The Chinese government has pointed out that territorial issues are not governed by the UN Convention on the Law of the Sea (UNCLOS), and that it has -- in line with UNCLOS -- excluded disputes concerning maritime delimitation from mandatory dispute-settlement procedures. Some 30 other countries have also made similar exclusions.
The joint statement said the two sides insist on maintaining maritime order on the basis of international law including the UN Convention on the Law of the Sea (UNCLOS) and on freedom of navigation and overflight as stipulated in the UNCLOS. It is in both sides' interests to keep order and regional stability.
"There is a real potential for cooperation between the two countries in the fields of infrastructure, transport, telecommunications and energy," said Han, who is also president of the Chinese People's Association for Peace and Disarmament (CPAPD).
By unilaterally initiating the arbitration, the Philippines has violated its agreement with China as well as its own solemn commitment in the Declaration on the Conduct of Parties in the South China Sea (DOC), he said.
