San Diego (KGTV) - Thousands of kids across California approved for in-home nursing care are struggling to get the help they desperately need.On Thursday two children filed a class-action lawsuit against the California Department of Health Care Services and its director claiming the state has failed to fulfill its commitment to provide them with sufficient Medi-Cal in-home nursing services.It says, “this class action lawsuit asks the Court to order Defendants to take all steps necessary to arrange for previously-approved, medically necessary in-home shift nursing services for Plaintiffs and Class members.”According to the lawsuit plaintiff, Ivory N. is a seven-year-old and a Medi-Cal beneficiary. It says the child needs 63 hours per week of skilled nursing at home but only receives about 56 hours per week.The non-profit group, Disability Rights California, says more than 4,000 Medi-Cal eligible children have been approved by the state to receive Medi-Cal in-home nursing care, but the state lacks an effective system for arranging for needed nursing."It’s too bad that a lawsuit had to be filed, but they are right to file it because right now that need is not being met,” said California State Assemblyman Brian Maienschein.In 2017 Maienschein tried to get the problem fixed through legislation. He believes the state is not following through on its promises to the kids.“It was a significant victory last year that we were able to get money in the budget, but they are still not following through on the promises they made,” he said.According to a news release from Disability Rights California, “29 percent of authorized Medi-Cal nursing hours go unstaffed.” 1693

SAN DIEGO (KGTV)- A Solana Beach man's trip to Bali takes an unexpected turn after a motorcycle accident. While he's thousands of miles away, the pandemic has made things even more complicated.28-year-old Anthony Galvan- Schaible packed his bags for Bali in February with the intent to stay until April. In March, the pandemic hit, forcing him to stay in Paradise a little longer."It was one of those things to sit it out and wait was the better idea," says Galvan- Schaible.He says one night he hopped on his motorcycle, and that's when things took an unexpected turn."The bike went to the street. I went to the left and ended up in a little ditch head first."He was rushed to the hospital after hitting his head on a concrete pillar. The impact compressed his spine. Within hours he was taken to emergency surgery. Galvan- Schaible now has multiple screws and plates along his back."It's terrifying… when they're across the planet and get hurt," says Mom, Jamie Schaible. "All you can think of is how can they get the care that they would get here."Because of travel restrictions, mom says it was stressful not knowing how she would get to her son."We reached out to the Indonesian embassy and just pleaded from a mother's heart and leaned on their compassion," says Schaible. "They bent over backwards to get me my visas."This allowed her to get to her son's bedside.Galvan-Schaible says he is starting to regain feeling in his hand. SAN DIEGO (KGTV) - The threat of a major lawsuit has led to several San Diego County cities changing how they are holding elections. As voters in those districts head to the polls or get their mail-in ballots, they will notice a big change in their options on who to vote for.15 jurisdictions in the county are switching from at-large elections to district elections. This means those jurisdictions have been carved up into districts. In those races voters will only be able to vote for someone who lives in that same district."It's going to create some confusion at the ballot box," Encinitas City Councilmember Tony Kranz told 10News. "You're going to wonder why you can't vote for some of those folks."Encinitas made the change for 2018, along with Carlsbad, El Cajon, Oceanside, Poway, San Marcos, Santee and Vista. School Districts using the new voting system are Cajon Valley Union, Carlsbad Unified, Oceanside Unified, Poway Unified, San Dieguito Union High School, and San Marcos Unified.In most cases, the change is a response to a threatened lawsuit. Attorney Kevin Shenkman, who works in Malibu, has threatened lawsuits challenging the legality of at-large elections across California. He says at-large elections are a violation of California's Voter's Rights Act of 2001."It's just a fundamentally unfair election system that freezes out minorities," Shenkman told 10News.Shenkman says at-large elections make it easier for the majority, even a slim majority, to take full control city councils, school boards, and other elected bodies. He says studies have shown that leaves minority groups without a voice.In an interview with 10News, he pointed out examples, including a claim that Hispanic voters did not have enough representation in Encintas, and a claim that voters in the southern portion of Poway have disproportionally less power than those in other parts of Poway."District elections are just a more fair system," Shenkman says. 1974

San Diego (KGTV)- After spending nearly months in the ICU, a local healthcare worker, who tested positive for COVID-19, is sharing his story."At that time, I thought for certain I was going to die."Ezequiel Melendez Jr., also known as Zeke, spent 57 days in the hospital after contracting COVID-19.The Respiratory Care Technician says he's always been an active and healthy person. He did not have any underlying medical conditions. His struggle with coronavirus started in early March with flu-like symptoms."I didn't meet the criteria at the time for COVID testing," says Melendez. "You were supposed temperature of 102; mine was 100. They told me don't go back to work until 24 hours with no symptoms."Melendez says seven days later, his symptoms got worse."Next thing I know, I'm laying on a gurney preparing for intubation with an endotracheal tube."Melendez's girlfriend, Grace Carbajal, who is also a healthcare worker, says it was a challenge seeing him sick."Being a nurse and not being able to be there at the bedside, also being a loved one and not being able to be there for him and with him, was very difficult," says Carbajal.After spending weeks in the hospital, Melendez was released in late May. He says it will be a while until he feels like himself again. He is still under doctors' care and has physical therapy weekly.He also has a message for everyone as the pandemic continues."We need protection and everyone doing their part to wear masks," says Melendez. "I was one who thought it was just something like the flu, maybe exaggerated at the time. But when it happened to me, it was a smack to the face."Melendez says he would like to thank everyone for the support and those who donated to the GoFund Me that was created while he was in the hospital.
