SAN DIEGO (KGTV) — A San Diego veteran is suing 3M Company alleging earplugs he wore while in the military were defective. He’s the latest in a series of lawsuits that have been filed against the company by service members across the country.Kevin Alicie filed a lawsuit on Wednesday claiming he “used Defendant’s dangerously defective Dual-ended Combat Arms? earplugs during tank firing, training firing, other live fire training, vehicle maintenance, and during other training and combat exercises.” According to the lawsuit Alicie wore the earplugs while at Camp Pendleton and was first diagnosed with hearing loss in California. Alicie tells 10News during his military carrier he started having problems with his hearing. He’d hear ringing. He says he didn’t think much about it until the ringing started to become more frequent.“I mentioned it to the doctor when I was doing my final physical, and sure enough when they did that last hearing test they found that there was hearing loss,” Alicie said.The lawsuit says 3M did not inform the military or Alicie that the earplugs were defective and failed to adequately warn that the earplugs did not meet the military’s sound requirements."The biggest defect is they don't do what they are advertised to do,” said Alicie’s attorney John Gomez. “Essentially they are supposed to protect your ears and your hearing in proximity to loud sounds that can cause hearing loss or damage.”Attorney John Gomez says the earplugs were standard issue in certain branches of the military between 2003 and 2015.“Without question, I think tons of users-consumers and potential victims reside right here in San Diego County,” Gomez said.According to a July 2018 press release from the United States Department of Justice, 3M agreed to pay .1 million to resolve allegations that it supplied the United States with defective dual-ended combat arms earplugs.The release says, “the United States alleged that 3M, and its predecessor, Aearo Technologies, Inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. SAN DIEGO (KGTV) - After weeks of large crowds, no masks or social distancing in Ocean Beach, the City of San Diego put together a compliance team to educate people about the county’s public health order.A team of about 12 people consisting of code compliance, parking enforcement, and park rangers handed out face masks to those who didn’t have them on and asked for compliance.“There was unacceptable levels of people coming together, congregating together getting really, really close without masks or social distancing,” said Joel Day, the senior advisor for COVID Response and Recovery with the City of San Diego. “We’re asking people don’t congregate here, please wear a mask if you’re around other people, and please socially distance and so far it’s looking pretty great.”Within one hour, Day said the team handed out about 300 masks.Earlier in the day, residents noted that Veterans Plaza in Ocean Beach appeared to be less crowded. But as the sun went down, the drum circle returned, and so did the crowds. They cleared out by about 10:30 PM.Resident Tim Johnson said home and business owners have had to deal with the same scene repeatedly. SAN DIEGO (KGTV) -- A training issue led to more than a dozen voters throughout San Diego County receiving the wrong ballot. According to Registrar of Voters Michael Vu, the issue affected fewer than 30 voters at satellite locations throughout the county. Luckily, the Registrar of Voters was able to quickly catch and correct the issue. SAN DIEGO (KGTV) - A staph infection led to the amputation of a 3-year-old boy's legs weeks after his family arrived in San Diego for a vacation.The Baumkirschners and some friends arrived in their RVs from Arizona in early October and immediately set up camp along Mission Bay.3-year-old Beauden and his two older sisters were part of a group that went for a ride on their bikes."He fell off his bike and scratched his knee. We put on antibacterial spray with a band-aid, and off we went," said his father Brian Baumkirschner.Baumkirschner says Beauden spent the next few hours riding bikes, running around, and at one point, playing in the dirt. Early in the evening, Beauden told him he wasn't feeling well."He said, 'My tummy hurts. Is it bedtime?'" said Baumkirschner.The next morning, Beauden woke up with a fever and eventually started favoring his right leg, where he had a scrape just under his knee. When he became lethargic the next day, his parents rushed him to urgent care, and then Rady Children's Hospital. Brian says his son's right knee was swelling up and turned purple."It started spreading up, his legs, down his leg, in his arms, and down to this hands," said Baumkirschner.Baumkirschner says doctors eventually diagnosed Beauden with a MSSA staph infection. Another type of staph infection, MRSA, is more associated with bacteria in the bloodstream."They kept telling us that there was swelling. All of his extremities are shutting down," said Baumkirschner.Beauden had developed a complication: toxic shock syndrome. His little body started to shut down. Beauden developed sepsis. His kidneys started to fail."It's been every parent’s worst nightmare. You can’t do anything. You’re helpless," said Baumkirschner.There were several leg surgeries to relieve the pressure. Baumkirschner says there were some harrowing days, but his son pulled through. On Monday, doctors had to amputate his legs below the knee.Baumkirschner says he's just grateful is son is alive. He's optimistic Beauden's arms and hands can be saved.Baumkirschner says doctors at Rady Children's Hospital told him similar serious staph infections are rare, and they only a see a few cases every year.Doctors also couldn't pinpoint exactly when or where Beauden contracted the staph bacteria.A Gofundme campaign has been set up to help with the family with expenses. 2365

SAN DIEGO (KGTV) — After more than two decades, legal street racing at Mission Valley's stadium site are coming to an end.Due to financial reasons, organizers have been forced the end the event after 21 years. Friday, thousands rolled into the stadium parking lot to see off Racelegal."What this shows me is the car culture has always been great in Southern California, this is showing the support and so much that the people want this to be here," said Peter Scalzo, the drag strip's owner.In an open letter on the organization's website, Executive Director Lydia DeNecochea said in part that she hopes San Diego will continue to fight preventable deaths due to illegal street racing."The 21 years of success is due to the support of San Diego’s infrastructure and the community of San Diego standing together to stop the predictable and preventable tragic loss of young lives due to an illegal street racing crash," DeNecochea said.
