With its lush subtropical vegetation, unique Mediterranean climate, and fine sparkling sand, beach-goers flock to this beach for great ship-watching and the summer’s warm and mild surf," Leatherman writes on his website.Kapalua Bay Beach in Maui, Hawaii, topped the doctor's list of beaches followed by Ocracoke Lifeguarded Beach in North Carolina, Grayton Beach State Park in Florida, and Coopers Beach in New York.Beaches were measured on water and sand quality, tide and wave breaks, weather, and safety and management. Since 1991, the professor has been grading the country's best beach destinations. SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said.  3412

SAN DIEGO (KGTV) - Explosions rang out Thursday and Friday at an ocean view La Jolla home where FBI agents served a search warrant. Agents were checking the house at 625 Wrelton Drive in an ongoing investigation when they came across “certain materials,” said FBI Special Agent Davene Butler. The County of San Diego Hazardous Incident Response Team (HIRT) and San Diego Fire-Rescue were contacted for help to detonate and dispose of unstable chemicals. The material could not be safely moved from the neighborhood, Butler said. On Thursday, people who live near the home were evacuated for their safety, according to the FBI. On Friday, they were told to shelter in place. The bomb squad detonated Perchloric Acid in the backyard around 1 p.m."The reason we're blowing them up is, if they are handled improperly, they can blow up on their own," said Robert Wise, of the Environmental Protection Agency. Wise said the home had corrosives, flammables, and oxidizers.RELATED: Gunfire reported during party at La Jolla mansion"Pretty much the whole ABC list of chemicals," he said. Federal search warrants show a man named Alex Jvirblis owned the home. Jvirblis passed away in August. He owned a materlal science company called Curtis Technology, giving him access to the chemicals. Jvirblis had no immediate hours, but the federal search warrant reveals a nephew who may inherit the home discovered the chemicals and called police. The home sits on a knoll above Tourmaline Surf Park overlooking the Pacific Ocean. 1702

  

SAN DIEGO (KGTV) — Distance learning is now possible for more than 7,000 San Diego County families who had little or no internet access before the pandemic. The County Office of Education has been working for months to get those students online and have plans to help even more.Before COVID-19 hit, the county estimates one in five families had no internet or were considered “under-connected” by not having a connection strong enough to support distance learning.Isabel Estrada was one of those students.“Sometimes it would cut out during class time and I would miss something or have to email my teachers of why it kept cutting out,” said the freshman at Oceanside High School.The County Office of Education has been working for months to bridge the digital gap. So far, they’ve provided more than 7,000 mobile hotspots to families in need.Once Isabel’s family got a hot spot she says she felt more confident signing on to class.“We’re just really grateful because the internet right now, it’s me and my sister so it helps both of us with school,” said Isabel.At a press conference Thursday, Supervisor Nathan Fletcher announced million from the general fund will be used to help connect another 4,000 families.“That digital divide went from something that we needed to address, to something we had to address when our promise of public education moved virtually,” said Fletcher.The million will be divided among 19 districts identified as having the greatest need. They include the Escondido Union High School District, San Ysidro School District, and the South Bay Union School District.The county estimates another 45,000 students still have no internet access or are under-connected.For more information about the county programs, click here. 1762

  

SAN DIEGO (KGTV) — Francis Parker School officials say a vendor that handles some of the school's backup data was victim of a ransomware attack in May. The school says third-party cloud computing provider, Blackbaud, Inc., notified them on July 16 of the cyberattack. Criminals demanded payment in return for destroying information they copied from Blackbaud's database, the school said.School officials warned parents that the compromised database may have included contact information, birth dates, and a history of relationships with the school, including donation dates and amounts. The school said the attackers did not access credit card information, social security, or other personal financial information and had no access to the school's systems.Blackbaud paid the ransomware and says based on the nature of the incident and investigations with law enforcement, there's no reason to believe any data went beyond the cybercriminals or was, or will be, misused.Francis Parker officials said they are reevaluating their relationship with Blackbaud.
