SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096

SAN DIEGO (KGTV) -- A Coast Guard crewmember was injured after someone pointed a laser at a boat off the San Diego Coast Friday evening.According to the Coast Guard, the incident happened Friday around 6:30 p.m. off the coast of Ocean Beach.The crewmember was taken in for medical care after receiving eye injuries while aboard the Sea Otter, a 78-foot-long patrol boat.San Diego Police checked the nearby pier in Ocean Beach, but were unable to locate any suspects. 474

SAN DIEGO (CNS) - Two former members of an Imperial County church that federal prosecutors allege was embroiled in a labor trafficking scheme in which church members forced homeless people to surrender their welfare benefits and panhandle for the church, pleaded guilty to labor trafficking and benefits fraud Thursday in San Diego federal court.Jose Gaytan, 47, and Sonia Murillo, 51, both of El Centro, admitted to assisting in the scheme to recruit homeless people in San Diego and other cities, then force them to participate in raising money on behalf of Imperial Valley Ministries, a non-denominational church headquartered in El Centro, according to the U.S. Attorney's Office.Prosecutors say former church pastor Victor Gonzalez ordered his members to prevent victims from leaving church properties, including by screwing or nailing windows shut and keeping doors locked from the inside at homes the church operated. Gaytan and Murillo were also instructed to tell female victims that Child Protective Services would take their children if they left Imperial Valley Ministries, according to prosecutors, who said Murillo was punished by other members for letting church participants leave.RELATED: DOJ: Church leaders held homeless against will in San Diego and other citiesA grand jury indictment states the transients were forced to sign documents stating that they would not leave the homes unaccompanied and they would hand over all identification and personal items to church directors.Other rules included no reading of anything other than the Bible, and no discussions of "things of the world," according to the indictment.Court documents identify Gaytan and Murillo as home directors for two of the church's group homes in El Centro and Chula Vista. SAN DIEGO (KGTV) - A BB gun shooting spree has neighbors frightened Sunday after more than a dozen incidents across San Diego.At the corner of L Street and Sixth Avenue a woman was shot in the arm overnight, according to San Diego Police. She was walking in a small group and one of the men was an exhibitor at Comic Con, staying at the Omni Hotel, where they were headed before the shooting. That man, Sal Abbinanti, said "The girl I was with said a guy in a white car in the back seat, she heard a trigger sound and then she's like oh I think I just got shot which kinda got out attention and then we saw it was bruised and bleeding and it looked like a BB." "There's just so much security down here, so many San Diego police down here. I was surprised that this guy was dumb and brazen to do something like that," he said the hotel provided excellent care to his friend.Over in National City and Paradise Hills, at least a dozen cars were hit.Coronado Police say at least 11 businesses were hit.Downtown, police reported four more instances of people being shot at or hit by BB guns.The rash of crimes comes after 10News reported more than a dozen businesses and car windows busted by BBs in the past month:June 24th – Numerous vehicle windows were vandalized in the Point Loma, Ocean Beach and Mission Hills neighborhoods.July 1st and July 2nd - Three businesses in the Hillcrest neighborhood were vandalized.July 2nd - Two businesses in the Park West neighborhood were vandalized.July 2nd and July 3rd – Numerous vehicle windows were vandalized in the Clairemont neighborhood.July 6th - Three businesses and one vehicle were vandalized in the Midway area. A dark colored SUV is suspected in these cases.July 7th - Five businesses in the College area were vandalized.July 8th - One home in the Lake Murray neighborhood was vandalized.According to California law, negligent discharge of a BB gun resulting in injury could mean up to a year in jail.Police from the corresponding agencies are working on these cases. SAN DIEGO (KGTV) -- A father is speaking out after being stuck on a SeaWorld ride for several hours in the cold Monday night. In video from the incident, 15-year-old Jordan Sherr can be heard shivering in the cold as temperatures plummeted into the low 40s. Jordan and his dad Jonathan were in a gondola on the Bayside Skyride when, two minutes into the ride, a huge gust of wind blew into the bay. “40-50 miles per-hour, blowing us around, looked up and saw the cables going spastic. Wondering what was going when it snapped shut, shaking us at a 45-degree angle back and forth,” said Jonathan Sherr. RELATED: 'Gust of significant wind' causes SeaWorld ride to stop, leaves 16 strandedFor a few terrifying moments, Sherr says he thought it was the end.“We thought we were going to plummet to our deaths. We said a few prayer, told each other we loved each other, then we decided to come up with a game plan, assessed height of water and decided it was a no go,” Sherr said. Their fears weren’t realized and, eventually, the gondola stabilized and they began to record cellphone video. “We're like a hundred feet up, over shallow water yea,” Sherr said. Over the next five hours, Sherr says they heard messages from staff at SeaWorld over a loudspeaker before firefighters came to the rescue. Jonathan, who has suffered a stroke, says he stiffens up in the cold. He was able to cover up with a blanket located in the gondola. After five hours, it was their turn to be rescued. They were the last to be rescued. Jordan went first, followed by Jonathan. 1714
