SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights.The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses.All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis.He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. SAN DIEGO (KGTV) - Eighteen-year-old Joseph Preissman is getting ready for his very first day as a college student. But a mistake he made last December is dragging down his final days of summer."It'd be really great to just figure out why we're getting charged so much for something so little, and something that was, like, an accident," he said. The accident happened near Idyllwild. Preissman and a friend were returning from a hiking trip, when he said it hailed. Preissman was coming around a bend and lost control of his car, running into a freeway directional sign and splitting its wooden post. Nobody was hurt, so Preissman thought the accident was ancient history. That is, until July 31, when the Preissman family got a bill from Caltrans to replace the sign - totaling 7.95. All but about of that bill was for labor. "I could even understand half that cost, but I can't understand how it could possibly take three people, let's say from 8 in the morning to 12 in the afternoon, to repair that sign," said Daniel Preissman, Joseph's father. Caltrans spokeswoman Emily Leinen stood behind the bill. She said about 0 of it went to administrative fees. Much of the rest reimbursed the crews for going out to the area and replacing the 16-foot-tall post. They had to make sure it had the proper breaking points for driver safety. SAN DIEGO (KGTV) - Frank Zamarron, 26, credits his Apple Watch for saving his life.“No warning signs, no pain no nothing,” Zamarron.  “All to know is that my Apple Watch started going off.”It was a Monday night in March, and his watch was alerting him something was wrong.“My heart-rate is elevated, and I'm just sitting at home watching TV relaxing from a long day at work,” he said. “After the fourth alert, I was like okay, something is not right. Time for me to a go to the hospital.”It was a decision that saved his life. It turns out, Zamarron contracted cellulitis, a skin infection, on his right leg. Soon after doctors started treating him, his leg began to blister.“Apparently your body is reacting to the infection trying to fight it off, doing everything it can, raising your heart rate,” Zamarron said. “They said it could have been fatal in a certain situation. Depending on how I treated it. Typically you would take pain pills or something and call it a day.”Zamarron spent seven days in the hospital.Doctors told him his weight might have contributed to the infection. Zamarron is now focused on staying active and getting healthier. 1223
