In a sharp turn of events, a San Francisco judge denied Monsanto's request to nix a 0 million award to a man who said he got terminal cancer from Roundup weedkiller.But she's also slashing that man's punitive award down to about million.Former school groundskeeper Dewayne Johnson was the first cancer patient to take Monsanto to trial, claiming Roundup gave him non-Hodgkin's lymphoma.Jurors sided with Johnson and awarded him 0 million in punitive damages (to punish Monsanto) and about million in compensatory damages (for Johnson's lost income, pain and suffering).The jury's verdict came in August. But on October 10, the tide appeared to turn in Monsanto's favor.That's when Superior Court Judge Suzanne Bolanos issued a tentative ruling granting Monsanto's request for a JNOV -- a judgment notwithstanding verdict. That's basically when a judge in a civil case overrules the jury's decision.Bolanos said the plaintiff "presented no clear and convincing evidence of malice or oppression to support an award of punitive damages." In other words, Johnson's entire 0 million punitive award was in jeopardy.The judge gave attorneys on both sides a few days to respond and further make their cases.When she issued her final ruling Monday, Bolanos reversed her tentative ruling and denied Monsanto's request for a JNOV.But it wasn't a complete victory for Johnson. Instead of 9 million in combined damage awards, Johnson is slated to get a total of about million.Bolanos said the punitive award was too high and needed to match Johnson's million compensatory award."In enforcing due process limits, the court does not sit as a replacement for the jury but only as a check on arbitrary awards," Bolanos wrote in her ruling Monday."The punitive damages award must be constitutionally reduced to the maximum allowed by due process in this case -- ,253,209.35 -- equal to the amount of compensatory damages awarded by the jury based on its findings of harm to the plaintiff."Monsanto had also requested a new trial on the punitive damages. The judge said that request will be denied if Johnson accepts the smaller punitive award. If he does not accept the million punitive award, then a new trial would be set.The 1 million plummet in Johnson's punitive award caught some legal experts by surprise, including University of Richmond?law professor Carl Tobias."I am somewhat surprised, but the punitive damage award was high even though the (percentage of) reduction was steep," Tobias said. "No one thought the plaintiff would retain the whole (punitive damages) award." 2626

House Speaker Nancy Pelosi’s office is responding to criticism after she got her hair done inside a San Francisco salon, amid a citywide coronavirus restrictions on salons.A statement from her office acknowledges Pelosi and her staff relied on the information provided by someone at the salon about what was allowed by the new city regulations that went into effect last Friday, according to multiple outlets.The statement came after Fox News shared a video showing Pelosi inside the salon. Fox talked to the salon’s owner, Erica Kious, who told the news outlet, “it was a slap in the face” that Pelosi could go in and “get her stuff done” while the owner and others can’t work.Kious said it was an independent stylist who rents a chair from her."This business offered for the speaker to come in on Monday and told her they were allowed by the city to have one customer at a time in the business," Pelosi's Deputy Chief of Staff Drew Hammill said in the statement. "The speaker complied with the rules as presented to her by this establishment."The statement also says Pelosi wore a mask except for a brief time when she was getting her hair washed.The new restrictions in San Francisco say hair salons can operate outdoors, and that some procedures, like color and chemical treatments, still cannot be done. 1316

If you've notice delays in the delivery of your packages or higher prices for some of things you order, a shortage of truck drivers may be to blame. A new program is hoping to bring some relief, but some worry it'll make roads less safe.The program trains teenagers to drive cross country. Elijah Amos is one of the teens involved with the program and working towards getting his commercial driver’s license.“I think we really did it for me is driving,” Amos says. “Because I really like driving and I feel like you get paid a decent amount of money. Just to drive.”But since he's 18, he won't be able to drive from state to state. He'll have to wait until he's 21. However, a new government pilot program will soon allow some drivers as young as 18 to drive cross country.“I feel like it would open up more job opportunities,” Amos says. “And maybe it opened up the eyes to some of the younger people maybe like actually try and do it.”The program would be available to some members of the National Guard and others with military experience. But in March, House Republicans introduced a bill to lower the commercial driving age to 18 for anyone driving state to state. Their goal? To fight a nation-wide truck driving shortage.Quincy Jones, who directs Sage Truck Driving School, says it's been challenging to attract driving students. He says ultimately, consumers pay the price.“Shipping costs get passed down the consumer,” Jones says. “So if there's a shortage, those aren't getting picked up as frequently. And so who pays them? We do. We all pay. Consumers do."The American Trucking Associations says the shortage is expected to hit 63,000 this year. But with motor vehicle drivers aged 16 to 19 being nearly three times more likely than people over 20 to fatally crash, not everyone believes teen drivers are the solution to the problem.“Younger people have less experience driving for all types of vehicles,” says Norita Taylor, with the Owner Operators Independent Drivers Association. “And so the crash rates are higher for younger people, and so we think it would be a dangerous idea.”Sponsors say the bill would require teens complete at least 240 hours driving supervised by a veteran driver.  2240

"I have to like touch all four sides of the door on the way in and you know with the seats," says one passenger. "And count to 100 during take off."It has almost led do some missed opportunities."I thought ok I'll just never fly again I'm old I don't care," one woman says. "But my daughter is going to college and I want to go with her."That's why these people have decided to not only share but face their fears in this Fear of Flying Clinic. Students learn it's not the fear that's the problem but the way they think about it. And once that changes so does the fear."It's not easy to do because you do have a whole set up of automatic beliefs that are causing you trouble," says one of the class instructors.That's why debunking students' biggest fears is so important."I have some very disappointing news for you all about turbulence," says commercial pilot Captain Mark Connell. "We don't care. It doesn't make much difference to us."As scary as it might feel, Captain Connell compares a plane hitting turbulence to a car hitting a pothole. He covers everything from turbulence and weather, to pilot training and preparedness."There's something helpful about that to think to yourself well he flies planes all the time and he's not scared so I probably shouldn't be scared either," says Mimi Kravetz.Kravetz has been scared of flying since she was 10."When there's turbulence on an airplane, my heart starts beating quicker. I feel really panicky. I can't focus. I can't sleep and I wanted to get out of that feeling," Kravetz says.Now she's ready to face her fear. "It'll be interesting on Monday to try and go in to see if I can replace my current set of thoughts with a set of new ones," Kravetz says.And get into the air with as much ease as the plane she's riding in.      2351
