SAN DIEGO (CNS) - The state Supreme Court Thursday ruled that a San Diego citizens' initiative that cut back city employee pensions was illegally placed on the ballot, and ordered an appeal court to consider a remedy.Proposition B, initially approved by voters in 2012, eliminated guaranteed pensions for new city employees, except police officers, and replaced those benefits with 401(k)-style retirement plans.In 2015, one of the city's largest public sector unions challenged the benefit system, alleging former Mayor Jerry Sanders and other officials illegally placed the measure on the ballot without conferring with labor groups. The Public Employees Relations Board ruled with the union, but the Fourth District Court of Appeal reversed the decision in April 2017.Now, the appeal court's decision is overturned."We reverse the Court of Appeal's judgment and remand for further proceedings to resolve issues beyond the scope of this opinion," wrote Associate Justice Carol A. Corrigan in Thursday's decision, in agreement with the other five justices.A city spokesperson couldn't be reached for comment.The court ruled that although it was a citizens' initiative, Sanders' support of Prob B as policy warranted engagement with the unions under the Meyers-Milias-Brown Act, which gave city and county employees the right to collective bargaining in 1968.Governing bodies "or other representatives as may be properly designated" need to engage with unions "prior to arriving at a determination of policy or course of action," according to the act.Sanders had said he supported the measure as a private citizen, not a public employee. The Supreme Court ruled that Sanders did use the power of his office to push the initiative, however."He consistently invoked his position as mayor and used city resources and employees to draft, promote and support the Initiative. The city's assertion that his support was merely that of a private citizen does not withstand objective scrutiny," Corrigan wrote.In overturning the Public Employees Relations Board ruling in 2017, the appeal court took an "unduly constricted view of the duty to meet and confer," according to the Supreme Court ruling.The Supreme Court ruled that the appeal court address an "appropriate judicial remedy" for the illegal placement of the initiative on the ballot.The Public Employees Relations Board had previously ruled the city must pay employees "for all lost compensation" related to lost pension benefits, which would cost millions of dollars.The 401(k)-style system was originally intended to save taxpayers money by reducing future pension liabilities. SAN DIEGO (KGTV) — A grant from the Central San Diego Black Chamber of Commerce is easing the pain of the pandemic and keeping businesses afloat.Captain Bill Wilkerson, the owner of Malihini Sportfishing, has fished since he was old enough to cast.Wilkerson said at the age of seven, he and his grandmother would walk to the bus stop and ride two hours to get to Venice Beach."We used to fish on Venice Pier sun up to sun down," he said smiling.He said his grandmother was trying to protect him, by taking him out of the L.A. neighborhood where they lived.Wilkerson said he had friends in elementary and middle school she knew were getting into trouble, "I went back 10, 15 years ago to see if I could locate some of those friends, and most of them were gone due to gangs and drugs and things like that."He said he would never forget the time she took him to Santa Monica to go fishing. It was an extra 45 minutes on the bus, but it was worth it, he said. While under the pier, he said he saw a boat pull up, let people off, take others on, and leave.He asked his grandmother what they were doing. She said, "do you want to go fishing on a boat?"She knew the captain and the next weekend he hosted Wilkerson. There was no going back to fishing on the pier after that trip.Wilkerson named the captains he worked for over the years and said he was thankful most for Raymond Sobeick, who he said taught him how to fish and opened him up to the opportunity to be a business owner. "My dad growing up told me that I would have to work 10 times harder than anybody else, just because of the color of my skin," he said pausing. "It's true."He said it was only true at the beginning of launching his business.After Wilkerson worked hard, bought the Malihini in 2006, and launched his business, he says from there it wasn't smooth sailing."In 2011, I was diagnosed with cancer, a brain tumor... In 2017, the boat struck a whale."The accident creating a mountain of debt."We started 2020 strong and then COVID-19 happened," he said.Wilkerson said they applied for every grant and loan available and didn't get anything. Then, he heard about the Black Business Relief Grant Fund through ABC 10News. He was awarded a ,000 grant and supported with tools and mentors who guided him on pivoting his business plan."They really want to see Black and minority and Asian businesses succeed ... To me, it's been invaluable. I mean, to see that there are doors that can be opened for a guy who owns a fishing boat who can't get financing because of whatever," he chuckled.Wilkerson said the grant paid for fuel and parts. He said they're hoping to get a loan to carry them through the next few months. He added that his faith has gotten him through many challenges."He's never let us starve, he's always made sure we have food, we had water. Our bills, for the most part, were paid," he said choked up. SAN DIEGO (CNS) - Two men were in custody this morning on suspicion of committing a home invasion robbery in the Skyline area.The victim and another man were inside a home at 7700 Skyline Drive around 12:30 p.m. Friday when two armed men entered the house, tied up the victim and the other man and stole items from the home and both victims, according to Officer Robert Heims of the San Diego Police Department.The suspects left the home and jumped into a waiting gold car, which lost control a short distance away from the home and became disabled, Heims said.Several people ran from the vehicle and when police arrived on scene, they found two men near the car, both of whom were detained and later arrested, Heims said.San Diego police robbery detectives are investigating. 784

SAN DIEGO (KGTV) - "81 percent of people get a mild form of this disease; I'm one of them," says Dr. Eileen Natuzzi. The Encinitas surgeon is still a bit weary after 16 days of self-quarantine from coronavirus symptoms. She retired in November after 25 years as an acute care surgeon but spends her time now in the Solomon Islands volunteering her services in undeserved communities. It was just over two weeks ago when she felt her symptoms coming on. "When I was returning from the Solomon Islands, I started to experience some chills, a little bit of a fever, and just a slight cough," says Dr. Natuzzi. She flew home a day early and got progressively sicker, with nausea, and intestinal issues. She spoke with a friend who's an infectious disease specialist and two ER doctors. "They said, 'Well, it sounds like you have it, but you're probably not sick enough to be tested at this point in time.'"Dr. Natuzzi was never able to get the test. But as of this week, she's back on her feet and recovering. When she's healthy enough, she'll answer Governor Newsom's call for retired health care workers to return to the job in the fight against coronavirus. For now, she's helping some friends in Hollywood with their cause. "So, please, please, please, donate as much or as little as you can. Everything helps," says actress Alicia Silverstone on her Instagram video.Dr. Natuzzi's and Silverstone have been trying to drum up support for donations to a GoFundMe page created by fellow actor Edward Norton. It's already raised close to 5-million dollars to get critical supplies to medical professionals. "To donate money, to cover the cost of moving PPE supplies to locations that need it," says Dr. Natuzzi. Places like New York, where supplies are desperately low. Dr. Natuzzi has a family member who works in one of those New York hospitals where mask supplies are so short; they use the same one all day. "Here we have probably more of a broadly spread disease, and we have folks reusing masks that shouldn't be reused," says Dr. Natuzzi. 2051

SAN DIEGO (KGTV) - A bizarre series of events led to a woman visiting San Diego with her family, getting attacked in a Hyatt Hotel lobby by a stranger running from a crash scene. Construction workers tell 10News they witnessed a man drive recklessly through a Mission Bay construction zone around 5 a.m., almost striking vehicles.The workers say they jumped in their truck and followed the driver down Quivira Road hoping to get his license plate information.Instead, they say the driver made a U-turn and crashed into their truck and a parked car. The driver’s car immediately burst into flames, but he wasn’t done just yet.According to the construction workers, the man then ran from the scene toward the Hyatt Hotel in Mission Bay.They say they chased him on foot, and held him down in the hotel lobby, waiting for police to arrive.Witnesses tell 10News that’s when the man got away and attacked a woman who was in the lobby checking out of the hotel.The woman’s husband told 10News the man tackled her then put her in the choke hold. The victim’s mother said she believes the suspect was trying to kill her daughter.The victim, her husband and parents were visiting San Diego from Minnesota. They were scheduled to continue their vacation by flying out to Hawaii this morning.They have to reschedule the trip because the victim was taken to the hospital.Police arrested the suspect. They say his motive is unclear.Investigators have not yet determined if the driver was under the influence of drugs or alcohol at the time of the crash. 1547
