SAN DIEGO (KGTV) -- An 87-year-old man was beaten during a home invasion in Clairemont Wednesday afternoon. According to San Diego Police, the incident happened on the 4600 block of Firestone Street at 3:02 p.m. Police say three men forced their way into the 87-year-old man’s home before beating and robbing him. "All of a sudden three guys come plowing through my front door, said 'this is a robbery.' I said, 'Come on ... I got nothing here for you.' Which didn’t dissuade them," said Paul Schmidt. Schmidt told 10News he was working on a ceiling fan with the door open when the men broke in. “I had scissors laying there, he grabbed the scissors and he threatened me with it. He said, 'There’s three of us and one of you, and we’re robbing you.' And what could I do, maybe one or two guys I can handle, but three ..." Schmidt added. Schmidt says he fought back, grabbing one of the robber's beards before one of the men held scissors to his throat. "The guy with the beard, he was the meanest, he seemed to be the lead, but he was higher than a kite," Schmidt said. The robbers were able to get away with Schmidt's wallet as well as his red pickup truck and some smaller items. Police arrested two suspects in the attack on July 25. Both suspects have, as of Monday, been charged with robbery, elder abuse and auto theft.The suspects were identified as John Slobig, 59 and Terry Jones, 53. Police say a third suspect is still outstanding and the victim’s vehicle was returned. 1489

SAN DIEGO (KGTV) — An Ocean Beach man was injured after two men stormed his home, beat him, and robbed him.Police say the 34-year-old victim was at his home on Cape May Ave. with a woman, possibly an ex-girlfriend, when there was a knock at the door at about 10 p.m.The woman answered the door and two men forced their way inside, one wielding an expandable baton and the other with a knife, police said.A struggle began between the victim and two suspects and the two men beat the victim several times, before ordering him to open a safe.After the suspect was unable to open the safe, the suspects rummaged through the home and stole several items, including credit cards. The two men then fled.The woman fled shortly after as well.The victim was treated at a nearby hospital for non-life threatening injuries.Police described the suspect with a baton as a 20- to 25-year-old white male, 5-foot 10-inches, with thin build. He was wearing dark clothing and may have had his face painted black, police added. The man with the knife was described as a 25- to 30-year-old Hispanic man, 6-feet tall, weighing about 220 pounds, and wearing a black sweatshirt and jeans. SAN DIEGO (KGTV) - An effort is underway to crack down on illegal party boats and other charter vessels operating on San Diego Bay. The Port of San Diego wants to create new charter permit requirements to make it easier for those who want to operate legally to do so. Currently, legal charter vessel operators must obtain a Permit from a marina or sportishing landing where they board passengers, and according to the Port there are more charter vessel operators than there are available slips at the marinas and sportfishing landings on San Diego Bay.To address this problem, the Port proposes to issue all Charter Vessel Operation Permits (Permits) for all Charter Vessel Operations and collect license agreement fees from qualified Charter Vessel Operators who do not have an agreement to operate from a marina or sportfishing landing. “San Diego Bay great place to do charter business because it's almost entirely landlocked, not subject to swells, makes for great party boats, cruising,” says Captain John Valente of San Diego Bay Cruises. Valente spent 15 months and almost 0,000 to get his boat in compliance with federal regulations. The figure does not include the price of insurance. Last year Harbor Police discovered roughly 200 charter vessels operating illegally in San Diego. “It’s very disheartening and it hurts because that's revenue lost. I need to pay the bills, I need to pay my rent,” says Valente. Officers and the Coast Guard are conducting joint patrols to stop the illegal operators. "It's not easy, the enforcement, but this does strengthen the rules and make it pretty clear who can and cannot be charter operators,” said Chief Mark Stainbrook, who added he would consider undercover operations if necessary. Stainbrook said the deadly diving boat fire off Santa Barbara's coast is another reminder at why getting this issue right is so important; they can't risk unsafe charters on the water. Valente says he's glad the Port is amending regulations, but isn't sure the current proposal goes far enough. The Port’s proposal is online and an updated ordinance will go before commissioners in December. 2140

  

SAN DIEGO (KGTV) -- Allegations of battery made against a California Assembly candidate have proven to be false, according to the San Diego County Sheriff’s Department.Detectives say after interviewing several witnesses and reviewing surveillance video, allegations against Phil Graham have proven to be unfounded and the case is being closed.RELATED: State assemblyman candidate accused of batteryNiki Burgan filed the report on Sunday, May 20. Burgan alleged that the incident happened on May 14 at the First Street Bar in Encinitas. Burgan said she met Graham and that they engaged in conversation.Burgan alleged that Graham kissed her against her will and followed her outside before attempting to have her touch him in a sexual manner against her wishes.The department says it conducted a thorough investigation and disproved the allegations after being assigned to the case on May 21.10News reached out the Phil Graham and received the following statement:  1006
