SAN DIEGO (KGTV) - "It's not fair and it's not right," says Warren Peters of Spring Valley. He says he's been watching his son, Jahmes, spend several months fighting for his federal tax return. "People need this money. People have worked for this money. People have earned this money," says 24 year-old Jahmes.The young man tells Team 10 that he filed online in February and received his state refund, but not his federal refund. It's now been more than 7 months. A return summary shows he's owed almost ,200 from the IRS.Jahmes says he's between jobs and burning through his savings. His father tries to help but says he's retired and on a fixed income, so his means are limited."It doesn't feel too good depending on your dad at 24-years-old," Jahmes tells Team 10. Jahmes says he has repeatedly called, emailed and written to the IRS. He adds he was once asked to appear in-person to verify identity, which he says he completed. However, he says his efforts didn't yield clear answers from the IRS.On the IRS website, he showed us what he says is his filing status. "Your tax return is still being processed," is what it reads. "If the circumstances were different, [the IRS] would be knocking on [our] door looking for their money," says Warren Peters. "The IRS is just understaffed and overworked," says tax attorney Ronson Shamoun, CEO of Downtown San Diego's RJS Law Firm. He says long delays are not uncommon. "Yet, after it's been so long, there should be some indication as to what's going on or some sort of game plan as to what you can do."Shamoun says the best route to take is contacting the Taxpayer Advocate Service, which was created by Congress to facilitate aid for taxpayers dealing with related issues. The IRS website reports that most refunds are issued in less than 21 calendar days, but explains there are a number of reasons for delays, including possible errors, incomplete returns, and concerns about identity theft or fraud.  The IRS says it cannot respond to media inquiries about specific cases."He does have a right to be upset. He definitely does," says Shamoun. The Taxpayer Advocate Service can be reached https://taxpayeradvocate.irs.gov/   2371

SAN DIEGO (KGTV) -- A 25-year-old has been arrested after being shot by a store clerk he was trying to rob, San Diego Police say.According to police, Hector Lopez-Gastelum entered the La Michoacana store on the 700 block of Vesta Street around 10:40 a.m. on October 18 demanding cash. Police say Lopez-Gastelum was armed with a handgun.After the clerk handed over the cash, the suspect reportedly demanded that a second register be opened.“While Lopez-Gastelum was still in the store, the clerk shot him twice in the torso with his own handgun, which is legally owned,” police said.The clerk then retrieved Lopez-Gastelum’s handgun and called 911. The suspect was taken to a hospital where he is being treated for his injuries. SAN DIEGO (KGTV) - A broken water line in Tijuana sent a mixture of potable water and untreated sewage across the U.S.-Mexico border. The 7.8 million gallon spill, which started Sunday night at 7:30 p.m., was stopped Monday afternoon, according to a spokesperson from the International Boundary Water Commission.A spokesperson for the IBWC said the 16-inch potable water line broke near Agua Caliente Blvd. in Tijuana. The ruptured portion of the pipe has been repaired.Mexican water officials shut down Tijuana’s pump station because the water flow exceeded the station’s capacity, the IBWC said. “Water and untreated waste water continues to flow into the United States,” said IBWC officials.County Beach and Bay Monitoring Program staff members tell 10News the flow was stopped before it could impact local beaches and there is no risk at this time. 860

SAN DIEGO (KGTV) - A Carmel Valley family who moved from Parkland, Florida is upset after learning two Parkland victims died of apparent suicides.Erin George says these suicides in her hometown are re-opening old wounds. It has her wondering how many more lives will be lost due to the senseless tragedy. She said, “I was numb. I just thought when does the loss of life stop from this.”Erin’s daughter Lauren lost a friend in the shootings. She worries about the emotional impact the shootings will have on her daughter.Suicide prevention experts say the best thing you can do is look for warning signs and talk to your teenagers. SAN DIEGO (KGTV) - A former Camp Pendleton Marine was sentenced Monday to more than 17 years in prison for owning and distributing child pornography.William Walsh IV, 55, was arrested in May 2017. Escondido Police officers searched his home and seized hundreds of files Walsh had downloaded through peer-to-peer file sharing software.A jury found Walsh guilty of all charges. U.S. District Judge Anthony J. Battaglia said Walsh’s conduct was “on the extreme end of the cases I have seen.”“Today a man who committed terrible crimes against children was sentenced to many years in prison,” said U.S. Attorney Adam Braverman. “These horrible experiences will echo in the hearts and minds of young victims for a lifetime, and I am deeply distressed and deeply committed to pursuing cases that will protect our vulnerable youth from people like Walsh.”“Today’s sentence confirms that this predator can no longer victimize innocent children because he is off the streets and he is offline,” said FBI Special Agent in Charge John Brown. “This investigation showcases the success of collaborative federal and local investigations working toward a common goal.”Walsh will serve his sentence in federal prison. 1208
