SAN DIEGO (KGTV) -- A woman was killed and two men were injured following a shooting at a Church's Chicken in Otay Mesa West Wednesday night. According to San Diego Police, the shooting of the three employees was reported at the restaurant in the 3700 block of Del Sol Boulevard just after 5:30 p.m. Police say a man in his 30s walked into the restaurant early in the evening. "The suspect got into a verbal argument with employees and left the restaurant. Surveillance video from a business across the street shows the suspect parking and re-parking his car several times between 4:40 p.m. and 5:22 p.m. At 4:53 p.m., video shows the suspect walking into the establishment before going back to his car at 5:08 p.m. The man re-parked his car at 5:22 p.m. before walking into the restaurant a final time at 5:27, when the shooting took place. At 5: 30 p.m., video shows the suspect walking to his car before driving away with his lights off. Minutes later, at 5:34 p.m., a San Diego Police vehicle arrived at the Church's Chicken. SAN DIEGO (KGTV) - A transgender San Diegan is calling for change when it comes to blood donation.Currently, the FDA’s recommendation to blood establishments is that in the context of the donor history questionnaire, male or female gender should be self-identified and self-reported for blood donation.Van Levy of Pacific Beach is non-binary transgender, meaning Van does not identify as male or female. Van goes by gender-neutral pronouns like 'they', 'them', 'their', or just Van.Van tells 10News when they reached out to the San Diego Blood Bank, they were told they would not be able to donate if they could not fully complete the donor history questionnaire, which has two gender-specific questions. Van was told if they cannot fill out 'male' or 'female' on the questionnaire they would not be able to donate blood. “It was really hurtful and painful, it reminded me we haven’t progressed as much as a lot of us like to believe we have, it just hurt," said Van. The two gender-specific questions are, in the past 12 months, have you:Male Donors: Had sexual contact with another male?Female donors: Had sexual contact with a male who had sexual contact with another male in the past 12 months?Helen Bixenman is Vice President of Quality and Regulatory Affairs at the San Diego Blood Bank. They include medications, how you’re feeling, travel, risk behaviors," said Bixenman.She says they must adhere to the strict regulations and requirements of the FDA and AABB. She says if anyone fails to fill out the entire donor history questionnaire they will be turned away from donating blood.Van wants to see this regulation changed and believes it marginalizes a group of people who only want to help their community. “I definitely understand the rules and regulations that they have to adhere too and I think that there's ways to remove gender from the questions to get to same answers they’re seeking to protect people receiving blood," said Van. Bixenman says the San Diego Blood Bank does not want to turn people away from blood donation. He was released from the hospital just hours before police found his body in Hillcrest. There was something about a man at the hospital that stood out to Megen Murray. "For whatever reason, I don't know why he caught my eye," said Murray. "I just watched the orderly wheel him outside."He was discharged from Scripps Mercy Hospital Wednesday night. He was still wearing a hospital gown when he was found."It was just unnatural to see a man in a hospital gown, in a wheelchair, sitting on the street."Murray says she tried to get the hospital to help, but she says they wouldn't listen. "Yep, he's homeless, he has nowhere to go, we dismissed him, if he wants he can come back in and be seen again but that was it," said Murray.She then took it upon herself to make him comfortable. "I said, 'I have these blankets for you,' and he looked at me and gave me the biggest smile. And then I said, 'I only have  cash on me, so here's .' I told him to put it in his pocket and said 'I'm sorry I cant do more."'The hospital told 10News the man was healthy enough to be released and aware of his surroundings. Seven hours later he was found dead after tumbling from the Washington Street bridge. And it's not the first time a patient was discharged in hospital clothes. A video from Baltimore went viral in January that showed a woman, wobbling and confused, still wearing a gown and surgical mask. Homeless patients are often discharged after being treated with nowhere to go. She said people saw the post and took screenshots of it.She’s now suing the man she says posted the photo, her ex-boyfriend William Ashley Oliver III."This pretty much consumed my life,” she told Team 10 investigator Adam Racusin.That’s L.S describing how one social media post of her naked body wrecked her sense of security. 10News is not naming the woman, but instead using the initials L.S. as they appear in her lawsuit against Oliver to protect her identity.“He was threatening for so long to do it that I didn't think he'd really do it,” she said.Their relationship started as most do: Girl meets boy, they fall in love and move in together. "I felt like I really got to know him fast and fell in love fast,” she said.Just like many relationships, everything was great until it wasn't. Unlike the typical breakup story, here's where this takes a different path.L.S. said she moved back to California in October of last year, about eight months after the relationship started.Oliver came to visit in late November, but things did not go well, she said.She said her ex-boyfriend became aggressive."He smashed my laptop in two, he smashed my brand new iPhone on the ground until it was shattered, and was calling me really horrible things,” she said.According to the lawsuit she filed, before leaving, Oliver took L.S’s passport and jewelry from the bathroom sink.A few days after that incident, while Oliver was still in San Diego, he began sending harassing text messages and copies of private photographs to L.S. to make it clear that at some point in their relationship he illegally accessed her computers and cell phones and stole sexually explicit and private digital photographs without her consent, the lawsuit stated."The pictures that he had were never sent to him they were taken before I ever met him," she said.According to the lawsuit, Oliver texted her: “Posted all your naked pics to the industry whore boards.” It said he also wrote among other things: “Your pics are getting blasted on services Moxy.”The lawsuit says L.S.’s pleas for Oliver to stop had no effect on him. The lawsuit claims Oliver then posted a sexually explicit photo of her on his public Instagram account, accessible by anyone, followed with the text: “(y)our naked pics are starting to proliferate.""My best friend sent me a text message, and she just said oh my god, and it was a screenshot of the picture that Will had posted on Instagram of me,” she said.Team 10 investigator Adam Racusin asked her what she thought when she saw that.“I was just so scared,” she said. “I was just devastated.”According to the lawsuit, Oliver admitted he posted the picture. The lawsuit stated L.S. was informed by a friend and multiple colleagues that they saw the photograph on Oliver’s Instagram site and knew it was her."I don’t know how many people have that; it's everywhere,” she said.Team 10 tried to get a hold of Oliver, but he hung up after answering once and didn’t respond to our request for comment.L.S is suing Oliver for revenge porn among other things. SAN DIEGO (KGTV) — A water culvert in Logan Heights overflowed Thursday night due to heavy rain, leaving neighbors with a mess Friday, many homes destroyed from all the water.Ruben Cortez’s home got filled with about a foot of water. Initially the water just piled up outside his sliding glass door, “the water was up to here so it looked like I was inside an aquarium”. After 20 minutes water came through the front and back doors, soon filling the entire house.Cortez and his wife are remodeling their home. One week ago they installed new flooring in their bedroom. After the flooding, the floor is completely ruined.The rest of the house has tile flooring and dirt and mud everywhere.His neighbors are also dealing with similar issues. Many parked their cars on the street and during the flooding the water filled up to the steering wheel.Most people in the neighborhood, along with Cortez himself, don’t have flooding insurance. He tells 10News, “its like getting snow insurance you don’t think anything like that is going to happen and this flood wasn’t really a typical flood, it was part of the drain that came out and flooded. You don’t think of those things”. Cortez wasn’t only worried about his own home, he’s also the pastor at the church next door. While the church was okay, the children’s classroom had water damage. The water also filled between a foot to two feet in the rooms.Left with a laundry list of things to fix, remodel and clean, Cortez tells 10News, “just count your blessings and the bad things as they come in, just face them one at a time." 1581
