SAN DIEGO (KGTV) -- The 21-year-old killed while driving across the trolley tracks near Encanto has been identified.The San Diego County Medical Examiner says Alex Garza, 21, was believed to be distracted, possibly on the phone, when he reportedly tried to drive his Toyota Prius across the tracks just before midnight at 60th Street and Imperial Avenue. SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) — The H1N1 strain of influenza is the most prominent strain of the illness in San Diego and around the nation so far this flu season, according to local health officials.Of 1,730 confirmed cases reported in San Diego this season, nearly 94 percent are influenza A, the County Health and Human Services Agency reported Wednesday. Influenza A covers H1N1 and H3N2. The Centers for Disease Control and Prevention believes this is because older adults have been exposed more to H1N1 and younger adults tend to have lower vaccination rates."Older people have some element of immunity to Pandemic H1N1 because they’ve had more exposure to these influenza viruses than younger groups," said Sayone Thihalolipavan, county deputy public health officer, said.Last week, a 26-year-old woman visiting San Diego from Washington, D.C., died possibly due to H1N1 complications. She was also suffering from meningitis, though it's unclear if she had been vaccinated or suffered from any other underlying medical conditions.Another local resident, identified as a 49-year-old male, died of the flu, according to health officials. SAN DIEGO (KGTV) - The former head of the Poway Unified School District appeared in court Monday for a preliminary hearing on five felony charges.Officials charged John Collins with misappropriating and misuse of public money.The complaint accuses Collins of misappropriation of public money dealing with vacation time and sick leave. Poway Unified fired Collins in 2017 after a scathing audit had alleged he received more than 0,000 in overpayments and unauthorized payments.The audit also claims there were an additional ,000 in other transactions that violated district policy and some questionable purchases for airline tickets, dinners and hotel fees.Collins attorney did not respond to 10News request for a comment, but in the past, Collins denied engaging in conduct that was dishonest.If convicted on all charges, Collins could face more than seven years behind bars. 894
