SAN DIEGO (KGTV) -- A state review board will decide Tuesday whether to grant parole to a former skateboarding star from Carlsbad who has spent nearly three decades behind bars for a brutal rape and murder.Mark “Gator” Rogowski was a world champion skateboarder in the 1980’s who drew comparisons to Tony Hawk. He parlayed his fame into endorsements and promotional videos until he entered a guilty plea to the 1991 rape and murder of Jessica Bergsten, whose body was found buried in the desert.“This was a horrific, heinous, monstrous crime by an individual who really doesn’t want to admit that he took out transferred rage on another innocent individual,” said Deputy District Attorney Richard Sachs, who will represent the state at Tuesday’s hearing.Rogowski was denied parole in 2011 and 2016, but his case was granted another review ahead of schedule, Sachs said. The parole board will determine if Rogowski remains a threat to the community based on a psychological assessment and other factors.In a promotional video by the prison rehabilitation non-profit Getting Out by Going In (GOGI), Rogowski said he’s taken accountability for the crime and found a higher power.“My identity as a man was skewed. I thought what it meant to be a man was to be a womanizer, to have a lot of relationships,” he said.In 1991, the former skateboarding celebrity invited Bergsten to his Carlsbad apartment. Bergsten was a friend of the girl who had just dumped Rogowski.In a fit of what he called “misplaced revenge,” Rogowski clubbed the young woman over the head, cut her clothes off with scissors and sexually assaulted her for hours. When she screamed for help, Rogowski covered her with a surfboard bag and strangled her through it. He then drove two hours into the desert and buried her naked body in a shallow grave.“Certain crimes are so horrible they shock the conscience and this is one of them,” Sachs said.Sachs said prosecutors will strongly oppose parole on public safety grounds, although he acknowledged he could not predict the board's decision. SAN DIEGO (KGTV) — A San Diego veteran is suing 3M Company alleging earplugs he wore while in the military were defective. He’s the latest in a series of lawsuits that have been filed against the company by service members across the country.Kevin Alicie filed a lawsuit on Wednesday claiming he “used Defendant’s dangerously defective Dual-ended Combat Arms? earplugs during tank firing, training firing, other live fire training, vehicle maintenance, and during other training and combat exercises.” According to the lawsuit Alicie wore the earplugs while at Camp Pendleton and was first diagnosed with hearing loss in California. Alicie tells 10News during his military carrier he started having problems with his hearing. He’d hear ringing. He says he didn’t think much about it until the ringing started to become more frequent.“I mentioned it to the doctor when I was doing my final physical, and sure enough when they did that last hearing test they found that there was hearing loss,” Alicie said.The lawsuit says 3M did not inform the military or Alicie that the earplugs were defective and failed to adequately warn that the earplugs did not meet the military’s sound requirements."The biggest defect is they don't do what they are advertised to do,” said Alicie’s attorney John Gomez. “Essentially they are supposed to protect your ears and your hearing in proximity to loud sounds that can cause hearing loss or damage.”Attorney John Gomez says the earplugs were standard issue in certain branches of the military between 2003 and 2015.“Without question, I think tons of users-consumers and potential victims reside right here in San Diego County,” Gomez said.According to a July 2018 press release from the United States Department of Justice, 3M agreed to pay .1 million to resolve allegations that it supplied the United States with defective dual-ended combat arms earplugs.The release says, “the United States alleged that 3M, and its predecessor, Aearo Technologies, Inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. SAN DIEGO (KGTV) -- A San Diego psychiatrist no longer has a license after authorities say he was intoxicated while practicing.According to the Medical Board of California, Marco Antonio Chavez’s license was suspended following an investigation.The investigation began after authorities say a patient reported that Chavez sent him a box of medication in 2017 that contained an empty vodka bottle.During one of several office visits, an investigator said Chavez appeared to be intoxicated.Documents show that Chavez told the investigator that his mother gave him a “Mexican home remedy to stop his drinking” which consisted of vodka and cloves. At a hearing, Chaves said he had two of the drinks that morning.During the visit, the investigator told Chavez he believed he was “so intoxicated that he could not practice medicine” and told two patients in the waiting room to go home.A test conducted by a San Diego Police officer shows that Chavez had a blood alcohol level of .216. SAN DIEGO (KGTV) - An 18-month-old toddler ingested marijuana at a home in San Ysidro, San Diego Police said.Officers said a nurse at Sharp Chula Vista called them Sunday about 5:30 p.m. about the incident.The child ingested the pot at a home on Beyer Blvd and was taken to Rady Children's Hospital, the nurse said.San Diego Police said child abuse investigators are looking into the matter. 399

SAN DIEGO (KGTV) - A woman was arrested Thursday on suspicion of running over and killing a man she had been arguing with at a Kearny Mesa parking lot. San Diego police said 33-year-old Latisha Ingram and an unidentified 25-year-old man were arguing in a parking lot in the 4600 block of Convoy Street at around 11:30 p.m. Thursday when the altercation escalated. Kiana Smith was in the middle of her shift at Rakiraki ramen restaurant when she heard the noise outside. Ingram was belligerent, Smith said, adding she had been turned away by a bartender at O’Brien’s. "She turned her down because she was way too drunk, then she made her way this way, and a server saw her before I did, saying she was way too drunk, she couldn't even walk." Smith told 10News the male victim, who had been waiting on a table with his girlfriend, was trying to stop Ingram from driving. "It looked like she was trying to get in her car, but she was obviously way too drunk to drive, so the guy was trying to stop her from driving,” said Smith. According to police, Ingram then drove away while the man was holding onto her car. Police said Ingram drove out of the parking lot and turned southbound onto Convoy Street when the man let go and was allegedly run over. "He ended up on the hood, and she made the right turn, and he completely flew off," said Smith.The man was rushed to the hospital, where he died from his injuries, police said. 10News learned Ingram returned to the area about 30 minutes later and was arrested without incident. Ingram was booked on suspicion of felony hit-and-run and felony DUI. 10News learned she has a prior DUI charge from 2011. Smith said returning to work Friday was tough. 1702
