ENCINITAS, Calif. -- No dancing allowed. Sounds a little like the movie, “Footloose” right? Well, it’s real — and it’s the law in the city of Encinitas, California.“We got in trouble for people dancing here,” said Brie Cardosa, owner of Mr. Peabody’s Bar and Grill. The restaurant was fined ,000 for allowing their patrons to dance while listening to live music.Cardonas' restaurant has been providing food and live music for more than a decade. She said they have never had any run-ins with the law until they recent fine from the Alcohol Beverage Control.“We didn’t realize we were doing anything wrong,” Cardosa said.The fine stemmed from a city law that makes it illegal to dance in Encinitas during evening hours.Encinitas Councilman Tony Kranz believes his predecessors created the law in 1986 to prevent several dance clubs from being built in the city, or to dissuade people from behaving lewdly at alcohol-serving establishments.“I think it’s just the result of cities trying to limit their liability," he said. "And make it an enjoyable experience for everybody that comes out."The crackdown took place after the city received an overwhelming number of complaints from a number of area bars. Many Peabody’s fans have taken a stand by signing an online petition to let them keep dancing.You can find the petition here. Cardosa said dancing to music is a natural reaction, and found it hard to force her patrons to remain still. “We just don’t want to get in trouble if we’re dancing, or if someone starts moving around,” Cardosa said. “We don’t want to tell them that they can’t dance. It’s such a difficult type thing to explain to someone.”Kranz agrees. “I’ve been there before. and I’ve seen some dancing. I might have even swayed to the music a couple of times there,” he said. “The (Alcohol Beverage Control) interprets their rules that if you sway to the music, you could be in violation of the rules. That is not what city council is interested in having happen.”Encinitas City staff have started work on a revision to the current, and outdated law. In the meantime, Cardosa is hoping the petition persuades the council to let them stay as is. Her other options are to turn in a “deemed approved ordinance” application to temporarily be approved or to submit the “entertainment establishment permit,” also known as the “cabaret permit.” This would allow Mr. Peabody’s to have “dancers“ inside their venue.But that doesn't really align either. “We don’t want to be a dance club. We don’t want to be a dance venue,” Cardosa said. “I hope to have the support of the city behind us, and just you know, move on.”Cardosa said she will continue to host live music at the restaurant several nights a week, without dancing. She is working with city staff to find the best way to legally run her business while making her patrons happy. 2912

Federal Judge Robert Lasnik issued a temporary restraining order on Tuesday "blocking federal government from allowing distribution of downloadable 3D printed" guns, according to a tweet from the Washington State Office of the Attorney General."The judge's rule is clear," Washington Attorney General Bob Ferguson said at a news conference. "We go back to the status quo, before the federal government made the disastrous decision to undo these protections for public safety."At least 10 US states were scrambling to block access to plans that would allow people to print 3D guns on Tuesday.New York Gov. Andrew Cuomo announced a series of actions Tuesday to prevent the distribution of the 3D gun designs. Cuomo issued a cease-and-desist letter to Defense Distributed, a Texas gun-rights organization that posts the plans online, to block the distribution of designs for 3D guns in New York. The governor called the impending release "reckless."Cuomo also directed state police to issue a notice reminding New Yorkers that manufacturing firearms defined as assault weapons is illegal in New York."As the nation rises up and calls for action against gun violence, it is absurd and frightening that the federal government wants to make accessing an automatic weapon as easy as hitting print," he said. "New York is proud to have the strongest gun safety laws in the nation, and we won't let this federal government take us backwards."Cuomo said he will pursue legislation to bolster the state's gun safety laws and outlaw private production of all 3D and so-called "ghost guns" that are untraceable and invisible to metal detectors.Cuomo's actions came after Pennsylvania went to court Sunday to block early distribution of the plans, which weren't supposed to be available for download until Wednesday. But more than 1,000 designs were downloaded recently, in advance of the agreed upon August 1 date.At the hearing, Defense Distributed agreed to block Pennsylvania IP addresses for a few days until a more formal hearing could be held.Josh Blackman, a lawyer for Defense Distributed, told CNN on Monday the Pennsylvania case was about free speech rights, not the manufacture of guns."One state cannot censor the speech of a citizen in another state," he said.Other states also are trying to bar access to 3D printed guns. Iowa and Virginia on Tuesday announced they are joining a federal lawsuit that asks a judge to block the court action that lets people download plansThese latest battles flared after Defense Distributed reached a settlement in June with the federal government that will allow it to post 3D printable gun plans online.The settlement ended a multiyear legal battle that started when Defense Distributed founder Cody Wilson posted designs for a 3D printed handgun he called "The Liberator" in 2013. The single-shot pistol was made almost entirely out of ABS plastic -- the same material Lego bricks are made from -- and could be made on a 3D printer.Wilson sued the federal government in 2015. 3041

ESCONDIDO (CNS) - Two men were stabbed, one fatally, in a gang-related attack at a mobile home park in Escondido and the suspects were at large Saturday morning.The stabbing occurred at 8:30 p.m. Friday in the 500 block of West 15th Avenue near the Centre City Parkway when two men in a black Toyota sedan arrived at the location and began arguing with the victims. At one point in the argument, one of the suspects pulled out a knife and stabbed both victims, according to Lt. Chris Lick of the Escondido Police Department.The victims, ages 30 and 25, were rushed to a hospital where the older man died and the younger man was listed in stable condition, Lick said.The suspects left the area in an unknown direction. ENCINITAS, Calif. (KGTV) - Neighbors are calling for action from the City of Encinitas after a pair of crashes along a stretch of Manchester Avenue."It's too fast," says Judy Blanchard, who lives on Manchester. "They need to do some traffic calming."Friday, a car lost control coming around a curve near the 4200 block of Manchester Avenue and crashed into a light pole. Two days before that, a pair of cars collided near the same spot.People who live nearby say speed on the road is a constant problem."People gun it. They really do," says Blanchard. "All these wannabe fast drivers, it's exciting for them to come through the curve."Blanchard had a car crash through her front yard a few years ago. It almost knocked down her prized palm tree, Bubba.City officials tell 10News they studied the road in 2017. They sent this statement from the City Manager's Office:“Based on the California Vehicle Code (CVC) and California Manual on Uniform Traffic Control Devices (CA-MUTCD), an Engineering and Traffic Study (Speed Survey) was conducted in 2017 which showed the 85th percentile speed (the speed at or below which 85 percent of all vehicles are observed to travel under) on this roadway was 47 mph. As a result, the speed limit was set by the City at 40 mph which is the lowest speed limit legally allowed based on the results of the Speed Survey. The Sheriff’s Office has been notified to increase enforcement efforts along the corridor.” Neighbors say that may not be enough. They say the street needs more warning signs and the city should reduce lanes from two to one near Rancho Santa Fe Road. They don't want to straighten out curves in the road, believing it will lead to more speeding. 1705
