EL CAJON, Calif., (KGTV) — The combination of good old fashioned police work and advancements in DNA science helped put an Oregon man behind bars after he killed a La Mesa man in 2006. Today, Hon. Judge Robert Amador announced Zachary Bunney's sentence: 12 years in a California prison for voluntary manslaughter. Before his sentence was announced, Bunney read an apology letter to the family of Scott Martinez. "I just wanted to say I'm sorry for the pain that this has caused the Martinez family. If I could go back in time and change the course of events that led to this, I would. I know that words cannot bring back to life, but I am truly sorry."Bunney referred to the night of June 27, 2006. La Mesa Police said Bunney went into 47-year-old Scott Martinez's apartment and used a sword to stab Martinez 30 times, killing him. For 12 years, Bunney evaded police, and the case went cold. Until this January, investigators linked the killer's DNA left on a bloody tissue paper, to Bunney's distant relative who was registered on a public genealogy database. "The defendant's DNA was uploaded into the system," Deputy District Attorney Brian Erickson said. "A relative of his had uploaded her DNA, and then they do the family tree backwards, and they were able to trace it through that."Detectives discovered that the DNA on the bloody tissue belonged to Oregon resident Zachary Bunney. "I didn't think anything like this would be what cracked the case," Martinez's daughter, Angelina Panek said. By November, Bunney pleaded guilty to voluntary manslaughter. In exchange for dismissing the murder charge, his stipulated agreement was that he would get 12 years in state prison. "The amount of years that he was on the run, and this is the amount of years he is going to be given as a sentence. It was a sign. And I had to take it," Panek said. Panek said she will always wear her father's ashes in her special necklace, knowing that he is watching over her and her family. "I'm just grateful that this day has come. (KGTV) - An El Cajon man says a new spinal procedure changed his life, but the Army veteran is now locked in a battle with his military health insurance plan which refuses to cover it.Ronald Maddern says he can't understand why TRICARE, his secondary insurance, would deny coverage of the procedure after his primary insurance, Medicare, agreed to cover 80 percent of the cost. Both insurance plans are run by the federal government."Makes me feel like a second-rate citizen after I served in the military for so many years," he said.The denial by TRICARE left him with a bill of ,756.Maddern had the Vertiflex procedure in 2017 to treat spinal stenosis, which had largely confined him to a wheelchair for 17 years. Maddern is now able to walk with help from a cane for balance."It was a drastic success," said the 71-year-old. "My quality of life now is very, very good."The procedure, developed by a Carlsbad company, was approved by the FDA in 2015. It has been performed thousands of times across the country, said Maddern's surgeon Dr. Michael Verdolin."It is extremely frustrating that one arm of the government says yes and the other portion, really the pinky, says no," he said.In a letter of denial, TRICARE argued Vertiflex is an "unproven procedure," despite its FDA approval."There have been 15,000 cases across the US. It's been cleared for use," Verdolin said. "There is no question to be asked about its efficacy."TRICARE did not immediately respond to requests for comment by 10News.Ronald Maddern's insurance case is now before an administrative law judge. (KGTV) -- A man in his mid-30s was killed Sunday afternoon after the SUV he was driving struck a tree in El Cajon.El Cajon police say the driver of a 1998 Ford Explorer drifted onto a center divider then slammed into the tree on N Second Street near Greenfield Drive at 1:49 p.m.The man was pronounced dead at the scene. His name was not released pending family notification.Surveillance video from a nearby store shows the impact of the crash and the aftermath. Several good Samaritans ran over to try to help the driver until police arrived.N Second Street between Persimmon Avenue and Greenfield Drive was closed off for approximately four hours as police investigated.Police said it was unknown if drugs or alcohol were factors in the crash. EL CAJON, CA (KGTV) - Students at a private school in El Cajon are scheduled to return to class next month.Parents of children at Foothills Christian Middle School got a letter from the school over the weekend outlining their re-opening plan.According to the letter, the school will re-open September 8th.A local mom contacted 10News concerned about the plan. She didn't give her name because she doesn't want retaliation against her daughter. She was surprised at the September return date."If schools could be open, I would send her to school, if the county said we could do that, I would do that, but they're saying we can't go to school and we should be wearing masks," said the mom.According to the letter, there is a five step plan for reopening:*Regular COVID-19 self-check screening questions*Temperature readings prior to entering campus*Hand hygiene*Environmental Cleaning/Sanitization and Refillable Water Bottle Stations*Face masks/coveringsThe letter states that face coverings will not be required, but will be optional on campus. It goes on to list several reasons, including:*There is a lack of evidence that wearing a face mask prevents COVID-19 transmission in children*Children are not typically trained in their use and there is potential for increased risk of infection with improper mask use*Masks can be irritating and may lead to increased touching of face and eyes*It is impractical for a child to wear a mask properly for the duration of the school dayThe mom who contacted us says this will send mixed messages to her child."What we're telling her at home is completely different than, this is completely opposite of everything we're doing.
