CARLSBAD (CNS) - The Army and Navy Academy agreed to pay .75 million to settle a lawsuit filed by a former cadet at the Carlsbad-based military school, where the cadet was allegedly sexually assaulted in 1999, the law firm representing the cadet announced today.The civil suit, filed by Irvine-based law firm Manly, Stewart & Finaldi, alleged that 60-year-old Jeffrey Barton, who was an administrator in charge of academics at the academy, molested the cadet when he was a ninth-grader in 1999, the law firm said in a statement.The lawsuit alleged that Barton drugged the cadet in May 1999 and sodomized him in a bathroom on campus.In a criminal case involving the cadet, Barton was convicted in June 2017 of five felony counts of oral copulation and one felony county of sodomy.He was sentenced to 48 years in prison in August 2017.Manly, Stewart & Finaldi also represented a former cadet of the Carlsbad-based academy in a separate civil suit in 2017. (KGTV) — A motorcyclist was killed on Friday after he lost control of his motorcycle and crashed into a building in Carlsbad.Carlsbad Police say the motorcyclist was traveling westbound on Faraday Ave. just after 3 p.m., when for unknown reasons he lost control and collided into a building.Officers arrived to find the motorcyclist unconscious. The rider, identified as a 29-year-old male from Encinitas, died at the scene.Police don't believe any other vehicles were involved and said it doesn't appear alcohol was a factor. It's unclear how fast the rider was traveling at the time of the crash.The area of Faraday Ave. and Orion Way was partially closed for the investigation but has since reopened. 728

CHICAGO (AP) — A Cook County judge has shot down actor Jussie Smollett's attempt to have the criminal charges against him dropped. In a ruling issued Friday, Judge James Linn rejected the argument made by the actor's attorneys that the new charges filed after the original charges were dropped violates Smollett's right against double jeopardy. Linn found that double jeopardy does not apply because Smollett has never been criminally punished.In January 2019, Smollett told Chicago police that he was the victim of an anti-gay and racist attack but he was charged after police concluded that he allegedly staged the attack himself. 640

Attorneys for Harris had asked that he be released and confined at home under strict conditions. But a Chicago federal judge said Friday that evidence offered by prosecutors “overwhelmingly supports detention.” U.S. Magistrate Judge Heather McShain says it would be “virtually impossible” to ensure Harris doesn’t use the internet. CHICAGO (AP) — Chicago's Second City comedy theater is up for sale. The sale, announced Tuesday, is the second in the company's 60-year history. In a statement released by investment banker Houlihan Lokey, co-owner Andrew Alexander said a sale presents the opportunity for Second City to continue to succeed well into the future. Second City suspended all its shows and classes in early March due to the COVID-19 pandemic until further notice. Second City faced controversy in June when Alexander stepped down from the training and performance troupe due to allegations of racism within the company.
