Retailers pulled some name brand dog food from store shelves after a euthanasia drug was found in several products."I was a little surprised, but at the same time you hear all sorts of stuff about what is and what isn't in dog food," said Sam Porach, pet owner.The FDA started an investigation after a TV station tested several cans of Gravy Train dog food and found 60 percent contained pentobarbital, a drug used to euthanize animals, found in some products."It's a tranquilizing drug that is sometimes used by veterinarians in animal shelters to reduce anxiety in animals and ultimately put them to sleep," said Jackie Bowen, the executive director of Clean Label Project.The Clean Label Project is a non-profit aimed at educating people about toxins in products, including pet food."This industry needs to do a lot more testing and be a lot more critical of the ingredients used in its products," said Bowen.The J.M. Smucker Co. owns the brands in question including Gravy Train, Kibble 'N Bits, Skippy and Ol' Roy.  The company is investigating how pentobarbital got into the supply chain."One possible way is through contaminated ingredients," Bowen said.Between recalls and reading labels, pet owners are left trying to navigate what's really safe."Try to go all natural type yah know baked treats and stuff," pet owner Ryan Searle said."I feel like there's been a pretty big movement lately on knowing what's in your dogs' food and having higher quality foods," Porach said.Smucker's said the low level of the drug found in the food does not pose a threat to pets, but admit it's not acceptable. (AP) -- The California Supreme Court overturned the 2005 death sentence for Scott Peterson in the slaying of his pregnant wife.The court says prosecutors may try again for the same sentence if they wish in the high-profile case. It upheld Peterson's 2004 conviction of murdering his wife Laci Peterson.Laci Peterson was eight months pregnant with their unborn son, and investigators said that on Christmas Eve in 2002, Scott Peterson dumped the bodies from his fishing boat into San Francisco Bay.The court on Monday said the trial judge made several significant errors in jury selection that undermined Peterson's right to an impartial jury at the penalty phase.The court ruled potential jurors for the death penalty phase were improperly dismissed after saying they disagreed with the death penalty but would be willing to impose it."The trial judge made a mistake by kicking those people off the jury, so the only people that sat on the jury were in the death penalty camp," said criminal defense attorney Gretchen von Helms.Prosecutors will now decide whether to retry the sentencing phase.While the sentence was overturned, the court affirmed the murder convictions. "The sentencing was a positive step. The other decision (convictions affirmed) was about what we expected. Now we go to the habeas appeal," said Lee Peterson, Peterson's father.The court will examine the case again when it decides a separate habeas corpus challenge, based on evidence. not presented at the original trial. Peterson's father declined to talk about the arguments in the appeal, but says he's expecting a development within the next four months.Peterson's family issued this full statement in response to the court's decision:Our family is sincerely grateful that the California Supreme Court recognized the injustice of Scott’s death penalty. While we hope for the opportunity to present the new evidence to a jury, it is not likely that this penalty phase trial will happen. (AP) — Californians who lost their home insurance because of the threat of wildfires will be able to buy comprehensive policies next year through a state-mandated plan under an order issued Thursday by the state insurance commissioner.As wildfires threaten the state, insurance companies have been dropping many homeowners who live in fire-prone areas.Most of those people turn to the California Fair Access to Insurance Requirements Plan, an insurance pool mandated by state law that is required to issue policies to people who can’t buy them through no fault of their own.But FAIR Plan policies are limited, offering coverage for fires, explosions and limited smoke damage.California Insurance Commissioner Ricardo Lara on Thursday ordered the plan to begin selling comprehensive policies by June 1 to cover lots of other problems, including theft, water damage, falling objects and liability.Lara also ordered the plan to double homeowners’ coverage limits to million by April 1.“You have people that now are being sent to the FAIR Plan and they have no other alternative. They won’t even get a call back from an insurance company to offer them a quote,” Lara said.The FAIR Plan has been around since 1968. It is not funded by tax dollars. Instead, all property and casualty insurance companies doing business in California must contribute to the plan.Known as the “insurer of last resort,” the plan has been growing in recent years as wildfires have become bigger and more frequent because of climate change. FAIR Plan policies in fire-prone areas have grown an average of nearly 8% each year since 2016, according to the Department of Insurance.Likewise, since 2015 insurance companies have declined to renew nearly 350,000 policies in areas at high risk for wildfires. That data comes from the state, and it does not include information on how many people were able to find coverage elsewhere or at what price.The FAIR Plan is governed by a board of directors appointed by various government officials. Lara says he has the authority to reject its operating plan. On Thursday, he ordered it to submit a new plan within 30 days that includes an option for comprehensive policies and other changes.California FAIR Plan Association President Anneliese Jivan did not respond to an email seeking comment.It’s unknown how much the plan’s new policies will cost. But rates for FAIR Plan policies are supposed to break even. The insurance industry must cover any losses. And if the plan generates a profit, that money is given back to insurance companies.FAIR Plan policies have been limited because, in general, the insurance industry doesn’t want state-mandated plans to compete with private insurance plans. "I felt like I had a bad burn in my back."The venom is so toxic that Russ knew it would eventually shut down his respiratory system.  "I could just start to feel the burning spreading and so that mean venom is spreading," Johnson said.  He was rushed to Banner University Medical Center in Phoenix. They're used to treating rattlesnake bites but a cobra? They didn't even have the antivenom to treat him. The closest vial of medicine was more than 800 miles away, in Denver. "It was difficult," said Dr. Michelle Ruha, a toxicologist at Banner. She's also one of Johnson's doctors. She tried giving him antivenom the hospital did have, hoping it would save his life. Nothing was working."He was no longer able to open his eyes," Ruha said. "He was becoming weak. He was having trouble speaking."The only option was to fly the 10 vials of antivenom from Denver to Phoenix. Finally, eight hours after the bite, Johnson was starting to come back. "There was an angel on my shoulder," Johnson said. "Beyond Dr. Ruha, who is my personal angel, and I guarantee you that."Today, Banner University Medical Center has the cobra antivenom on-hand. It's also expanding what types it does carry. SACRAMENTO, Calif. (AP) — Police say a shooting at a Sacramento mall on Black Friday has killed one person and left another with life-threatening wounds. It happened at around 6:30 p.m. at Arden Fair Mall. Fire officials tell KPIX-TV that one person was found dead at the mall and another was found at a bank outside of the mall and was taken to a hospital with life-threatening injuries.
