SAN DIEGO (KGTV) — A 59-year-old woman is the sixth person to die from the flu in San Diego County this flu season.The East County woman died on Nov. 23 from influenza B and there was no indication she received a flu shot this season, according to the County Health and Human Services Agency. SAN DIEGO (KGTV) - A Delta passenger mauled by an emotional support dog has filed a lawsuit against the airline and the dog's owner, a Marine combat veteran.In June 2017, Marlin Jackson boarded a San Diego-bound flight in Atlanta headed for a work conference. Soon after, fellow passengers watched in horror as a brutal dog attack played out in front of them.Jackson sat in a window seat. In the middle seat was a Marine veteran was with an emotional support dog, a chocolate lab pointer mix, in his lap. According to a Jackson's just-filed lawsuit, while he was securing his seat belt, "the animal began to growl."RELATED: Service dog or pet? He bled so profusely that "an entire row of seats had to be removed."The incident sparked national headlines, and tighter policies for emotional support and service animals. SAN DIEGO (KGTV) - A City pool is now drained and shut down after vandals threw glass into it.Parents who bring their kids to the Allied Gardens pool for swim lessons were notified on Monday of the closure. "Honestly my reaction, I just kind of sat there dumbfounded, they called and said the classes were canceled, me being curious I asked why, they said vandalism. I said you have to be kidding. This is my neighborhood!" said Marie Veenstra, a mom of three.She says two of her children attend lessons at the pool on Glenroy Street four days a week. "It is super frustrating, not only as a mom who can't bring her kids to the pool, but thinking about the environment," said Veenstra.The City says broken shards of glass can be impossible to see or retrieve without draining the pool. Broken glass found in and around the pool results in having to drain the pool completely, conduct a thorough cleaning of the pool bottom to retrieve remaining pieces of glass, refill the pool with water and necessary chemicals to ensure the pool is safe and then reopen the facility.The City's safety protocol is consistent with the Model Aquatic Health Code. Draining and refilling the more than 320,000-gallon pool will cost the City roughly ,000 when factoring in personnel. SAN DIEGO (KGTV) -- A family’s trip to the pumpkin patch goes sour when thieves went picking through their car while they were picking out their pumpkins.Fay Feltman, her daughter, her granddaughter and great grandson went to the pumpkin patch located off Mission Gorge in Grantville.Because of how busy the lot was, they struggled to find an open space. She tells 10 News her daughter ran to the car to find the window smashed and the purse stolen right from the trunk of the car.Feltman says her and her family were only in the patch for about 30 minutes. SAN DIEGO (KGTV) - A former San Diego Unified School District student and football player is suing the district.The lawsuit filed by Jason Srouy alleges he was never informed of the potential financial and legal risks of participating and playing an organized sport if a lawsuit were to be filed alleging any negligent or other claims against the student-athlete.In 2018 Srouy and the school district were sued by a referee. The referee was injured during a 2015 game and claimed it was done on purpose. He alleged Srouy had a history of unsportsmanlike conduct known and encouraged by the coaching staff.At the time Srouy told 10News he was playing wide receiver during the game, tasked with blocking the opposing cornerback. During the block, he says the opposing player fell onto the back of the referee's legs, injuring the official.In a previous interview, Srouy said after learning of the lawsuit a school official led his family to believe the district would help him; however that was not the case. “It wasn’t on purpose, it was an accident, I didn’t mean to hurt anybody," said Srouy.Srouy’s attorney tells Team 10 he was eventually dropped from the lawsuit but not before racking incurring more than 5,000 in costs and fees.A spokesperson for the district says they can’t comment on pending litigation. 1323
