighted work and up to ,000,000 for each infringement of the Nintendo trademark. Its lawyers said Mathias profited off the website through ad sales and donations. On Wednesday night, both 'LoveROMs.com' and 'LoveRetro.co' displayed messages they were shut down.Reached by phone, Mathias declined to comment. His attorney, Lance Venable, responded by email that he had "no comment at this time regarding the allegations" but added, "I have been in contact with Nintendo's counsel and we are hopeful that we can resolve the matter amicably." 1590

NEW YORK CITY — A New York City mom allegedly threw her newborn son out of a bathroom window, District Attorney Melinda Katz said Tuesday. Sabina Dookram, 23, was charged with attempted murder, attempted manslaughter, assault and reckless endangerment.“This is a heartbreaking situation," Katz said. "A newborn baby has suffered greatly because of the alleged actions of his mother, who now faces serious charges and a lengthy prison sentence."A neighbor heard crying sounds on Sunday morning, officials said. When she went outside, she found a naked newborn boy on the ground next to the building's garbage. Responding officers found blood on the ground, on the side wall leading up to the bathroom window and on the window sill. The baby was taken to a local hospital in critical condition, Katz said. He was placed on a ventilator. Doctors determined he suffered a traumatic brain injury with bleeding and swelling about the brain and scalp and an abdominal injury with internal bleeding.Dookram gave birth on Saturday afternoon, prosecutors said she told officers."I cut the cord with a scissor from the bathroom," Dookram said according to court documents. "I panicked and threw it out of the bathroom window. I did not check on the baby, I put my clothes in the laundry hamper in the bathroom, I showered and went to sleep.”Dookram faces up to 25 years in prison if convicted. NEVADA — The wait continues to see who will clinch the needed 270 electoral votes to win the presidency. Ballots are still being counted in critical battleground states, including Nevada.Nevada's six electoral college votes could be the deciding factor in this election. So what's taking so long to count the ballots?"It's taking a little longer than normal this year because every active voter received a mail-in ballot this year," explained Nevada Attorney General Aaron Ford."Processing mail takes time because election officials must ensure that no one has more than one vote," he said."And counting ballots has also taken time because we have many safeguards in place to prevent fraud," added Ford, "such as signature verification, unique bar codes and other tools."Ford says officials knew the ballot counting process would take some time this year and adds that our counting procedures are overseen by a bi-partisan board in each county. He also says state officials have zero concerns about the ballots right now and are more focused on being accurate and fair. The Clark County Registrar of Voters Joe Gloria will provide daily updates on behalf of the county at 10 a.m.This story originally reported by Alicia Pattillo on ktnv.com. 1247

NORFOLK, Va. - Heading into Election Day, one poll had Joe Biden up five in Florida. He lost.Another had him up double digits in Wisconsin. He narrowly won the state.Just like in 2016, the polling leading up to the election is facing criticism. "The pollsters got it knowingly wrong. They got it knowingly wrong. We had polls that were so ridiculous, and everyone knew it," President Trump said Thursday night. In Virginia, Christopher Newport University's Wason Center for Public Policy was pretty close to predicting the results. A poll in late October said Biden was up by 12 in Virginia with a margin of error of plus or minus 3.4. Biden is currently up 9.43%."It's pretty clear many polls were off, so I'd say broadly speaking this is a challenge with estimating what the true electorate is going to be for pollsters," said Dr. Rebecca Bromley-Trujillo, Research Director at the Wason Center.Part of the challenge is the uniqueness of President Trump. "We have our likely voter models. We have our expectation about who is going to turn out to vote," Bromley-Trujillo said. "Certainly, President Trump has been a unique candidate who has brought out different types of people at higher numbers than is typical."So, what needs to be fixed? Dr. Eric Claville, the Director of the Center for African American Public Policy at Norfolk State University, says more nuance is needed. He feels pollsters should concentrate on issues to help forecast why people vote a certain way."I think the polls have to ask themselves: What is it that really drives individuals to vote one way or another?" Claville said.Reporters and campaigns could also provide more context, the experts said. "It would be better to present the margin of error. It would be better to say, 'If the electorate shifted this way, this is what it would look like,' so people understand this is what we expected based on past elections," said Bromley- Trujillo.During this current election, it's clear it's a lot closer in key states than many polls had it with ballots still being counted. This story was first reported by Brendan Ponton at WTKR in Norfolk, Virginia. 2138
