SAN DIEGO (CNS) - San Diego City Councilman Chris Cate urged prosecutors Friday to take a zero-tolerance stance on predatory scams involving fraudulent checks, particularly amid the COVID-19 pandemic when people may be especially susceptible to fraud.In a letter sent Friday to California Attorney General Xavier Becerra, the councilman suggested removing the possibility of prosecuting Penal Code 476 -- which makes creating or passing a fake check a crime -- as a misdemeanor, increasing the fine amount and maximum jail sentence for those found guilty, and assigning additional Department of Justice resources to investigate check fraud complaints.The councilman wrote that scams in the form of fake check deposits "are becoming widespread in Southern California and are causing our most vulnerable to lost thousands of dollars they cannot afford."Cate said one such fraudulent check was recently received by one of his staff members, which appeared authentic and bore the name of a "legitimate financial institution."He said he worried that with high unemployment rates amid the pandemic, people would be more likely to fall prey to scams of this sort."Taken as a whole, these measures will send a clear message to those who would attempt to prey on the most vulnerable and susceptible in our society that California stands with consumers and will not tolerate this fraudulent conduct," Cate wrote.A copy of Cate's letter, which features examples of a fraudulent check and typical accompanying letter from a supposedly legitimate company, can be viewed at https://www.sandiego.gov/sites/default/files/predatory_check_scam_enforcement.pdf. 1650
SAN DIEGO (CNS) - San Diego city leaders said Tuesday that more than 1,100 people will secure permanent or longer-term housing by the end of the year through Operation Shelter to Home -- the city's COVID-19 homeless shelter at the San Diego Convention Center.The shelter opened its doors in April as a measure to halt the spread of COVID-19 among San Diego's homeless population, and currently houses around 900 people per day, and housed a peak of 1,300 people daily, according to San Diego Mayor Kevin Faulconer.Faulconer called the project "a public health success story" at a Tuesday morning news conference, saying only 27 residents and staff tested positive for COVID-19 out of more than 9,300 tests administered since the shelter opened.Officials said that to date, more than 840 individuals and 45 families sheltered at the convention center have obtained housing, while around 400 others will soon be moved into housing units the city secured through the purchase of two hotels in Mission Valley and Kearny Mesa. That purchase will convert the hotels into 332 furnished apartment units and residents will receive on-site supportive services, officials said.In addition to those moved into housing, others will be matched to housing resources like vouchers or other rental subsidies, the city said."This pandemic brought our region together like never before to work toward our shared goals of protecting our most vulnerable residents and removing barriers to housing -- and now over 1,100 people will have a permanent place of their own to call home," Faulconer said.San Diego Mayor-elect Todd Gloria said the collaborative efforts to bring Operation Shelter to Home together was "a bright spot" amid the pandemic."This is a testament to what we can do if we choose to do it," said Gloria, who said efforts like Operation Shelter to Home must be continued even after the pandemic ends."It shouldn't take a pandemic to care about our unsheltered population," he said. 1983

SAN DIEGO (CNS) - San Diego-based medical equipment manufacturer ResMed Corp. has agreed to pay more than .5 million to resolve allegations that it paid kickbacks to suppliers, sleeps labs and other health care providers in exchange for referrals and prescriptions for its products, the Department of Justice announced Wednesday.The government accused ResMed of violating the Anti-Kickback Statute of the False Claims Act by providing free or below-cost medical equipment to companies in several states. Court documents state that ResMed's products -- which treat sleep apnea and other sleep disorders -- were provided to companies that in some cases began writing prescriptions to their patients entirely for ResMed equipment.Prosecutors say some examples of ResMed kickbacks included free home sleep testing devices, free or below-cost positive airway pressure masks and diagnostic machines, and free telephone call center and patient outreach services that allowed the companies to order resupplies for sleep apnea patients.RELATED: San Diego suing SDG&E for allegedly delaying pure water projectThe settlement agreement resolves five lawsuits filed by whistleblowers, who will collectively receive around .2 million out of the total settlement."Paying any type of illegal remuneration to induce patient referrals undermines the integrity of our nation's health care system," said Assistant Attorney General Jody Hunt. Scott Peters, D-San Diego, Friday called on the federal government to determine and commit to an interim and long-term plan for nuclear waste storage.Peters challenged the rest of the federal government to find a storage solution during a meeting of the House of Representatives Energy and Commerce Committee's Environment and Climate Change Subcommittee.The subcommittee, on which Peters sits, held a hearing on three bills that would establish a process to send spent nuclear fuel rods from decommissioned plants to designated storage areas around the country. To do so, Peters said the government should invoke the Constitution's supremacy clause, which requires states to follow federal law if they have conflicting statutes.``There's not a lot of enthusiasm among the states to accept any defined or undefined amount of nuclear waste. There just isn't,'' Peters said.``To me ... the magic of federalism is the supremacy clause and the ability of the federal government to ... (say) in this geology, per this engineering, (and) through this licensing process that this risk is lower.''Two of the bills the subcommittee considered -- the Spent Fuel Prioritization Act and the Storage and Transportation of Residual and Excess Nuclear Fuel Act -- would directly affect San Diego County by relocating spent nuclear fuel from the defunct San Onofre Nuclear Generating Station to designated storage sites like Yucca Mountain in the Nevada desert.The plant shut down in 2012, but nearly four million pounds of spent fuel cells remain buried under the plant in a temporary storage facility about 100 feet from the Pacific Ocean. The plant sits approximately 60 miles or less from both San Diego and Los Angeles and the storage facility continues to be susceptible to a major earthquake or significant sea level rise.The bills remain in limbo due to pushback from legislators who represent the districts in which spent fuel rods would be stored.However, Peters' office hopes the bills could get a vote out of the committee by the end of the year. 2073
SAN DIEGO (CNS) - The San Diego City Council declined to report details of its closed-door discussion Tuesday on a draft appraisal of price and payment terms for the city's potential sale of the SDCCU Stadium site to San Diego State University.The council met in closed session to discuss the undisclosed terms of the appraisal with its negotiating team, composed of officials in various city departments and the city attorney's office. Both the city and SDSU have expressed an intent to exchange the property for "fair market value," but what that entails remains opaque.D.F. Davis Real Estate estimated the fair market value of the site sits at .2 million, according to documents.The city is currently in the process of selling a 132-acre parcel of land to SDSU as the university intends to redevelop the parcel, which includes SDCCU Stadium, into a 35,000-seat stadium to be primarily used by the university's football team, a satellite campus, a park along the San Diego River and commercial and residential space.After the closed session, City Councilwoman Barbara Bry called for the draft appraisal to be released to the public and for all future discussions of the sale to take place in an open session."It is now time for SDSU to make an offer which honors the terms of Measure G and the promises that were made during the campaign," Bry said in a statement. "This offer should include a commitment to building the river park and designing a transit-dependent development."City officials have also noted their concern over certain elements of the project's draft environmental impact report, such as the university's analysis of how the project will affect traffic patterns in Mission Valley. The council must approve a final version of the report prior to completing the sale.On Monday, the Friends of SDSU, a group of university alumni and community members, called on the city to accept the appraisal without changes, arguing that the project would be transformative for the city and SDSU will be a good steward in overseeing the land."Introduction of extraneous considerations that are inconsistent with the provisions of voter-approved Measure G or are outside the mutually agreed-to guidelines for the appraisal could substantially delay or threaten altogether the successful transfer of this property," Friends of SDSU wrote in a letter to Mayor Kevin Faulconer and the council.San Diego voters approved the plan, then known as SDSU West and now dubbed SDSU Mission Valley, last November. Since then, the university has selected two firms to oversee the planning and construction of the future stadium and campus while negotiating the sale with the city.On the project's current timeline, university officials expect the California State University Board of Trustees to consider approving a draft environmental impact report on the SDSU West plan early next year. The university expects to break ground on the project in early 2020 and complete the redevelopment in its entirety by the mid-2030s. 3022
