SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. SAN DIEGO (KGTV) - A chlorine spill that prompted evacuations in University City was contained Monday evening. 30 gallons of chlorine spilled in the pump room of the Lawrence Family Jewish Community Center's Friedenburg Pool about 3:30 p.m. on Executive Drive at Regents Road, according to the San Diego Fire-Rescue Department. Just after 4 p.m., the department said about 40 children were sheltered in place while crews developed a plan to mitigate the situation. The location is near corporate offices and housing, including UC San Diego's Mesa Residential Apartments.No injuries were reported.Chlorine spill contained to 30 gallons at the JCC pool. No injuries. About 400 kids evacuated already. SAN DIEGO (KGTV) -- A 23-year-old man was arrested in connection with a death at a Rancho Pe?asquitos home stemming from a reported fight at the residence.San Diego police said officers were called to a home in the 12500 block of Darkwood Rd. in Rancho Penasquitos just before 4:15 p.m. Wednesday in response to a reported fight at the house.According to police, a man called 911 to report his 23-year-old son, Wyatt Austin Lane, had been in a fight with a guest at their home earlier in the day.Regarding the fight, the father reported that his son told him “the guest had lost and never regained consciousness,” according to police.Officers arrived to find a deceased male inside a bedroom with “apparent trauma to his body,” police said. The victim was not immediately identified.Lane was arrested and booked into County Jail on suspicion of murder.SDPD Homicide Unit detectives are investigating the incident. 921

SAN DIEGO (CNS)  - A 39-year-old woman suffered some head injuries Saturday morning during a home invasion at a residence in the Nestor community of San Diego, where one of two suspects fired a shot into the structure, shattering the glass of a rear patio door.No property was taken, said Officer Steve Bourasa of the San Diego Police Department.The woman was with her 45-year-old husband at their home in the 1500 block of Oro Vista Road when someone knocked on their front door a little before 1:30 a.m. and asked for a woman, Bourasa said.``The woman told the male no one by that name lived there," he said. ``The male left the front door and went to the rear of the residence, where he was joined by another male. The two males jumped the patio fence and began banging on the rear glass patio door."One of the suspects fired a shot into the patio door, shattering the glass and one of the two suspects entered the home, he said.He confronted the woman, demanded money and punched her several times when she said she did not have any money, he said.``Meanwhile, the husband had exited the front door and went around to the rear of the residence, where he saw the other male standing on the grass," Bourasa said. ``That male pointed a handgun at the husband and then fled."The man heard his wife screaming, ran back inside his home and saw her being assaulted by one of the two suspects. The man then began punching the suspect who had been assaulting his wife, causing the suspect to flee the residence, where he jumped over the patio fence and ran off, he said.The 39-year-old woman was transported to an area hospital, he said.One suspect was described as a 20 to 30 year old Latino man with a normal 5-foot, 7-inch tall normal build. He was last seen wearing a black hooded sweatshirt with black pants and glasses.The second suspect was described as a 20 to 30 year old Latino man with a 6-foot, 2-inch tall normal.
