(CNS) - The Vista Unified School District fully reopened its schools Tuesday morning, becoming one of the first in the region to do so, even as San Diego County appears poised to slip back toward more restrictive COVID-19 tiers as infections surge.The district, which has 29 elementary, middle and high schools, eschewed the more cautious measures some other school districts are taking, moving into its "Phase 3" reopening plan. The plan, "Vista Classic" allows every school in the district to reopen at full capacity. Parents and guardians will still be able to keep students in "Vista Virtual," the district's distance-learning program, if they so choose.The district said it will attempt to have social distancing as much as possible but will allow as many as 38 students in a single classroom, so desks will not be spaced six feet apart.ABC 10News was at Vista High School as, for the first time in more than seven months, students with backpacks were seen walking to school.Some students told ABC 10News they with had mixed reactions to coming back.One Vista High student said, “I’ve been wanting to come back because I miss going out and interacting with people.”Another student added, “I don’t want to catch the virus and spread it to my family.”A rally last Thursday by teachers and parents at Foothill Oaks Elementary School attempted to dissuade the Vista Unified School Board from reopening Tuesday, with many educators believing the safety measures inadequate.According to KPBS, plexiglass barriers were not provided to teachers. Instead, they were given PVC pipes and plastic liner to create makeshift protection from students returning to in-person learning.Keri Avila, president of the Vista Teachers Association, said on the first day back they’re already seeing issues that need to be addressed to ensure that everyone stays safe.“The problem is it’s not equitable throughout the district. What other classrooms have others don’t have. And we just want the safety for all of our members and students,” Avila said.The reopening of the Vista district comes as the county is expecting to receive bad news about its reopening status with the California Department of Public Health. Rising case numbers could tip the region into the "purple" tier, the state's most restrictive, as soon as next week. The state's plan requires a county to post statistics in a lower tier for two consecutive weeks before it is moved down.Avila told ABC 10News that if the county moves into the purple tier, there are plans for a special board meeting where they will discuss the situation. 2606

WASHINGTON — The Justice Department is suing Walmart, alleging the company unlawfully dispensed controlled substances through its pharmacies, helping to fuel the opioid crisis in America. That's according to a person familiar with the matter who spoke to The Associated Press on Tuesday. The person says the civil complaint points to the role Walmart’s pharmacies may have played in the crisis by filling opioid prescriptions and by unlawfully distributing controlled substances to the pharmacies during the height of the opioid crisis. The lawsuit claims Walmart wanted to boost profits and pressured employees to fill prescriptions quickly, according to the Wall Street Journal. “Walmart knew that its distribution centers were using an inadequate system for detecting and reporting suspicious orders,” said Jason Dunn, the U.S. attorney in Colorado. “As a result of this inadequate system, for years Walmart reported virtually no suspicious orders at all. In other words, Walmart’s pharmacies ordered opioids in a way that went essentially unmonitored and unregulated.”Walmart operates more than 5,000 pharmacies in its stores around the country. The Justice Department’s action comes nearly two months after Walmart filed its own preemptive suit against the federal government. Walmart's lawsuit at the time claimed the Justice Department and Drug Enforcement Administration were trying to scapegoat the store for what Walmart says are the federal government's own regulation shortcomings, according to the Wall Street Journal. Walmart and Target are being sued for allegedly selling toys with lead levels up to 10 times more than the federal limit of 100 parts per million, New York Attorney General Barbara D. Underwood announced on Thursday. According to a statement released by Underwood's office, the AG's office was able to find Cra-Z-Jewelz jewelry-making kits from stores. The kits allegedly contained lead at levels of 120 to 980 parts per million. The Attorney General's office had further independent testing done to confirm the results. The toy's maker, LaRose Industries, which is also a plaintiff in the New York lawsuit, issued a national recall. Underwood's office is accusing Walmart, Target and LaRose of "repeated illegality and fraud under New York State law by committing thousands of violations of state law prohibitions on importing, distributing, and selling hazardous toys; deceiving consumers; and false advertising."Underwood's office is seeking civil penalties of  to ,000 for each Cra-Z-Jewelz kit the companies sought to sell in the state.“No parent should have to worry that their child’s toy may be toxic. As we allege, these companies imported and sold toys with dangerous levels of toxic lead – jeopardizing the health of New York’s children and breaking the law,” Underwood said in a statement. “Our lawsuit seeks to hold these companies accountable for the failures that allowed lead-contaminated toys on store shelves, while forcing them to take responsibility for the safety of the products they sell.”The suit also seeks to force the companies to adhere to higher quality control standards to prevent toys with high lead levels from being purchased. The CDC says that lead in children's blood has been shown to affect IQ, ability to pay attention, and academic achievement. Trump's visit to Kenosha comes days after the president stopped in Louisiana following the landfall of Hurricane Laura. But do presidential visits during a crisis help or hurt the community? "If I was doing his security, I would advise against it," Grant Whitus, a retired SWAT team leader in Colorado said. Whitus has protected presidents in the past and is a Trump supporter. Whitus says when a president comes to town, hundreds of officers need to be reassigned. "Their resources are already stretched to the max trying to deal with this," Whitus added. Many Wisconsin leaders feel the same way. Gov. Tony Evers (D) of Wisconsin wrote to the president unsuccessfully asking him to cancel his trip. Visits to areas in crisis have been a signature of Trump's since taking office. During his 2016 campaign, Trump visited Louisiana and their flood devastation a full four days before siting President Barack Obama made the trip. When asked if Trump was visiting Kenosha for political reasons, White House Press Secretary Kayleigh McEnany said no. "The president is showing up to see hurting Americans," McEnany said.
