SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. SAN DIEGO (CNS) - The county's flu death toll inched closer to 70 last week, while lab-confirmed flu cases continued to decline, the county's Health and Human Services announced today.The county received one report of a flu-related death last week, a 74-year-old North County man who had additional medical issues. County health officials did not disclose whether he had received this flu season's vaccine. The county's flu death toll now sits at 68.The county confirmed 86 flu cases last week, down from 114 cases during the prior week. Confirmed flu cases have declined for six consecutive weeks since reaching a season-high of 692 in mid-March. SAN DIEGO (CNS) - Restaurant chain Tapioca Express has agreed to pay more than 0,000 to settle a federal sexual harassment lawsuit involving two franchises in Chula Vista and National City, where the owner was accused of making unwanted sexual advances toward young female employees, the U.S. Equal Employment Opportunity Commission reported Monday. Tapioca Express will pay 2,500 due to the unidentified restaurant owner's conduct toward Filipina employees between the ages of 17 and 23, according to the EEOC, which reported the harassment involved "repeated and unwanted comments of a sexual nature and physical contact," which led some employees to quit their jobs. The EEOC did not specify how many employees were harassed, but alleged that a written complaint did not lead to any changes regarding the harassment. "We commend the young women for coming forward to shine a light on the harassment to which they were subjected," said Christopher Green, director of the EEOC's San Diego office. "Their strength may give courage to other young people or those in the Asian American and Pacific Islander community who may be suffering harassment or discrimination in the workplace to come forward as well."In addition to the settlement money, Tapioca Express will hire an "external monitor" to review sexual harassment policies and procedures and establish a complaint procedure for employees.
