SAN DIEGO (KGTV) - A jury deadlocked Friday on two key charges regarding a drunk driving crash that killed a Lyft driver on SR-94.Steven Quintero was charged with six counts including murder and gross vehicular manslaughter in the Oct. 1 death of 41-year-old Henry Reyes of Escondido.The jury reached verdicts on four counts, finding Quintero guilty of DUI causing injury, DUI, hit and run with death, and driving on a suspended license. The judge declared a mistrial on the murder and gross vehicular manslaughter charges.RELATED: Testimony in Lyft?driver's death continuesReyes was taking three women home from a night downtown when the crash happened. One of the women became ill and Reyes pulled over on the shoulder of SR-94 near 28th St. to give her some water.Minutes later, the Lyft car was hit from behind by Quintero’s car. Reyes, an aspiring dentist and the father of a 2-year-old child, was killed as he walked around the car to get back in."I was hit so hard I didn't know where I was," said passenger Kelly Hoffman, who was on the phone in the backseat when the collision occurred. Hoffman testified that she had a broken bone of the top of her foot, whiplash of the neck, and a concussion.Passenger Sarah Smith, who had cuts to her chin, a neck injury and a bruised spine, said she has no memory of the crash.At Quintero's arraignment, Deputy District Attorney Cally Bright said the murder count was warranted because a previous charge of driving under the influence was filed against the defendant in November 2015, and because he allegedly left the scene of the fatal crash. 1604

SAN DIEGO (KGTV) -- A man was arrested Tuesday night following a chase that injured one woman.According to San Diego Police, officers noticed that the man’s headlights were out and tried to pull him over near Nimitz Boulevard and Rosecrans Street around 8:22 p.m.The man then reportedly took off, striking two cars along the way. The pursuit then led officers onto Interstate 5 where the suspect struck the back of an SUV, injuring a woman inside.Officers were able to take the man into custody after he tried to cross I-5 and run down a steep embankment.The severity of the woman’s injuries are unclear. 612

SAN DIEGO (KGTV) -- A Navy SEAL was sentenced Tuesday after pleading guilty to molesting his relative in California.Gregory Kyle Seerden pled guilty to seven counts of molestation following a preliminary hearing in which the victim testified. According to the court, the abuse happened while Seerden was a Navy SEAL stationed in San Diego. "We can start healing today by making him answer for his crimes every day for the rest of his pathetic existence," Alicia Reppert said, reading a prepared testimony.Reppert is Seerden's ex-wife. She said on the stand, that her daughter endured abuse from her father, starting from when she was five years old. The Deputy District Attorney said the girl mustered up the courage to report her father's crimes in 2015. At the pretrial hearing in May, the now 12-year-old testified in front of a judge. The testimony was so powerful, Seerden pleaded guilty to seven of the nine counts of molestation, without going to trial. He was sentenced to 60 years in prison. Seerden is already serving a 27-year federal sentence for manufacturing child pornography. In 2017, Seerden was accused of of raping a woman while serving in the Navy in Virginia. When authorities searched his cell phone, they found child pornography, including a video of him abusing another 5 year-old relative, while she slept. "In California, you can use that evidence to corroborate molestation in this case," Deputy DA Amy Colby said. Seerden was arrested on April 3, 2017, for the case involving child pornography. SAN DIEGO (KGTV) — A San Diego judge said Thursday that his recent ruling protecting two strip clubs from California's stay-at-home order extends to all county restaurants.San Diego Superior Court Judge Joel R. Wohlfeil said Wednesday that strip clubs and "San Diego County businesses with restaurant service” cannot get a cease-and-desist order. Thursday, he reiterated his ruling, saying that it applies to all restaurants in the county, not just the strip clubs in question. "The court’s intention is that all businesses which provide restaurant service — meaning all restaurants in the County of San Diego — are encompassed in the scope of the court’s order. No one wants our small businesses to be closed, but the science and data are showing a dire trend in hospitalizations and deaths. Over 1,200 have died in San Diego County and the ICU capacity in Southern California has dropped to zero," a statement from Gloria said. "We have a collective obligation to accept the personal responsibility of keeping each other safe. I am asking San Diegans to continue to stay home as much as possible, wear a mask, avoid large gatherings, and order to-go to support small businesses. The health of our local economy hinges on the health of San Diegans."Wednesday's ruling prompted many local restaurants to open their doors again after they were shuttered by the state's stay-at-home orders requiring restaurants to offer takeout and delivery only. Though it wasn't immediately clear if that meant restaurants could reopen for full service or limited service, such as outdoor dining only.County officials said Wednesday that until more clarity surrounding the ruling was provided, they have suspended enforcement against restaurants and live entertainment establishments. California's regional stay-at-home order went into effect after the Southern California region, which includes San Diego County, saw its ICU capacity dipped under 15%. Thursday, the region's capacity hit 0% as the state added more than 52,200 new coronavirus cases.Wednesday’s ruling was in response to a case brought against the county and state by Midway Ventures and F-12, the owners of Pacers Showgirls and Cheetahs Gentleman's Club, in October, after COVID-19 restrictions that forced them to close. A preliminary injunction was granted to the strip clubs on Nov. 6 protecting them from any enforcement, though the businesses were still required to comply with rules surrounding a 10 p.m. curfew and close early. 3733
